Background

The Universal Periodic Review (UPR) is a unique process which involves a review of the human rights records of all UN Member States. The UPR is a State-driven process, under the auspices of the Human Rights Council, which provides the opportunity for each State to declare what actions they have taken to improve the human rights situations in their countries and to fulfil their human rights obligations. The UPR is one of the key elements of the Council which reminds States of their responsibility to fully respect and implement all human rights and fundamental freedoms. The ultimate aim of this mechanism is to improve the human rights situation in all countries and address human rights violations wherever they occur.

In May 2010, the human rights record of the Turkey was reviewed for the first time as part of the process known as the Universal Periodic Review (UPR). 167 separate recommendations were made, of which 121 were accepted and 43 rejected; 2 received a general response and 1 received no response. During the review, Turkey expressed the delegation’s commitment to follow up on all questions and recommendations with great care.  The acceptance rate assess the political will demonstrate Turkey’s will to comply with international human rights law. The second cycle of the Universal Periodic Review of Turkey (UPR) will be held in January/February 2015. The follow-up of the UPR recommendations is the most critical and important phase of the whole UPR process as it is the one leading to the concrete realization of the UPR goal that is the "improvement of the human rights situation on the ground". UPR therefore provides a new opportunity for Turkish government comply with its human rights obligations and commitments.

 Supporting the efforts of the Government and civil society during this process, United Nations in Turkey initiated a Joint Program for Enhancing the Monitoring and Implementation Capacity of the Outcome Document of UPR in March 2013. The referred Program directly targets institutions which are the leading stakeholders of the review process such as the Ombudsman, the National Human Rights Institute and NGOs, both accredited and potential accreditation takers. It is also expected that Government of Turkey will benefit from the improved monitoring and follow up of the implementation of the outcome document of UPR.

Within this framework, the international consultant shall support the UNJP in terms of developing a manual to be used by national actors to sensitize them on strategies of implementing the recommendation of the UPR. The referred toolkit will be instrumental to bridge gaps in the current strategies used by those actors, as well as to link them around a comprehensive understanding of the implementation of the UPR recommendations

Duties and Responsibilities

The Universal Periodic Review (UPR) is the latest international protection of human rights’ mechanism and provides a new opportunity to hold the Turkish government accountable to all its human rights obligations and commitments. Similar to other human rights mechanisms, the UPR encourages all relevant stakeholders to engage in dialogue and challenge their governments to respect, protect and fulfill the broad range of human rights under the international law.

The main objective of the assignment is development of a toolkit for effective monitoring of the implementation of the UPR outcome document.

The Toolkit is expected to address the following:

  • Role of national stakeholders before, during and after the UPR process;
  • Strategies for national stakeholders in preparing stakeholders report for the UPR;
  • Guidance to the national actors to take active part during the review;
  • Strategies for the NGOs on monitoring the implementation of the UPR recommendations;
  • Other country experiences on the above.

In specific terms, the consultant will be required to undertake the following tasks:

  • Identify the needs for effective monitoring of the implementation of UPR outcome;
  • Conduct a comparative assessment on effective implementation of the UPR and reporting mechanisms in other countries;
  • Develop a toolkit for the stakeholders to monitor implementation of the UPR outcome document.

The Consultant will serve under the direct supervision of UNDP, as the lead implementing agency of the UNJP.

Timing, Duration and Place of Work

The Assignment is planned to start on 15 September 2014 and completed by 24 November 2014. The total number of days to be invested in the whole assignment shall not exceed 33 days in 2 months.

Activity and Timing - International Consultant

  • Identify the needs for effective monitoring of the implementation of UPR outcome - 10 days - Ankara / Place of residence;
  • Conduct a comparative assessment on effective implementation of the UPR and reporting mechanisms in other countries - 3 days - Place of Residence;
  • Develop a toolkit for the national actors to monitor implementation of the UPR outcome document - 15 days - Place of Residence
  • Contingency – 5 days.

Total Days Allocated for the Assignment - 33:

  • The expert shall work in his/her place of residence and in Ankara.

Deliverables and Payment

The International Consultant will be hired under an Individual Contract (IC) and be paid in USD on daily basis and the payments schedule for International Consultant is set out in the table below.

Deliverable - Payment Conditions:

  • Submission of the report on needs for effective monitoring of the implementation of UPR outcome - 10 working days of the contracted amount;
  • Submission of the comparative assessment brief on effective implementation of the UPR and reporting mechanisms in other countries - 3 working days of the contracted amount;
  • Submission of the toolkit on effective monitoring of the implementation of UPR outcome document - 15 working days of the contracted amount.

The International Consultant is expected to submit a timesheet on the number of days invested along with the deliverable.  The amount paid shall be gross and inclusive of all associated costs such as social security, pension and income tax. Assignment-related travel and accommodation costs will be borne by UNDP upon submission of documentation.

* The payment conditions indicated herein represents the maximum amount to be paid for the particular deliverable and will be based on the actual number of working days invested for the development of each deliverable.

The total working days cannot exceed 33 days.

Required Skills and Experience

Education:

  • Advanced degree in the field of human rights, international development, or law;
  • Full proficiency in English;
  • Having computer literacy is required.

Experience:

  • Minimum five (7) years of relevant professional experience in the field of human rights;
  • Extended knowledge and experience on UPR process;
  • Experience of developing effective human rights monitoring mechanisms and tools;
  • Working experience with human rights institutions and civil society organizations.

Notes:

  • Internships (paid/unpaid) are not considered professional experience;
  • Obligatory military service is not considered professional experience;
  • Professional experience gained in an international setting is considered international experience;
  • Experience gained prior to completion of undergraduate studies is not considered professional experience.

Documents To Be Included When Submitting the Proposals.

Interested individual consultants must submit the following documents/information to demonstrate their qualifications:

Proposal:

  • Explaining why they are the most suitable for the work;
  • Provide a brief note about the proposed approach and/or systematic to be followed for the achievement of the outputs of the Project;
  • Personal CV including past experience in similar projects and at least 3 references;
  • P11.

Financial Proposal:

The candidates will be requested to submit ‘Financial Proposals’ upon completion of technical evaluation.

The financial proposals shall be submitted in UNDP’s standard format which will be communicated to successful candidates. The financial proposal shall specify the daily fee, travel expenses and per diems quoted in separate line items, and payments are made to the Individual Consultant based on the number of days worked.

Payment:

The International Consultant will be paid in USD on the basis of the number of days invested for each deliverable, as approved by UNDP;

The International Consultant shall be paid upon submission and approval of the above described deliverables. The International Consultant shall also prepare a timesheet that shows the number of days invested for each deliverable.

The amount paid shall be gross and inclusive of all associated costs such as social security, pension and income tax. Assignment-related travel and accommodation costs outside of home base will be borne by UNDP upon submission of documentation.

Evaluation

Applicants meeting the minimum requirements listed in the Terms of Reference will be short-listed and asked for price proposals. The selection of the Consultant will be made in accordance with the quality- cost based selection method (70% technical component and 30% price component). Only short-listed candidates will be contacted.
