Background

Following Yemen’s political unrest of 2011, and the signing of the Gulf Cooperation Council peace initiative in November of that year, the Republic of Yemen has embarked on a two-year transition agenda. Against the backdrop of this political transition, and the request of the Yemeni authorities, the United Nations has articulated a Joint UN Framework to Support the Transition in Yemen, 2012-2014, which provides an important basis for UN assistance during this period. In this context, Rule of Law (RoL) has been identified as a key priority for Yemen, and for international assistance. In explicit contribution to this transition agenda, UNDP has developed a broad strategic programme of assistance in the areas of RoL, justice and security, human rights and transitional justice. This project document represents one component of this overall strategic support;

There are many human rights challenges, which need to be addressed in Yemen. Recent developments underpin the need for dialogue and consultation on human rights; stronger civil society organizations which are able to effectively advocate for the citizens’ rights; enabling government systems and institutions to address human rights challenges; and, engaging civil society. UNDP is committed to support the establishment of permanent and independent Human Rights structures which can monitor the human rights situation in the country, support National NGOs working on Human Rights issues and assist the existing Human Rights Ministry to address all Yemen’s national and international obligations;

The purpose of the assessments is:

  • A functional Assessment of the Ministry of Human Rights is aimed at supporting the Ministry and the Government to identify strengths and weaknesses in the Ministry’s capacity. The assessment will need to study the current structure of the Ministry and propose amendments as necessary particularly in light of the expected establishment of an Independent National Human Rights Institution (INHRI). The assessment should also address areas for capacity building by the Government and other partners in order to improve it service delivery of the Ministry during the Transition period;

Scope:

  • The assessment will be a desk review of any of the assessments previously completed (if any)in order to ensure that the review is of maximum usefulness and relevance, the assessment reports used should also be as recent as possible, but not more than two years old;
  •  The review will cover areas of the national Human Rights needs and service provision provided by the Ministry and those expected to be provided by the INHRI. The functional review should address gaps, overlap, complimentary and provide a vision for the possible future role of the Ministry.

Methodology:

  • The consultant will begin with the collection of existing review reports from the Ministry and will also consider the Ministry’s’ own experience and knowledge;
  • The consultant will work in close collaboration and coordination with the UNDP and donor technical working group (or any existing modality if any) established by UNDP or other donors), to gather data from the government authorities or for arranging of meetings with government officials, and any other assistance the consultant may need to accomplish the tasks assigned;
  • The consultant will give special attention to the aspects that the current Ministry’s structural shall have a potential of being replaced or reshaped into an Independent National Human Rights Institution and issues related to the management and the capacity of these authorities to benefit from the services and assistance received from the Government and donors in general and technical assistance in particular;
  •  The consultant will prepare a draft report on the results of the assessment, based on an agreed outline. UNDP office will share the draft report with all concerned parties, beneficiaries and other development partners.

Institutional Arrangement (Reporting system/Unit):

  • The CTA for the Human Rights project will directly supervise the consultant;
  • The consultant is expected to liaise and collaborate with the Human Rights Project staff in the course of performing the work.

Duties and Responsibilities

 Deliverable:

A National Consultant is needed for this assignment.

The National Consultant is expected to carry out an initial assessment and basic information document of the Ministry of Human Rights, its roles, functions and structure. The assessment should also indicate recommendations for the future role and structure of the Human Rights Ministry after the establishment of the INHRI. All this analysis, assessment and recommendations should be provided by the consultant in a report format. 

Expected Outputs and Deliverables ( Duties and Responsibilities);

  • Desk assessment of previous work and/or documents (2-3 days);
  • Assessment current structure of the Ministry of Human Rights (2-3 days);
  • Analysis of the possible future role function and recommendation of future structure, including interviews with concerned individuals and bodies (6 days);
  • Report writing (9 days).

Competencies

Competencies:

  • Must have collaborative work style;
  • Good communication and interpersonal skills;
  • Proven skills in working independently on computers-especially on MS-Word, MS-Excel and MS-PowerPoint;
  • Outstanding networking, team building, and organizational skills;
  • He should be Independent of the Government of Yemen and should have prior experience advising on such assessments;
  • Broad understanding of governance and accountability and Transparency issues;
  • Ability to identify and collect reports on the Government management systems and best practices in Yemen;
  • Knowledge of Arabic is essential.

Required Skills and Experience

Qualifications:     

  • Advanced degree in Political Science, Law, or Human Rights.

Experience:

  • Minimum 10 years or proven work experience in the legal field, human rights, or gender equality areas;
  • Experience and expertise in reviewing public management systems, HR and legal background such as consultants who have worked on preparing assessments and similar reports.

Language required:

  • Fluent Arabic.
