Background

UNDP has its support to SGBP project which contribute to the goal of creating sustainable and well-governed path of development for Socotra Archipelago that ensures the conservation of its globally important biodiversity. The main components of the project is supporting the local governance and provide them with suitable mainstreaming tools that will ensure the sustainable decision making by new Socotra governorate decision makers. The Socotra Conservation Zoning Plan (CZP) which approved by precedential decree No (275) for the year 2000 is still the main legal document. The CZP is mainly a framework without details and need to be detailed and enriched by other related laws and legislations.

Duties and Responsibilities

  • The National Legal Advisor will prepare regulations and by-laws that are necessary for the full implementation of the Conservation Zoning Plan (presidential degree 275, 2000, Cabinet decree 45, of 2008). The National Legal Advisor will review national environmental laws & regulations, prepare a Training-of-Trainers’ module on them and impart a training to staff of EPA, de-concentrated line ministry offices on Socotra and Governorate officials on the environmental legal context of Socotra.  In this task, he will be actively supported by the Natural Resource Management Specialist;
  • Additionally, in collaboration with the Natural Resource Management Specialist and the Environmental Planning Advisor, the National Legal Advisor will take the lead role in ensuring that biodiversity mainstreaming tools identified by these experts are embedded into the Conservation Zoning Plan in a legally appropriate manner, considering national laws and international obligations.  In collaboration with the Environmental Planning Advisor, the National Legal Advisor will impart trainings on the appropriate use of mainstreaming tools to local administration officials;
  • The National Legal Advisor will facilitate a workshop to delineate institutional mandates between the Governorate and EPA in terms of their responsibilities in conserving biodiversity and the mandatory use of biodiversity data supplied by EPA for Governorate planning processes.  As a conclusion of this work, the National Legal Advisor will prepare a legal document outlining these responsibilities to be submitted for approval by the Governorate;
  • The National Legal Advisor will outline the integration of Protected Area entry fees into the EPA revenue fund;

Deliverables:

  • Base line report: Mainstreaming tools their compatibility with national laws and regulations for  6 working days in Sana’a;
  • Field work consultation for 14 working days in Socatra;
  • First stakeholder WS for 1 working day in Socatra;
  • Field work consultation for 15 working days in Socatra;
  • Second stakeholder WS for 1 working day in Socatra;
  • Preparation of draft report: draft detailed guidelines and by-laws to CZP considering main production sectors for 8 working days in Socatra;
  • Final document and a assist in preparation of training-of-trainers’ modules on the application of biodiversity mainstreaming tools as embedded into the CZP for 8 working days in Socatra;
  • Train local authorities on application of mainstreaming tools for 6 working days in Socatra;
  • Training: environmental legal framework to EPA and line ministry officers for 10 working  days in Socatra.

Required Skills and Experience

Education:

  • Post-graduate degree in Law or related fields.

Experience:

  • At least 5 years of experience drafting legal and/or regulatory instruments;
  • Experience/specialization in environmental law;Experience in formulating strategies and concepts;
  • Experience in developing guidelines, frameworks and training modules;
  • Communication and training.

Language:

  • Excellent writing skills (Arabic required, English desirable).
