Background

In December 2014, 14 human rights organizations and civic initiatives working for/in Donbas (eastern Ukraine) created a coalition “Justice for Peace in Donbas” with the aim to create a national database of human rights violations in Donbas and to contribute to the restoration of justice in the region. The coalition has evolved since, elaborated/adjusted its methodology for documenting rights violations, while expressing the need for specific topic-based, technical and organizational capacity development needs.

Within the frame of UNDP’s long-term commitment to cater support for the recently established CSO Coalition in enhancing its technical and organizational capacities, the need to extend its vision while embracing smart practices came around.  Therefore, learning from the Balkan country experience that lived through a similar conflict and its aftermath seemed pertinent and timely. Hence, a study tour would offer first-hand opportunity to best benefit the Coalition’s learning.

The goal of the study tour is to expose Ukrainian human rights defenders, civil society activists to Serbian experience and best practices of:

  • Documenting human rights violations in local or regional conflicts, armed conflicts, etc. aiming at renewing the violated rights and restoring justice;
  • Raising awareness and organizing/conducting effective national and international advocacy campaigns, to bring perpetrators to liability;
  • Making alliances among human rights actors, as well as brokering relationship with other stakeholders, including but not limited to agents in law enforcement, investigation, court litigations, etc. to orchestrate efforts for justice renewal purposes. 

Duties and Responsibilities

Main objectives

The Contractor/Consultant should organize a Study Tour for 2,5 – 3 working days in Belgrade for tentatively 18 – members of the CSO Coalition “Justice for Peace in Donbass”  engaged in documenting human rights violations in eastern Ukraine.

Description of responsibilities / scope of work:

  • Developing plan and programme for the Study Tour in Serbia, including the agenda, logistical note for participants, list of entities to meet, basic information on the visits, sites, study materials, etc., in the English language. The agenda should consist of meetings with the experts from the relevant human rights documentation center in Serbia, as well as relevant state agencies/institutions dealing with documenting/investigating human rights violations like law enforcement agencies, prosecution, judiciary, etc. The final agenda is to be cleared by UNDP Ukraine;
  • Organizing all meetings during the study tour, including one orientation/introductory meeting for participants at the beginning of the study tour, one social event to facilitate networking between the Ukrainian and Serbian counterparts;
  • Facilitating and providing the logistics for the study tour including identifying and booking suitable accommodation and meals, organizing local transportation services, interpretation.

Deliverables and implementation schedule:

  • The Contractor will produce the following written outputs submitted in the English language;
  • A detailed draft agenda of the study tour and logistics note for the participants approved by UNDP Ukraine;
  • Study tour activities, including meetings and site visits.

Study Tour time schedule: It is expected to conduct the study tour in the week commencing 11 May.

The following instalments will be done according to the deliverables stated above:

  • Agenda and logistics note.  Delivery: 5 May 2015, 5 Instalment: 70%;
  • Study successfully conducted.  Delivery: 15 May 2015, 5 Instalment: 30%.

Payments will be made only upon confirmation of UNDP on delivering on the contract obligations in a satisfactory manner (to be agreed with the Contractor upon signing of the contract).

Monitoring/Reporting requirements

DHRP Coordinator will supervise the work of the Consultant through regular in person and e-mail/or telephone / Skype communication. Upon completion of the task, the final report, in English, shall be submitted electronically.

Required Skills and Experience

Education:

  • Bachelor degree in international law, humanitarian law, human rights, international relations or similar social sciences majors).

Experience:

  • Minimum of 3 years’ experience in documenting human rights violations, including, retrieving, storing, processing, protecting the information; working with witnesses and victims; organizing and conducting awareness and lobbying campaigns to restore rights violations;
  • Ability to transfer Serbian/Balkan knowledge on documenting human rights violations, including but not limited to trainings delivered, study tours organized etc. (previous/current cooperation with institutions mentioned in the TOR is an asset).
  • Track record of cooperation with Serbian national institutions responsible for restoring justice, protecting and renewing human rights, conducting investigatory and litigation processes;

Languages:

  • Knowledge of the English language;
  • Knowledge of Ukrainian/Russian would be an advantage. 

Documents to be included when submitting the proposals:

  • Personal CV, including information about past experience in similar projects / assignments and contact details for referees;
  • Financial proposal.

Financial proposal - Lump sum contract

The financial proposal shall specify a total lump sum amount, and sums pertinent to specific and measurable (qualitative and quantitative) deliverables. Payments are based upon output, i.e. upon delivery of the services specified in the TOR.  In order to assist the requesting unit in the comparison of financial proposals, the financial proposal will include a breakdown of this lump sum amount. 

Travel:

  • All travel arrangements will be handled by DHRP if such travel is deemed necessary.

Administrative arrangements

It is expected that the Consultant will be involved into distance and on the ground consultancy work involving cabinet research and Skype / online consultations with the Ukrainian counterparts / experts/DHRP team. The work will be conducted in close coordination with the CSO Coalition “Justice for Peace in Donbas” (eastern Ukraine). Space/technical equipment will not be provided. The Expert shall work under the direct supervision of the DHRP Project Coordinator.

Selection method:

  • Desk review.

Evaluation criteria:

  • Educational background - 20 points max ( 20 pts – Master’s degree in international law, humanitarian law, human rights, international relations or similar social sciences majors, 10 pts – Bachelor’s degree in international law, humanitarian law, human rights, international relations or similar social sciences majors);
  • Relevant professional experience - 30 points max (30 pts – over 7 years of experience in the area of documenting human rights violations, protecting and promoting human rights, conducting awareness raising and advocacy campaigns in Serbia and/or other Balkan countries (as full-time or part-time consultant, expert, official,  20 pts – between 5 and 7 years of experience in the area of documenting human rights violations, protecting and promoting human rights, conducting awareness raising and advocacy campaigns in Serbia and/or other Balkan countries (as full-time or part-time consultant, expert, official, 10 pts – between 3 and 5 years of experience in the area of documenting human rights violations, protecting and promoting human rights, conducting awareness raising and advocacy campaigns in Serbia and/or other Balkan countries (as full-time or part-time consultant, expert, official);
  • Cooperation with stakeholders in the area of investigating human rights violations, protecting and promoting human rights, conducting awareness raising and advocacy campaigns, including Serbian governmental and non-Governmental actors, or other stakeholders from across the Balkan countries as well as international human rights treaties/agencies/mechanisms - 15 points max (15 pts – evidence of such cooperation on the national and international level, 10 pts – evidence of such cooperation on the national level);
  • Language Skills - 5 points max (5 pts – English as well as Ukrainian and / or Russian, 3 pts – English).

Maximum available technical score - 70 points.

Evaluation method: Cumulative analysis

Contract award shall be made to the incumbent whose offer has been evaluated and determined as:

  • Responsive/compliant/acceptable;
  • Having received the cumulative highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

Technical Criteria weight: 70%/Financial Criteria weight: 30%

Only candidates obtaining a minimum 70% from the maximum available technical score (49 points) would be considered for the Financial Evaluation

The maximum number of points assigned to the financial proposal is allocated to the lowest price proposal and will equal to 30. All other price proposals will be evaluated and assigned points, as per below formula:

30 points [max points available for financial part] x [lowest of all evaluated offered prices among responsive offers] / [evaluated price].

The proposal obtaining the overall cumulatively highest score after adding the score of the technical proposal and the financial proposal will be considered as the most compliant offer. After successful completion of the validation interview the offeror will be awarded a contract.

Individual Consultants are responsible for ensuring they have vaccinations/inoculations when travelling to certain countries, as designated by the UN Medical Director. Consultants are also required to comply with the UN security directives set forth under dss.un.org
