Background

The creation of a National Human Rights Institution (NHRI) in Sudan was stipulated both in the Comprehensive Peace Agreement (CPA) and the Interim National Constitution in 2005. In 2009, the National Assembly passed the National Human Rights Commission Act. In January 2012, the National Human Rights Commission (SNHRC or “the Commission”) was formally established by a presidential decree.

As a part of UNDP’s commitment to strengthening human rights promotion and protection mechanisms in Sudan, the UNDP Governance and Rule of Law Unit has been providing capacity building and technical support to the SNHRC since its establishment in 2012. The main objective of the “Strengthening the Capacity of the Sudan National Human Rights Commission” project is to support the SNHRC in the development of its operational, technical and legal capacities in order to become a cornerstone within Sudan’s national human rights protection system.

Based on the results of a capacity assessment of the SNHRC, conducted in September 2013 within the framework of this project, UNDP supported the SNHRC to develop a 5-year Strategic Plan (2014 – 2018), which was adopted and launched by the Commission in March 2014. The Strategic Plan outlines the Commission’s vision, strategic priorities and objectives and contains a detailed and phased result activity framework. Phase I (2014) aims to strengthen Governance and Sustainability of the Commission, by supporting the development of institutional infrastructure and organizational development. Phase II (2015 – 2016) focuses on increased capacity development and human rights programming. The project is aligned with the Strategic Plan and aims to support its implementation.

The Commission is currently composed by 15 Commissioners and a few administrative support staff and is thus in urgent need of qualified management and technical staff to become fully functional. According to the Strategic Plan and the organizational structure, the Commission is planning to set up four departments, namely Research and Information (Public Education and Training, Legislative and Policy Analysis, Information’s and Publications), International Relations (International Reporting, Treaty monitoring, Liaison), Complaints and Monitoring (Registrar, Investigations) and Corporate Services (Finance, ICT, HR, Admin). Further, positions at management level are planned to be created to support the Chair, Vice-Chair and Secretary General.

A key area of Phase I of the Strategic Plan is the hiring of new staff, according to a recently developed organizational structure. In order to prepare and carry out the recruitment process, UNDP is looking for an international consultant specialized in Human Resources (HR) to develop a detailed Human Resources Plan for the Commission and support the roll-out of a national recruitment campaign.

Duties and Responsibilities

The objective of this consultancy is to develop a Human Resources Plan for the SNHRC to facilitate the recruitment of the Commission’s staff. Therefore, the consultant is expected to undertake the following tasks:

  • Develop a Human Resources Plan for SNHRC: The consultant will design a HR plan, in close collaboration with the Commission, which will be based on the planned staffing level and specific positions as outlined in the organizational structure of the Commission. It is expected that the HR plan will include a staff recruitment policy, ethics policy, applicable public administration guidelines, job descriptions (see next task), reporting relationships, performance management planning, and equity objectives that take into consideration geographical and professional diversity, as well as gender equity. The HR plan should also include a program for volunteers to benefit youth and build community engagement;
  • Develop job descriptions for vacant positions: The consultant will develop – in close cooperation with the Commission - detailed job descriptions (including required qualifications and work experience) for the required positions in each department, including directors and staff, as well as for management level.

Provide advice on the preparation and roll-out of national recruitment campaign: According to the Strategic Plan, the Commission aims to recruit management and key staff, including department directors and investigation/monitoring staff, in 2014 (Phase I). The consultant will support the Commission in the preparation of a national, competitive recruitment campaign by a) preparing recruitment guidelines, which will contain the modalities of the recruitment process, and are in accordance to Sudanese labor law and international standards, and b) by providing technical assistance and on-the-job training to kick-start the hiring process. Hiring outcomes should demonstrate sensitivity to gender equality in all ranks of the organization, and should seek to attain diversity in regional representation and representation by disadvantaged groups.

The consultant is expected to produce the following deliverables, with in the below mentioned tentative timeframe:

Institutional Arrangement

  • The consultant will work under the overall supervision of the Team Leader of the UNDP Governance and Rule of Law unit and reports to the Rule of Law Programme Officer. The consultant will work in close cooperation with the SNHRC.

 Duration of the Work

  • The assignment period is expected to be 25 working days, within a 2-months time frame .

 Duty Station

  • The consultant will be based in Khartoum and within both UNDP and the Commission premises.

Competencies

Functional Competencies:

  • Expert knowledge of mandates, powers and functions of National Human Rights Institutions and demonstrated experience providing technical assistance to NHRIs and government agencies in the area of Human Resources;
  • Familiarity with United Nations policies, methods and procedures is a requirement; familiarity with UN support to National Human Rights Institutions an asset;
  • Previous work experience in Sudan and/or the region is an asset;
  • Demonstrated initiative and perseverance; self-starter, highly motivated and comfortable in a multi-cultural team setting; Personal sensitivity and commitment to the values of the United Nations;

Required Skills and Experience

Qualifications of the Successful Individual Contractor

Education:

  • Master's degree or equivalent in Human Resources Management, Social Sciences, Political Science, Economics, International Relations, International Law, Human Rights or other disciplines related to the assignment;

Experience:

  • 7- 10 years of progressively responsible experience in Human Resources management and development at international level, preferably in/with National Human Rights Institutions or comparable institutions that have a human rights mandate.

Language:

  • Proficiency in English and (both spoken and written);
  • Working level of Arabic is essential.

Scope of Price Proposal and Schedule of Payments

The consultancy fee will be determined on a lump sum basis. The lump sum amount must be all-inclusive and the contract price must be fixed regardless of changes in the cost components. Daily Subsistence Allowance (DSA) and travel fees to the duty station will be included in the lump sum. Payment will be made upon completion of all deliverables and following the submission of the final mission report.

Criteria for Selection of the Best Offer

The offers received from the candidates will be evaluated using combined scoring method. The combined scoring method assesses the offers with technical merits of the proposals – where the qualifications and methodology will be weighted a max. of 70%, and later combined with the price offer which will be weighted a max of 30%.

The price proposals of candidates obtaining 49 points and higher (or 70% or above) will only be technically qualified; they will be reviewed and compared for the assessment of overall ranking of the proposals. Those obtaining lower than 49 points (or lesser than 70%) will be technically non-responsive proposals, price proposals of such candidate will not be compared.
