Background Information

A well-functioning, effective, efficient and de-politicized public administration is a prerequisite for democratic governance. Public administration reform should lead to enhanced transparency and accountability and improved service delivery for citizens and business. For Kosovo it also plays a fundamental role in the European integration process. The public administration reform in Kosovo is an on-going process which includes changes to the legal and organisation structure of central and local administration, personnel management, capacity development, training and results based management, as well as regulatory reforms. It also refers to targeted legal reforms, such as the revision of the civil service laws and by-laws.
The new strategy on public administration modernisation  2015-2020 has its foundation on the newly created political context, and the need to foster public administration development in conformity with the demands for an efficient, effective and Europeanization of administration, and is expected to foster a professional, transparent and accountable public administration, able to meet the demands of the citizens.

The Strategy is based on three pillars:

  • Development and coordination of policies and legislation;
  • Civil Service development, management of human resources, provision of public administrative services, re-organisation of the public administration and accountability;
  • Public Finance Management.

Globally and regionally UNDP has extensive experience on public administration reform, including capacity development of the civil service, including experience in working in accession countries. This experience has translated into a dedicated support for the Ministry of Public Administration in Kosovo, with a focus on the legal framework, salary system development, introduction of institutional quality mechanisms, as well as the development of individual and institutional capacities.

UNDP Kosovo will continue its support to the overall implementation of the public administration modernization strategy, with a specific focus on the first two pillars as noted above. To this end UNDP is now seeking specialists in four key areas as listed in the Scope of Work section.
Key beneficiary will be the Ministry of Public Administration while other institutions will be supported based on identified needs and mandate on advancing the modernization process.

Note on Long Term Agreement (LTA)

UNDP Kosovo shall establish a roster based on applications and enter into a long term agreement (LTA) with the selected consultant(s) and shall provide specific deliverables and time frames for each task, as and when required. Prospective individuals are requested to take note of the following:

Long Term Agreement is an arrangement between UNDP and an individual to provide the required services at prescribed prices or provisions over a period of 12-36 months. UNDP reserves the right to rescind the agreement during that period should performance of the consultant not meet its requirements.

Under a Long Term Agreement, UNDP does not warrant that any quantity of services shall be purchased during the term of this agreement. Where a request for services arises, UNDP shall directly contract the consultant based on its need to carry out those activities. A specific Term of Reference (TOR) outlining the outputs for each assignment shall be provided and an Individual Contract would be issued to the consultant, detailing the time frame.

Objectives of Assignment

Support the Ministry of Public Administration, line ministries, municipalities, and agencies, to implement the Strategy for the modernisation of public administration 2015-2020.

Duties and Responsibilities

Scope of work

Under the direct oversight of UNDP Governance Portfolio Manager/Deputy Programme Coordinator, and in close cooperation with beneficiaries, the consultants will advise, guide, support, and inform the following processes:

Legal framework consultants:

  • Review, amend, and draft primary and secondary legislation pertinent to public administration (comparative analysis, legal review, harmonisation with the aquis);
  • Support the implementation of the legal framework through capacity development activities (training, on the job-learning, exchange of experiences);
  • Legislative advice to beneficiary institutions on broadening the reform to the whole of the public sector;
  • Strategic advice to senior leadership in government institutions;
  • Substantial contribution to and participation in the working groups for finalizing and amending of primary and secondary legislation.

Policy development, implementation and monitoring consultants:

  • Prepare comparative analysis;
  • Draft policy papers, strategies and action plans (with costing);
  • Develop systems and mechanisms for monitoring and evaluation of policy implementation;
  • Advise and provide inputs for mechanisms for improved communication and coordination at horizontal and vertical level in regard to implementation of the PAR strategy;
  • Elaborate and introduce best practice with respect to the policy-making processes.

Human Resource Development consultants/Change Management consultants:

  • Support the implementation of the Civil Service Training Strategy and the Action Plan including its review and update as needed;
  • Support the development of structured trainings for various categories of civil servants;
  • Development of training curricula and their implementation for select categories of civil servants;
  • Identify and address weaknesses in administrative structures/capacity development needs;
  • Identify and address weakness in the management system;
  • Develop Monitoring and Evaluation procedures for HR departments on capacity development for civil servants.

Organisational and institutional development consultants:

  • Assess the need for development of structured institutional capacity assessment;
  • On the basis of the capacity assessment process and reports, support and oversee the implementation of the Capacity Development Plan to achieve the milestones identified and address the identified capacity gaps;
  • Support the sensitisation, ownership and implementation of the capacity development process;
  • Provide authoritative policy advice and technical guidance on CDP implementation and delivery.
  • Advise the MPA on the direction, strategies and technical issues concerning capacity development and institutional strengthening;
  • Collaborate with development partners and other stakeholders to enable a harmonized approach and collaboration;
  • Establish dialogue with donors, partners and stakeholders to maintain effective working relationships, sustain interest, and increase cooperation;
  • Provide coaching and mentoring to key partners to support the capacity development process.
  • Improve governance through transparency and accuracy by embedding best practices and processes into all its operations, doing away with non-value adding/redundant processes in the course of regulating and establishing excellence in Institution.

The consultants are also require to provide technical advice to UNDP on approaches to public administration on a need to basis, with a focus on opportunities and risks, capacity development needs, and on the adoption approaches to foster behavioural change.

Deliverables/ Outputs:

Organisational and institutional development:

  • Policy proposals, position papers, presentations and/or documents for internal and external strategic discussions, consideration, policy formulation and assessment and/or approval;
  • Identified best practices and lessons learned to build capacity and knowledge, codified and disseminated through case studies, guidance notes and other relevant media.

Target Due Dates:

  • To be determined prior to each engagement.

Review and Approvals Required:

  • Governance Portfolio Manager/Deputy Programme Coordinator/Senior leadership in the beneficiary institution.

Deliverables/ Outputs:

  • Final report documenting the implementation of the contractual obligations including home based deliverables submitted (summary of the deliveries achieved, deliveries in the process of implementation and further assistance required).

Estimated due dates:

  • After the completion of each assignment.

  • Written legal expertise on primary and secondary legislation;
  • Comparative Analysis;

  • Final report documenting the implementation of the contractual obligations including home based deliverables submitted (summary of the deliveries achieved, deliveries in the process of implementation and further assistance required).

Required Skills and Experience

Education:

  • MA in Law, public administration, public policy, Human Resources, Business Administration, or a related field.

Working experience:

  • A minimum of 10 years of relevant professional experience with a proven track record;
  • A minimum of 8 years of working experience in enacting client-oriented reforms and providing strategic advice;
  • Knowledge of the aquis experience in legal harmonization;
  • Specialized knowledge on public administration (central and municipal) legislation;
  • Substantial experience at a senior level management/leadership in public governing organisations/institutions a distinct advantage;
  • Familiar with Kosovo’s public administration, particularly the reform process; experience in Kosovo on public administration a distinct advantage;
  • Highly developed coordination and facilitation skills and the ability to negotiate complex agenda with a broad range of stakeholders.

Language:

  • Fluent in spoken and written English;
  • Albanian and/or Serbian desirable.
