Background

The Public Administration Reform Strategy (2010-2013), and PAR Action Plan (2012-2014) aim to reorganized system and institutional capacity building for the planning, drafting and monitoring of legislation as necessary to give binding force to government policies, including approximation to EU legislation; legislative drafting activities shall be carried out according to priorities set out for EU legislation approximation.

There have been a number of good example of citizen friendly public administration, offering online services in public administration. These initiatives should continue with the professional support of experts for administrative processes, who should advise experts on informatics of the fields in which electronic administrative processes can be additionally simplified and administrative burdens eliminated.
 
Communication and participation of citizens aims to reorganized communication system and strengthening the participation of citizens in the drafting process of policies, legislation and decision-making; communication field shall be included in the policy making process.
The execution of many projects which did not respect the approved standards and policies has brought on a situation where various platforms are applied. The creation of these “oasis” which follow different rules and platforms brings on the institutional engagement and cooperation in completing the networking of the systems – interoperability. Interoperability presents the ability of the ITC systems and logical processes that support the trading of data and makes them usable for various purposes .
 
Rationalization of electronic administrative processes shall advance administrative services quality that are provided by the government institutions for citizens, businesses and itself, through digitalization of administrative processes. Advancement of electronic administrative procedures through which administration provides services to the citizens and businesses and drafting standards for their simplification and reduction of administrative barriers shall be achieved. In order to achieve that objective, the following projects are planned by PARAP:
  • Drafting of standards for internal administrative procedures (back office) for all public administration bodies;
  • Drafting of standards for general procedures for offices for services to citizens (front office) and analysis of special procedures for service provision;
  • Drafting and application of quality management standards for service provision and control/inspection of quality of service provision in all institutions.
In short, the following objectives of the PAR Strategy, should be supported  throughout this project:
  • Better coordination of the legislative drafting activities including coordination of priorities set out for EU legislation approximation;
  • Accessibility of the legislation to all citizens and strengthening the participation of citizens in the drafting process of policies, legislation and decision-making;
  • Advancing quality of the administrative services for citizens, businesses, also through digitalization of administrative processes;
  • Simplification of drafting legislation and of  electronic administrative procedures through which administration provides services to the citizens and businesses, in order to increase transparency and reduction of costs;
  • -reduction of administrative costs in offering administrative services to citizens and businesses, using  Standard Cost Model (SCM).
In order to support the above objectives, the project “Better regulation” should  consist of the following expertise and best practices:
  • Implementation of regulatory impact assessment (RIA), which is an effective tool for permanent, modern, evidence-based assessment of regulation. Regulatory impact assessment of the economic, environmental and social impacts is crucial for the design quality of proposed regulations. RIA should be an integral part of the policy making process. It does not replace the political decision: rather it allows that decision to be taken with clear knowledge of the evidence.
  • Simplification of legislation with a view to greater levels of transparency, rationality and efficiency of public administration, focusing on a higher degree of legal certainty and acceptance of rules for citizens and greater accountability by government. Simplification of legislation means a merging various legal provisions from different laws and/or bylaws into a single (legal) text or the transformation according to new rules and codification of certain acts
  • Cooperation (participation) with the public is intended to ensure appropriate integration of civil society in the earliest stage of the process of preparing draft regulations. It is a tool for open governance, and as such early and effective consultation of interested parties. 
  • Access to regulation for those affected by regulation who have the right to be able to access it and understand it; this right is explicitly defined in the legislation but there is no uniformed implementation yet, like annual reporting.
  • Gradual introduction of Common Assessment Framework (CAF) and/or of European Quality Management Framework (EQMF) as quality assessment process in public administration. The CAF provides a self-assessment framework which is conceptually similar to the major Total Quality models, in particular the Excellence Model of the European Foundation for Quality Management (EFQM), but which is especially designed for public-sector organizations, taking into account their characteristics.

Duties and Responsibilities

Under the overall supervision of the UNDP Governance Programme Coordinator and in close cooperation with Director of the PAR Management Department in Ministry of Public and UNDP CTA on PAR, the experts will fulfil the following objectives:
 
Expert #1:
  • Drafting of the procedures, methodologies and standards for introduction of gradual  implementation of Regulatory Impact Assessment (RIA):  Home-based, 15 days.
  • Organizing workshops and other ways to start up of RIA processes in the public administration of Kosovo, aiming to raising the quality of proposed regulations in the public administration of Kosovo (greater levels of transparency, rationality and efficiency of public administration, higher degree of legal certainty and acceptance of rules for citizens and greater accountability by government):  Pristina-based, 15 days.
Expert #2:
  • Drafting of the procedures, methodologies and standards for gradual introduction of CAF and/or EQMF in the public administration of Kosovo: Home-based, 15 days.
  • Organizing workshops and other ways to start up the CAF and/or EQMF quality models processes in a number of state administration bodies of Kosovo in the public administration of Kosovo: Pristina-based, 15 days.
Expert #3:
  • Drafting procedures, methodologies and standards for measurement and reduction of administrative costs and of administrative barriers in offering administrative services to citizens and businesses through digitalization of administrative processes and simplification of drafting legislation in order to increase transparency and reduction of administrative costs (using  Standard Cost Model (SCM)): Home-based, 15 days.
  • Organizing workshops and other ways to start up of these processes in the public administration of Kosovo: Pristina-based, 15 days.  
Expected Results:

Result 1:
  • Gradual introduction of Regulatory impact assessment (RIA) should start and the processes initiated to increase of the quality of proposed regulations.
  • Cooperation (participation) with the public will increase, such as appropriate integration of civil society and other public in the earliest stage of the process of preparing draft regulations and policies.
Result 2:
  • Advancement of quality of the administrative services for citizens and businesses.
  • CAF or EQMF will be introduced and the processes initiated in a number of state administration bodies of the Government of Kosovo (ministries, agencies, etc.) following the principles of Total Quality Management and facilitating the self-assessment of Kosovo public administration.
Result 3:
  • Reduction of administrative barriers in offering administrative services to citizens and businesses through digitalization of administrative processes and simplification of drafting legislation in order to increase transparency and reduction of costs using  Standard Cost Model (SCM).
  • A permanent governmental Steering committee for elimination of administrative obstacles, in order to stimulate and systematically initiate, follow and supervise the process of rationalization of electronic administrative processes composed of experts on administrative processes and experts on informatics would be established. The activities of the steering committee should aim to reducing, eliminating and/or preventing administrative burdens, including the measurement of administrative costs caused to economic operators or citizens.
The task performance of the Steering committee would be drafted and introduced (management and coordination of strategy of e-government in public administration, coordination of state administration in implementing the program for the elimination of administrative obstacles, reform of administrative processes and support the development of e-government with the aim of bringing services closer to citizens and business, registers that provide connectivity and integration of data through IT support processes, proposals for eliminating administrative obstacles and complaints of economic operators and citizens and to prepare appropriate responses, coordinating the program for eliminating administrative obstacles reducing administrative costs).
 
Deliverables / Final Products Expected:

1.
  • The procedures, methodologies and standards for introduction of gradual  implementation of Regulatory impact assessment (RIA).
  • Workshops and other ways to start up of RIA processes in the public administration of Kosovo, aiming to raising the quality of proposed regulations in the public administration of Kosovo (greater levels of transparency, rationality and efficiency of public administration, higher degree of legal certainty and acceptance of rules for citizens and greater accountability by government).

  • Procedures, methodologies and standards for measurement and reduction of administrative costs and of administrative barriers in offering administrative services to citizens and businesses through digitalization of administrative processes and simplification of drafting legislation in order to increase transparency and reduction of administrative costs (by using  Standard Cost Model (SCM).
  • Workshops and other ways to start up of these processes in the public administration of Kosovo.

Required Skills and Experience

Education:
  • Completed at least a Masters Degree in Public Administration, Political Sciences or Law.
Experience:
  • More than 10 years of working experience in the field of public administration, building relations and developing relationships with organizations and the general public.
  • Long working experience in building relations and communication with parties, interest groups and local and international institutions.
  • Sound knowledge on European legislation and the work of international organizations which support the improvement of the management and governance.
Language Requirements:
  • Fluent knowledge of English language.
  • Knowledge of Albanian and/or Serbian is highly desirable.
