Background

Since the deployment of MINUSTAH (Mission des Nations Unies pour la Stabilisation d’Haiti) in 2004, there have been major improvements in the Haitian security situation, demonstrated by declining crime rates and the public’s growing confidence in the Haitian National Police. The situation remains fragile, though, due to the poor quality of living conditions of the large majority of the population.

The coming years will be a big challenge for the further consolidation of the democratic rule in Haiti, especially given the recent creation (July 2012) of the Council of the Judicial Power (Conseil Supérieur du Pouvoir Judiciaire) and June 2012’s Constitutional amendments. The existence of an efficient and credible rule of law system is a prerequisite for stability in Haiti. The limited capacity of the judiciary to administer justice quickly has led to a sharp rise in the prison population, which lives in overcrowded conditions.

UNDP has been a main actor in support to the rule of law sector over the past 10 years. In close coordination with MINUSTAH, UNDP provided technical and financial assistance to Haiti on justice, police and prison related activities (actually phasing down police and prison activities) and leads the Justice working group for technical and financial partners as well as the Integrated Strategic Framework (ISF) Institutional Refundation pillar.

Recently, within the Global Rule of Law focal point, UNDP and MINUSTAH worked together to develop a joint programming framework for Rule of Law.

To foster collaboration and promotion of one UN, the project aims at:

  • (i) joint planning and prioritization;
  • (ii) joint resource mobilization;
  • (iii) co-location where possible and desirable;
  • (iv) joint review of activities at technical level.

Overall policy coordination is sought through the Policy Group which has been established in 2009, with participation of both DSRSGs (Deputy Special Representative of the Secretary General) and Head of Agencies of UN organizations involved in Rule of Law. UNDP’s role in Rule of Law is focusing mainly on institutional capacity building and service delivery of the judiciary.

The rule of law project has 2 main components:

  • Support to the Judiciary;
  • Support to institutional capacity building of the Ministry of Justice and Public Security, Supreme Court (Cour de cassation), Council of the Judicial Power (Conseil Supérieur du Pouvoir Judiciaire), School of Magistrates (Ecole de la Magistrature).
Residual activities will remain on police and prison (support to the penitentiary data base and construction of Les Cayes’ maritime base).

Through all components, the Rule of Law Project aims at (i) supporting justice services delivery in two critical areas (Port de Paix, and Port au Prince), (ii) strengthening national capacities to design and implement policies on Justice (of which the PACTE JUSTICE, the MoJ work plan on capacity building).

The RoL Project is actually in a transition phase in which resource mobilisation will be central for the future programming (2014-2016). A new project document is currently being drafted and discussions around a Peace Building Fund submission are ongoing. The RoL project manager will have to develop a strategy to mobilize fund, strengthen existing partnerships and develop new ones. Resources mobilization efforts will be key throughout the project.

The Project Coordinator will reside in Port-au-Prince, with missions on the field.

Duties and Responsibilities

Provide strategic direction and leadership in the rule of law area and is responsible for the implementation of the overall project:

  • Head the overall Rule of Law Project;
  • Provide senior high level policy advice to government and other partners.
Support partnership building and resource mobilization for UNDP in the project area:
  • Drafting of a RoL’s mobilization strategy, identifying funding needs, gaps and potential funding partners;
  • Implementation of the ROL mobilization strategy;
  • Develop fundraising proposals and strategies for stronger partnerships with donors;
  • Regularly liaise with potential partners, donors and corporate institutions for fund raising purposes;
  • Prepare regular concept notes and project proposals for submission;
  • Ensure communication of the project’s result and disseminate information to the donors.
Ensure knowledge management:
  • Under the direct supervision of the Country Director, the Rule of Law Project Coordinatorr provides strategic direction and leadership in the rule of law area and is responsible for the implementation of the overall project;
  • Leads the Rule of Law team in project vision, planning, development and implementation to ensure a project which is relevant, in line with UNDP Haiti’s country programme strategy and responsive to changes in the country context;
  • Supervises all project managers in the rule of law area;
  • Leads in exploring stronger synergy and joint programming and implementation modalities with other UNDP projects (e.g. early recovery and disaster risk reduction), MINUSTAH and UNCT partners;
  • Provides strong leadership and an overall strategic vision with a view to building national capacities, strengthening the rule of law to support the overarching peace-building objective of the UN, in close coordination with MINUSTAH;
  • Ensures the integration of cross-cutting issues, such as gender, HIV/AIDS, peace building, human rights and ICT, into rule of law project design, monitoring and evaluation;
  • Ensures regular monitoring and evaluation, including but not limited to regular field visits and participation in Project Board and/or Steering Committee meetings;
  • Directly supervises and provides effective leadership to the UNDP project managers in the area of Justice and capacity strengthening.

The Rule of Law Project Coordinator heads the overall Rule of Law Project and is responsible for adherence to the following corporate standards:

  • Additional resources are mobilized to implement the RoL project;
  • Oversees overall work plans and budgets for all activities in the project portfolio and the continuous monitoring of work plans;
  • Ensures timely and adequate reporting against plans, including timely and articulate progress reports.

The Rule of Law Project Coordinator promotes UNDP’s mandate and corporate policy and provides senior high level policy advice to government and other partners:

  • Promotes rule of law results, ensuring appropriate levels of visibility and public awareness on results and ongoing activities;
  • Provides policy advice to UNDP Senior Management in Haiti, government counterparts, donors and other partners on issues related to rule of law;
  • Represents UNDP, as requested by the Country Director, Deputy Country Director or Resident Representative.

The Rule of Law Project Coordinator supports partnership building and resource mobilization for UNDP in the project area:

  • Ensures sufficient resource mobilization for the project in close consultation with Senior Management and is co-responsible for reaching the annual resource mobilization targets;
  • Advocates for UNDP rule of law work and represents UNDP Haiti with national authorities, MINUSTAH and UNCT, the donor community, and international financial institutions;
  • Liaises regularly and forges close linkages with other UN programmes, agencies and entities, as well as other international and national stakeholders concerned with or providing assistance on rule of law issues in Haiti;
  • Ensures high-quality and timely reporting to donors and other partners involved in the project;
  • Contributes to the harnessing of effective partnerships and competitive selection of partners for implementation of UNDP projects;

The Rule of Law Promotes joint programming and UN reform, and collaborates effectively in established frameworks for UN and other international coordination:

  • Promotes identification and synthesis of best practices and lessons learned from the project area for organizational sharing and learning as well as external information;
  • Actively participates in UNDP knowledge networks and takes advantage of best practices and lessons learned that are available in the region and globally, and encourages project staff to do so by creating a culture of knowledge sharing and learning;
  • Uses and promotes the use of the Regional Service Center and integrates RSC expert advice in project design and implementation;
  • Promotes the participation of UNDP Haiti in regional programmes and regional activities related to the project area as appropriate;
  • Supports capacity and knowledge building of national counterparts;
  • Any other tasks as assigned by the Country Office.

Required Skills and Experience

Education:

  • Advanced university degree (Masters) preferably in political science, law, international studies, development studies or a related field.

Experience:

  • A minimum of 10 years of relevant professional experience in development, preferably in emergency and post-conflict situations, with a focus on field-work;
  • Proven experience of at least 10 years of specialist expertise in rule of law;
  • Proven experience in handling donors and development partners;
  • Proven successful experiences on resource mobilization;
  • Good knowledge on gender-based and Human Rights based approaches to programming;
  • Senior-level management responsibilities of similar scope and complexity is desirable;
  • Previous experience with UNDP is desirable.

Language Requirements:

  • Strong written and spoken skills in French and English;
  • Knowledge of additional UN languages, in particular Spanish, is desirable but not required.
