Background

The justice chain refers to the actions and actors involved in obtaining remedies for rights violations. This chain differs for civil and criminal settings as well as by whether the forum in question is formal or informal. The criminal dimensions of justice, particularly in formal settings, are more complex as they entail a multiplicity of steps and different rules of evidence: contact with the police (reporting), medical and social services, legal aid, investigations, forensic examinations, arrests and detention, interim orders, prosecution, adjudication, judicial decisions, and enforcement. Intrinsic to the justice system is the involvement of multiple agencies and structures including the police, prosecutions, immigration, prisons, lawyers and social services.

The ability of women to access justice is dependent upon a number of demand and supply factors. Demand concerns the extent to which women are aware of their rights, of the institutions created to protect and enforce them, have trust in the system, and the attrition rates which are fundamental to setting any judicial process in motion. Supply factors include the availability of easily accessible court facilities, legal aid and victims’ assistance, filing fee waivers, linguistic access, gender responsive policing, judicial interpretation and the availability of friendly spaces and related social services. All these are equally important in ensuring that women not only access legal remedies, particularly through the justice system, but that they also do so effectively.

The rule of law and capable institutions, grounded on human rights, are serious considerations for the soon to be agreed Sustainable Development Goals and related targets. Given the critical role and place of justice in a country’s system of accountability, UN Women is in the process of developing a Guidance Note on Women’s Access to Justice as a programmatic source of reference for its staff at global, regional and country levels.

This Guidance Note will place UN Women in readiness to implement the forthcoming General Recommendation of the Committee on the Elimination of All Forms of Discrimination against Women (CEDAW) and related commitments that will arise from the soon to be concluded post-2015 development framework.

Duties and Responsibilities

The consultant will work closely with a team consisting of UN Women’s Constitutional and Access to Justice Advisor, consultants and staff members. She/he will work with the team to ensure that essential programme planning and programme cycle bench marks and content are fully taken into account in the preparation of the proposed Guidance Note.  The consultant will be responsible for the following deliverables:

  • Prepare a brief on the implications of UN Women’s programme cycle and content on gender responsive programming e.g. in undertaking  situation analysis, mid-term reviews and the preparation of Strategic Notes: March 12, 2015;
  • Participate in internal and external consultations on the design, content and nature of the Programme Guidance and produce a report on the programmatic implications and outcomes of these consultations: June 17, 2015;
  • Develop a chapter on a step-by-step approach to integrating women’s access to justice in programming, using as a source of reference, essential landmarks in UN Women’s programming cycle and ensure that all aspects of the Programme Guidance on Women’s Access to Justice are consistent with the programming cycle content and process: October 23, 2015.

Required Skills and Experience

Education:

  • Minimum of Master's degree in Planning in combination with Gender Studies.

Experience:

  • A minimum of 10 years of progressive experience in programme design and monitoring, particularly within the UN system;
  • knowledge of programming in the field of gender justice administration, including professional understanding the dynamics of the justice chain, vertical and horizontal relationships within and across ministries and departments;
  • Experience in inter-agency or inter organization collaboration an advantage;
  • Knowledge of the interface between civil, criminal, informal and quasi justice will be a strong advantage.

Language:

  • Fluency in English is required;
  • As this assignment will require the identification of sources in other languages, proficiency in another UN working language will be an asset.
