Background

Access to justice for women is a critical component of UN Women’s work globally and at national level. UN Women’s progress report, In Pursuit of Justice (2012) presents evidence of factors that enable and hinder women’s access to justice. An important observation of the report is that financial allocation to justice for women and girls is limited. It finds that although strengthening the rule of law has been a major priority for governments for several decades, components on women’s access have been less visible. The report therefore recommends a significant scaling up of investments in women’s access to justice to support the implementation of legal commitments in this field.

The assignment under contemplation therefore, seeks to provide an analysis of the factors that facilitate and inhibit access to justice for women in Uganda, with a view to providing entry points for Government of Uganda (in particular the Judiciary), UN Women and other actors on priorities for funding in order to improve access to justice for women in Uganda. The consultant will work with and feed into work of the lead consultant who is undertaking the review of financing for access to justice for women. The findings from this review will inform the priority recommendations for funding by Government and development partners in Uganda. Additionally, the consultant will work closely with and inform the consultancy on development of the bench briefs for the judiciary, aimed at enhancing gender responsiveness of the judiciary.

Duties and Responsibilities

Under the supervision of the Deputy Representative, the consultant will be responsible for the following:

  • Activity 1. Undertake a review of the state party reports to the Committees on CEDAW, the UPR and the UN Committee on ESCR as well as corresponding Concluding Observations and Recommendations in specific relation to women’s access to justice;
  • Activity 2. Review the National Gender Policy, the Beijing +20 report, the JLOS Gender Policy and Strategy as well as the JLOS SIP III for barriers to women’s access to justice and dwell on the recommendations for improving accessing access to justice for women, and other relevant national and international documents on Uganda’s commitment to women rights, gender equality and empowerment of women;
  • Activity 3. Make specific inputs to the UN Women contribution to the UNCT reports on the implementation of CEDAW and the ICESCR in Uganda;
  • Activity 4.  Make specific inputs/ recommendations on the women’s access to justice priorities for purposes of informing the concurrent research on financing for women’s access to justice. The consultant will closely cooperate and coordinate with the GRB consultant;
  • Activity 5: Support the country office in developing funding raising program proposals to strengthen women’s access to justice, through identified priority actions. This will be done through preparations and engagements with JOLS and other relevant ministries, departments, agencies in Government, CSOs in particular women human rights defenders and relevant development partners;
  • Activity 6: Support the country office and the UN Convergence Group on Gender Equality and Empowerment to write gender briefs for the different sectors priorities of the National Development Plan II;
  • Activity 7: As Gender and Human Rights Expert support the writing team for the National Development Plan II, with focus on ensuring that the identified gender priorities are fully integrated and budgeted in each sector project and in the overall final NDP II document;
  • Activity 8: Participate in and provide technical inputs including serving as a facilitator and making presentations in UN Women workshops and forums, as requested by the Deputy Representative;
  • Activity 9: Work closely with and inform the consultancy on the development of the bench briefs for the judiciary, aimed at enhancing gender responsiveness of the judiciary.

Required Skills and Experience

Education:
  • Minimum of Master's degree or equivalent in Law, Gender Studies, International Relations, Development studies or other related disciplines;
  • A combined gender and legal background will be an asset.
Experience:
  • A minimum of 10 years of professional experience in programme work and policy analysis at a national or international level with specific focus on women’s human rights, gender equality and empowerment of women;
  • Experience in gender, international law, human rights law, legal practice or legal research and analysis from a gender perspective, with extensive knowledge of the Ugandan legal systems;
  • Experience in working UN, international organizations and/or research and training institutions, with specific emphasis on women’s human rights;
  • Demonstrated hands-on experience in developing policy briefs, knowledge products and advocacy materials and tools in the field of women’s human rights;
  • Experience in the usage of computers and office software packages, experience in handling of web based management system;
    Extensive experience as a researcher on gender and women’s rights, in particular access to justice;
  • Demonstrated experience in the use of law and human rights-based approaches to address development issues/ challenges in advancement of gender equality and empowerment of women;
  • Strong experience with strategic planning for policy and programme interventions on women’s access to justice;
  • Strong background in developing proposals on advancing women’s human rights;
  • Experience with UN work highly desirable.

Language Requirements:

  • Excellent skills in English , both oral and written, are required;
  • Knowledge of one or more local language is highly desirable.

Individual consultants will be evaluated based on the following methodology:

  • Technical Criteria: 70 points;
  • Financial Criteria: 30 points.

Technical Criteria – Maximum 70 points

  • Criteria A:  Relevance of Education – 15 points;
  • Criteria B: Special skill (excellent communications, professionalism) Language, etc. - 5 Points;
  • Criteria C: Relevance of experience in conducting similar assignment – 25 points.
  • Criteria D: Description of Approach/ Methodology to complete the assignment– 25 points.
 The assignment will be undertaken from August-December 2014. The consultant will be paid on deliverables as follows:
 
20% on submission of:
  • an approved inception report detailing methodology, sources and work plan
  • draft report containing recommendations for key actions and indicators for enhancing women’s access to justice in Uganda, (estimated time 31st August 2014).

20% on:

  • presentation of draft report to a selected audience and;
  • submission of final report fully incorporating feedback from audience (estimated time 30th October 2014).
20% on:
  •  submission of funding proposals/briefs and successful facilitation of funding engagements/ discussions /workshops with identified funding partners (estimated time 30th September 2014).
20% on:
  • submission of gender briefs for the different sectors to the NDP II writing team; complete with analysis, evidence, justification, strategies, budget and indicators (estimated time August 2014).

20% on:

  • successfully representing UNW on the NDP II writing team and integrating the gender issues in the final NDP II( estimated time Sept 2014).
