I. Organizational Context
Background
Over the past four years UNDP has provided support for both the Government of Indonesia (GoI) and Indonesian civil society to undertake activities that strengthen access to justice (A2J) in multiple ways. Through the Legal Empowerment and Assistance for the Disadvantaged Project (LEAD), UNDP facilitated the GoI’s formation of the National Strategy on Access to Justice (NSA2J), launched by BAPPENAS in October 2009, and provided grants for NGOs to undertake a range of A2J activities in a number of provinces. In Aceh province, UNDP has also provided timely and comprehensive access to justice support in the post-tsunami and post-conflict context under the Aceh Justice Project (AJP) by strengthening the institutional capacity of the both the formal and informal justice systems.
Both LEAD and AJP projects have been implemented since 2007. In 2011, LEAD and AJP were completed, and a new project called “Strengthening Access to Justice in Indonesia” (SAJI), was introduced.
The SAJI project presents the continuation and expansion of these two UNDP projects, and will be geared towards improved access to justice for Indonesian citizens, contributing to the alleviation of poverty, good governance practices, and empowerment of disadvantaged, vulnerable, and marginalized people.
In accordance with the Jakarta Commitment and the principle of supporting national priorities and policies, the SAJI Project will use the GoI’s National Strategy on Access to Justice (NSA2J) and other relevant Indonesian policy instruments as their guiding framework, which will therefore directly link the policy and local interventions such as the National Action Plan on Human Rights. SAJI will help realize Indonesia’s 2005-2025 Long Term Development Plan, which emphasizes that, consistent with its vision of “A Just Indonesia,” development is to be carried out from the people, by the people and for the people.
The Project
The SAJI Project is developed based on experiences, best practices, and lessons learned from the LEAD and AJP Projects. SAJI consists of the following components:
1. Institutional mechanisms, legal and regulatory framework, and capacities of government institutions strengthened to implement the recommendations and Action Plans of the National Strategy on Access to Justice.
2. Improved public complaint and grievance handling mechanisms (PCMs) in government institutions at both national and subnational levels.
3. Improve people’s access to state-funded legal aid, particularly for women and vulnerable groups.
4. Improve people’s access to fair and accountable justice services in the community-based justice system
5. Knowledge management to inform policies and initiatives to effectively strengthen access to justice and to contribute to Indonesian reporting on the implementation of human rights instruments
Portion of the first component will be implemented through the extension of the LEAD Project the umbrella of the SAJI Project. While originally set to expire at the end of December 2011, both UNDP and BAPPENAS have agreed to extend the duration of the LEAD Project until the end of 2012. This extension is aimed to ensure uninterrupted provision of support for the implementation of the National Strategy on Access to Justice, which was launched at the end of 2009.
Under the direct supervision of the SAJI Project Manager, and the close coordination with the National Project Director (NPD), the Analyst assumes the responsibility to strategize, facilitate and ensure the implementation of all key activities set under the SAJI project, especially in the context of improving public complaint and grievance handling mechanisms (PCMs) in government institutions at both national and subnational levels and people’s access to state-funded legal aid, particularly for women and vulnerable groups as commanded by the National Strategy on Access to Justice and the Law No. 16 of 2011on the Legal Aid
Duties and Responsibilities
II. Functions / Key Results Expected
Summary of Key Functions:
1. Ensure strategic direction of Project Component aimed to improve public complaint and grievance handling mechanisms (PCMs) in state institutions and a regulatory framework and provision of state-funded legal aid that are accessible for the poor, women and vulnerable groups both through policy dialogues at the national and the pilot implementation at subnational levels.
2. Ensures effective implementation of all Project activities set under component of increased access to justice through public complaint and grievance handling mechanisms (PCMs) in state institutions and a quality regulatory framework and provision of state-funded legal aid.
3. Support the provision of top quality policy advice services to the government and facilitation of knowledge building that can inform innovative approaches towards the improvement of public complaint and grievance handling mechanisms (PCMs) in state institutions and a quality regulatory framework for provision of state-funded legal aid and monitor the progress of the implementation.
4. Perform other related duties as required by the Project Manager
Specific responsibilities are as follows:
1. As part of SAJI Project team, the Community Based Justice Analyst ensures the strategic direction of the public complaint and grievance handling mechanisms (PCMs) in state institutions and a quality regulatory framework and provision of state-funded legal aid,focusing on achievement of the following results:
- Building and maintenance of close cooperative relationship with relevant stakeholders and partners at National and sub-National levels including government and non government agencies, universities, researches/study centers, and other development partners.
- Solid analysis of current initiatives/activities being implemented by those relevant stakeholders which have strategic links to goals of the Improvement of public complaint and grievance handling mechanisms (PCMs) in state institutions and a quality regulatory framework of provision of state-funded legal aid as a means to increase access to justice of the poor and the marginalized.
- Review on progress and/or possible gaps within the current initiatives
2. Ensures effective implementation of Project activities under component of increased access to justice through public complaint and grievance handling mechanisms (PCMs) in state institutions and a quality regulatory framework and provision of state-funded legal aid focusing on achievement of the following results;
- Solid analysis of the activities achievements, built colabratory with other components of the SAJI team, timely readjustment of activities as necessary to maximize impact of the SAJI’s supports towards the improvement of public complaint and grievance handling mechanisms (PCMs) in state institutions and a quality regulatory framework and provision of state-funded legal aid as a means to increase access to justice of the poor and the marginalized.
- Draft/revise Term of Reference (TOR) of all project activities implemented under these second and third project components.
- Coordination and facilitation supports for the government and non government agencies, universities, researches/study centers, and other development partners that share common interests on the improvement of public complaint and grievance handling mechanisms (PCMs) in state institutions and a quality regulatory framework and provision of state-funded legal aid as a means to increase access to justice of the poor and the marginalized.
- Supports to organization of or participation into any meetings, workshops, or trainings undertaken by different stakeholders in the context of public complaint and grievance handling mechanisms (PCMs) and provision of state-funded legal aid issues as a means to increase access to justice of the poor and the marginalized.
3. Support the provision of top quality policy advice services to the government and facilitation of knowledge building focusing on achievement of the following results:
- Strategic advice on roles and actions by different stakeholders, respectively by Ombudsman, Komnas HAM, Direktorat HAM-Kemkumham, and BAPPENAS on the public complaints and grievance handling mechanisms, and by the National Law Development Agency (BPHN) and BAPPENAS on the quality regulatory frameworks on provision of state funded legal aid.
- Identification and synthesis of best practices and lessons learnt directly linked to SAJI’s initiatives in supporting national and sub-national Governments in public complaint and grievance handling mechanisms (PCMs) and provision of state-funded legal aid issues as a means to increase access to justice of the poor and the marginalized.
- Sound contributions to knowledge networks and communities of practice on public complaint and grievance handling mechanisms (PCMs) and provision of state-funded legal aid issues as a means to increase access to justice of the poor and the marginalized.
- Substantial contribution into the UNDP Programme Team in producing reporting required under the UNDP internal Monitoring & Reporting (M&R) frameworks, and agreements with donor agencies and other key UNDP partners; and
4. Perform other related duties as required by the Project Manager that may involve other aspects of project work.
III. Impact of Results
The timely and quality of activities implementation with strong analysis on key achievements and lesson learned will enhance the effectiveness of the project support towards the improvement of public complaint and grievance handling mechanisms (PCMs) in state institutions and a quality regulatory framework and provision of state-funded legal aid which will lead to the increased access to justice of the poor and the marginalized. The successful candidate will therefore be required to demonstrate their ability to understand public complaint and grievance handling mechanisms (PCMs) and provision of state-funded legal aid issues as a means to increase access to justice.

Required Skills and Experience
Education: Bachelor, or preferably master degree or equivalent in Law, Business Administration, Public Administration, Economics, Political Sciences, Social Sciences or related field.
Experience:
• 6 years for Bachelor, or 2 years for Master Degree of relevant experience at National or International level.
• Demonstrated knowledge and experience in working on improving access to justice and legal aid sector is essential.
• Prior grant making experience and familiarity of UNDP system, rules and procedures are an advantage.
• Experience in the usage of computers and office software packages and in handling of web-based management system.
• Excellent communication and presentation skills, particularly for coordinating and facilitating various development and governance partners;
• Full of initiative and sound judgment, and demonstrated ability to work in multi-cultural UN environment.
Language Requirements: Excellent command of English and Bahasa Indonesia, both spoken and written.
