Objective XXVIII of the National Objectives and Directive Principles of State Policy of the Constitution of Uganda (1995) provides a Constitutional basis for Uganda’s foreign policy. However, there is no enabling law. In addition there is no existing law giving effect to the establishment of the Uganda Institute for Diplomacy and International Affairs. Foreign policy currently relies on uncoordinated mandates provided for under various Instruments. These, include: the National Development Plan (2010/11 – 2014/15); Presidential Manifestos; Security Sector Framework; the Ministry Strategic Investment Plan (2009/10 – 2013/14); ICT Policy and Master Plan; Human Resource Development Policy; Diaspora Strategic Business Plan. The Ministry of Foreign Affairs with support from United Nations Development Programme (UNDP), has decided to engage services of one Individual consultant to carry out thorough review of various literatures on Uganda’s foreign policy and the institutional framework and formulate bills to provide legal basis for Foreign Service and UIDIA.

Duties and Responsibilities:

  • The objective of the assignment is to develop a Uganda Foreign Service Bill, which when enacted into law will operationalize the Constitutional Provisions on foreign policy;
  • To develop the UIDIA Bill to give effect to the establishment of the UIDIA.

Duties and Responsibilities

Scope of Work:

The consultant shall undertake the following tasks:

  • Carry out a SWOT analysis on Uganda’s reviewed foreign policy and make appropriate recommendation in relation to the Bill;
  • Review and analyze existing sector policies, laws, etc. that impact on foreign policy and  propose ways and means to enhance synergies between them and the proposed Foreign Service Act;
  • Carry out consultations with key national stakeholders with a view to promoting consensus on the new Act;
  •  Identify best practices from other nations that can be adapted to the Uganda Foreign Service Bill;
  •  Participate in all consultative processes including the Inter-ministerial committee and Civil Society Organizations meeting, the Retired Senior FSOs meeting, Parliament committees meeting and the National Validation Workshops
  • Prepare and submit bills including applicable reports.

NB: The Foreign Service Bill shall include, but not be limited to, the elements outlined by Ministry of Foreign Affairs (that will be shared at the inception stage of the assignment).

Duration of the assignment:

The assignment shall be completed within a period of forty (40) work days from the date of signature of the contract.

The Consultant will be expected to be available on a full time basis, to complete and submit expected outputs as per the timelines indicated below:

  • An Inception Report (by end of September 2014);
  • A Uganda Foreign Service Bill and UIDIA Bill (by end of September 2014); and
  • A comprehensive Report (by October 2014).

Expected Outputs/deliverables:

The Consultant shall prepare and submit four key documents, namely:

  • An Inception Report for both bills;
  • A Uganda Foreign Service Bill that should include, but not limited to, the elements outlined by Ministry of foreign Affairs and the UIDIA Bill;
  • A Report on the process leading to the finalization of the Bills.

NB: Documents will be submitted in hard copy format (2 of each) and electronic format.

Reporting, Monitoring Progress Controls:

  • The Consultant will work closely with the Office of the First Parliamentary Counsel in formulating the Bills;
  • The consultant will supervise, assign and clear work of the other member of the Team;
  • The Consultant will be responsible for incorporating inputs from relevant stakeholders at every stage of the process; and reporting to the Permanent Secretary, Ministry of Foreign Affairs;
  • The assignment will be carried out under the close supervision of the Foreign Service Bill Steering Committee; under the overall guidance and leadership of the Permanent Secretary, Ministry of Foreign Affairs;
  • The Ministry of Foreign Affairs, as the implementing body, will conduct routine and progress monitoring and evaluation of outputs of the Consultancy Team.

The Consultant shall have the following responsibilities:

  • Have responsibility for the overall direction of the assignment;
  • Review of all documentation considered necessary for finalization of the assignment;
  • Lead the Consultancy Team during meetings or other consultative discussions with the Client or any other stakeholder(s) in the course of the assignment;
  • Bear the ultimate responsibility for the overall quality of the assignment deliverables.

Competencies

Competencies:

  • Analytical capacity and demonstrated ability to process analyse and synthesize complex, technical information from different disciplines;
  • Demonstrated research skills and ability to write clearly and concisely;
  • Good report writing and presentation skills, demonstrated experience in a similar or related assignment and experience in planning;
  • Ability to act professionally and flexibility to engage with a diversity of stakeholders.

Required Skills and Experience

Education:

  • A Master’s Degree in Law from a recognized University;
  • A Postgraduate Diploma in Legal Practice from the Law Development Centre.

Experience:

  • At least 10 years of experience in the practice of legal affairs, 5 of which must be in legislative drafting;
  • Must have drafted or participated in the drafting of at least two (2) Bills and they should be mentioned;
  • Experience working in either a national or international organization or a setting related to legislative drafting.

Language:

  • Excellent spoken and written English language and interpersonal communication skills.

Price Proposal and Schedule of Payments:

This will be based on skills, qualifications and experience for the job.  The consultancy team shall be responsible for all taxes, as applicable. Payments shall be made upon satisfactory submission of the following documents:

  • Inception Report:  20%
  • A Uganda Foreign Service Bill and UIDIA Bill: 70 %;
  • A comprehensive Report: 10 %.

Evaluation Method and Criteria:

Cumulative analysis

The award of the contract shall be made to the individual consultant whose offer has been evaluated and determined as:

  • Responsive/compliant/acceptable, and
  • Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation;
  • Technical Criteria weight; - 70%;
  • Financial Criteria weight; - 30%.

Only candidates obtaining a minimum of 49 points (70% of the total technical points) would be considered for the Financial Evaluation

Criteria: Points

  • Qualification: 20;
  • Knowledge of legislative drafting: 40;
  • Relevant experience in conducting similar assignments: 15;
  • Description of approach/methodology to assignment: 10;
  • Understanding of Diplomacy, International Affairs and Foreign Services context: 15.

Interested individual consultants must submit the following documents/information to demonstrate their qualifications in one single PDF document:

  • Duly accomplished Letter of Confirmation of Interest and Availability using the template provided by UNDP (Annex II);
  • Personal CV or P11, indicating all past experience from similar assignment, as well as the contact details (email and telephone number) of the Candidate and at least three (3) professional references.

Technical proposal:

  • Brief description of why the individual considers him/herself as the most suitable for the assignment;
  • Brief statement on understanding of the Terms of Reference  and methodology, on how they will approach and complete the assignment;
  •  Financial proposal that indicates the all-inclusive fixed total contract price, supported by a breakdown of costs, as per template provided (Annex II).
