Background

Promoting the rule of law is at the heart of the UNDP’s mission. Establishing respect for the rule of law is fundamental to achieving a durable peace in the aftermath of conflict, effective protection of human rights, and sustained economic progress and development. UNDP promotes effective, responsive, accessible and fair justice systems as a pillar of democratic governance. Democratic governance is undermined where access to justice for all citizens (irrespective of gender, race, religion, age, class or creed) is absent and rule of law is not guaranteed to all.

Kyrgyzstan’s transition to the Parliamentary form of governance with the adoption of a new Constitution in 2010, its plan for judicial reform and efforts to deliver security and services to its citizens continue to face political and economic challenges. Corruption is endemic within state administration. Reports of torture and extortion at the hands of the police continue to surface—despite the fact the Kyrgyzstan has become a party to many international human rights treaties. Meanwhile, many citizens—especially most vulnerable groups—lack any meaningful access to justice or livelihoods. April and June 2010 events and their consequences showed that there is strong need for strengthening the rule of law and creating an environment where all people regardless of their ethnic origin, gender or association to any particular social group have equal access to justice.
Accordingly, the focus of the “Enhancing the Democratic Rule of Law to promote peace and stability in the Kyrgyz Republic” Programme is upon building the capacity of justice and security actors to better implement laws, conduct oversight of government and security services, combat corruption, provide service delivery and security and afford citizens and most vulnerable groups access to justice, community security and empowerment.

Under the direct supervision of UNDP Deputy Resident Representative the Chief Technical Advisor (CTA) will be the programme leader and will be accountable for achieving the expected results of the programme; developing and implementing the Annual work plan; coordinating inputs; ensuring compliance with UNDP project management rules and regulations and supporting the UNDP Country Office (CO) with resource mobilization efforts and plans. The CTA will provide advice and direction on strategic and policy issues and ensure that gender sensitive and youth-oriented activities are integrated in the programme plan and implementation strategy. The CTA will also ensure coordination of ongoing individual RoL related projects within the broader programming framework, in which s/he will be supported by the Democratic Governance Programme Dimension Chief. He/she will continuously review the programme status and provide strategic and policy advice to the Democratic Governance Programme Dimension Chief and to the Programme Board on required follow up and/or corrective action and provide direction and guidance to stakeholders on UNDP implementation modalities. The CTA is expected to adopt an on-the-job capacity building approach targeting the National Programme Staff involved, and more importantly the national counterparts.

Duties and Responsibilities

  • Advising on planning the activities of the project and monitor progress against the initial quality criteria;
  • Organizing the technical committee meetings and provide the necessary technical advice to ensure proper design and implementation of programme activities;
  • Convening regular RoL coordination meetings including RoL projects in the CO with support from Democratic Governance Programme Dimension Chief to ensure coordinated implementation of programme activities, integrated programme development and resource mobilization strategy.
  • Advising the national programme staff in the design of annual work plans, time lines for specific activities and budgets;
  • Drafting ToRs and work specifications, identify appropriate international consultants and supervise performance of defined tasks;
  • Ensuring good coordination and collaboration with suppliers, senior beneficiaries and other implementing partners;
  • Liaising with UNDP, donors and other stakeholders and the Project Board to assure the overall direction and integrity of the project;
  • Participating in the Rule of Law sub-group of the DPCC(Development Partners Coordination Council);
  • Identifying and obtaining any support and advice required for the management, planning and control of the programme;
  • Ensuring monitoring and update the risks and issues logs according to Programme Board decisions;
  • Monitoring events as determined in the visibility & communication plan, and update the plan as required;
  • Monitoring financial resources and accounting to ensure accuracy and reliability of financial reports;
  • Drafting proper financial/administrative and narrative report to donors regularly;
  • Providing progress reports to the Project Board, or through other oversight mechanisms established;
  • Providing briefings and written reports to UNDP senior management, donors and other stakeholders, including the development of the Programme Quarterly Progress Reports (progress against planned activities), and development of the Annual review report, and submit the report to the Project Board;
  • Providing all assistance and information for Programme Evaluators. Developing the organizational chart of the project and identifying required skills and functions, and, in collaboration with UNDP CO, preparing the Terms of Reference, participating in the recruitment process of programme staff and in the identification of short-term experts;
  • Contributing efforts to resource mobilization for the programme;
  • Undertake any activity as required by the Programme and the UNDP CO
In particular the following is expected from CTA during the first year of programme implementation:
  • RoL project is officially launched. First quarter report with analysis of RoL Programme activities (prioritization, introduced stages of implementation), resource mobilization plan, achievements and planned activities for the next quarter submitted and approved by Deputy Resident Representative - 31 August, 2013
  • Coordination of donor activities in RoL area strengthened and productive partnership established with main active national and international actors in this field. Identified potential UNDP RoL Programme donors/investors received developed proposals and negotiations are going on. Second quarter report with analysis of RoL Programme activities and achievements and planned activities for the next quarter submitted and approved by Deputy Resident Representative – 30 November,2013
  • Third quarter report with analysis of RoL Programme activities (including financial
  • analysis and forecast), achievements and planned activities for the next quarter submitted and approved by Deputy Resident Representative – 28 February,2014
  • Final report on whole assignment with special section providing Recommendations to
  • the Government on RoL reforms that might be introduced in the country and to UNDP RoL Programme adjustments submitted and approved by Deputy Resident Representative 31 May, 2014.

Required Skills and Experience

Education:

  • Advanced University degree (Masters or PhD) in the areas of Law, political science or related discipline

Experience:

  • At least 7 years of progressively responsible experience in rule of law, access to justice and democratic development related fields. Previous experience in post-conflict areas is an asset;
  • Prior experience of working on UNDP Rule of Law/Legal support projects would be highly advantageous;
  • Knowledge of UN/UNDP operations and programmes and familiarity with UNDP programme execution rules and regulations is an asset;
  • Knowledge and experience in working on policy development and capacity building;
  • Strong knowledge / experience in results based management and results oriented approach to project implementation
  • Excellent computer skills.

Language Requirements:

  • Fluency in English and ability to draft and edit project documents, proposals, correspondence, briefings and presentations in English. Knowledge of Russian language is an asset.
