Background

The Lao PDR acceded to the United Nations Convention against Transnational Organized Crime (UNTOC) and the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children (TIPP) on 26 September, 2003. The accession to the UNTOC and TIPP prompted a strengthening of the legal framework on human trafficking in the country.

Lao PDR has made considerable effort to develop and implement its national laws and provisions on human trafficking, and meet its obligations under the UNTOC and TIPP. However, prosecution rates remain low and victim protection is limited. There are also gaps in the legal framework, which hamper effective implementation of the existing laws on human trafficking and associated crimes.

Through the LAOX26 project UNODC has been working with the Lao Ministry of Justice (MoJ) to ‘Strengthening Criminal Justice Responses to Human Trafficking in Lao PDR’, funded by J/TIP.  The overall purpose of the project is to reduce human trafficking by strengthening the country’s capacity to implement its laws to effectively prevent, investigate and prosecute human trafficking, and protect and empower victims of trafficking. The current project extension until 2016 will continue targeted interventions in the areas of: (1) legal reform; (2) capacity-building and cooperation, and; (3) empowerment of victims and (4) awareness of risks and rights.

Purpose of the assignment:

Under the overall supervision of the Project Manager of the Project LAOX X26 based in UNODC Bangkok, the consultant while in Laos will report directly to the Country Manager and  work in close cooperation with National Project Officer (X26) . The Consultant is expected to provide high quality technical guidance and support to the Office of the Supreme People’s Prosecutors.  In addition, the expert/consultant will be expected to develop and deliver a training programme the meets international standards for prosecuting human trafficking related cases, to further strengthen the capacity and understanding of prosecutors who will play a key role in the presentation of all forms of human trafficking related cases.

Expected Results:

Expected Deliverables (as per above scope of work):

  • Work plan for development and delivery of prosecutors training enhancement program;
  • Report on outcome of training needs assessment workshop with draft curriculum;
  • Report on presentation to key stakeholder from OSPP;
  • Report detailing approved training program, including training manual and training aids;
  • Report of ToT for prosecutors training enhancement program;
  • Report on delivery of two training programs delivered by trainers, including observations and recommendations;
  • End of mission report;

Duties and Responsibilities

The consultant will provide technical assistance in line with UNPODC strategic objectives and in accordance to counterpart requirements, and perform the following tasks:

  • Develop a working plan for the development and delivery of the prosecutor training enhancement program;
  • Conduct Training needs assessment (TNA) workshop to identify the training needs of prosecutors and a proposed training curriculum based on the TNA;
  • Present findings of TNA including proposed curriculum to key stakeholder within Office of Supreme People Prosecutors for approval to develop training program;
  • Develop a training program based on approved curriculum.Including training plans for each topic or module, power point presentations a participant workbook and other training aids as required;
  • Conduct a training of trainers (ToT) for prosecutor training enhancement program with identified trainers;
  • Oversee the delivery of two training program delivered by trainers, accompanied by national stakeholders and UNODC staff to 2 selected provinces (Champasack and Luang Prabang), 7 days/time after the completion of ToT in Vientiane;
  • Prepare other substantive inputs, as required;
  • Prepare end of mission report.

Required Skills and Experience

Academic Qualifications:

  • At least University degree in law.

Experince :

  • At least 10 years of relevant professional experience within the law & justice sector which proven of investigating or prosecuting trafficking in persons is highly desirable;
  • Professional experience in developing and delivering legal training which is victim-centered and based on human rights;
  • Professional experience in coaching and delivering training concerned with anti-human trafficking would be a very strong asset;

Languages:

  • Excellent written and spoken English.

Interested individual consultants must submit the following documents/information to demonstrate their qualifications: 

Technical Proposal as per Annex III “Offer’s Letter to UNDP”

  • Explaining why you are the most suitable for the work;
  • Providing a brief methodology on how they will approach and conduct the work including the work schedule for the delivery of outputs/deliverable;
  • CV including past experience in similar project and contact reference of at least 3 references for whom you have rendered preferably the similar service.

Note:

The financial proposal shall specify a total lump sum amount, and payment terms around specific and measurable (qualitative and quantitative) deliverables (i.e. whether payments fall in installments or upon completion of the entire contract). Payments are based upon output, i.e. upon delivery of the services specified in the TOR. In order to assist the requesting unit in the comparison of financial proposals, the financial proposal will include a breakdown of this lump sum amount (including travel, per diems, and number of anticipated working days). All envisaged travel costs must be included in the financial proposal. UNDP accept travel costs not exceeding of an economy class air ticket.

Only a consultant obtaining a minimum of 50 points in the technical rating would be considered for the financial evaluation.
