Background

UNDP Myanmar has been implementing UNDP Country Programme for 2013-2017 with the aim to promoting local governance, growth and sustainable development with the emphasis on rights-based, gender sensitive, inclusive and equity. This goal will be pursued through three complementary components; Local Governance, Environmental Governance and Disaster Resilience, and Democratic Governance.

Environmental Governance and Disaster Resilience Component of UNDP Myanmar - focuses on strengthening capacities at local, regional and national level to manage and utilize natural resources in a sustainable way, and to enhance resilience and adaptive capacity to long-term climate change including variability impacts and to reduce the associated risk of natural disasters.

 UNDP has been closely working with Ministry of Environmental Conservation and Forestry to improve environmental governance in Myanmar. The Environmental Conservation Department, which is chairing the Government’s Environment Sector Working Group, requested UNDP to assist in the development of a “National Environmental Policy, Strategy Framework and Master Plan”.  It will serve as a guiding policy framework to incorporate environmental conservation in relevant sectors i.e. to mainstream environment policy into national planning, sectoral policies and law to ensure sustainable development of the country.

 UNDP is now looking for an international consultant who will provide technical assistant to Environmental Conservation Department in developing “National Environmental Policy”.

Duties and Responsibilities

Under the guidance of the Director General and Deputy Director General of Environmental Conservation Department, Ministry of Environmental Conservation and Forestry of Myanmar and the Team Leader (Environmental Governance and Disaster Resilience) of UNDP, and under the direct supervision of Programme Specialist/ Programme Analyst of UNDP, the International Consultant will develop “National Environmental Policy” covering the following results and activities.

 Key Result 1: Institutional and legal analysis on Environmental Conservation in Myanmar

Myanmar’s economy is shifting from an agriculture-based economy towards greater industrialization and integration with global markets. This has prompted an increase of investments in extractive industries and the energy sector including hydroelectric power.

In this context of transformation, the sustainability of natural resources and environmental conservation and management are important considerations in the planning and implementation of the country's development. Over the last twenty years, a policy and normative and institutional framework has been established and a series of studies have brought light on emerging environmental trends. Policy, normative and institutional developments together with changing environmental trends present challenges that need to be addressed in a comprehensive National Environmental Policy Framework, for which purpose the National Environment Policy of Myanmar was issued in 1994 needs to be updated.

A thorough review on relevant existing policies and other related documents for environmental conservation is required for preparation of National Environmental Policy which would cover all relevant sectors that can be mainstreamed into implementation for national, sectoral and spatial planning and implementation processes.

In this context, the consultant will review the documents including, but not limited to, the following documents:

  • Environmental policy (1994),
  • Mining Law (1994),
  • Myanmar Agenda 21 (1997)
  • National Sustainable Development Strategy (2009),
  • Environmental Conservation Law (2012),
  • Guidelines of Investment by Myanmar Investment Commission (2013),
  • Environmental conservation rules (2014)
  • National Comprehensive Development Plan
  • Relevant documents related to State of Environment in Myanmar
  • Environmental related other Sectoral Laws

The consultant will also review the political, social and economic changes in Myanmar relating to environmental conservation. The consultant should be familiar with the environmental policies of other countries to identify the success and gaps relevant for Myanmar for consideration in developing the National Environmental Policy for Myanmar.

As per the findings on the review process and discussion with key stakeholders from the different sectors, the consultant will prepare the Institutional and legal analysis on Environmental Conservation in Myanmar.

 Key Result 2: Development of National Environmental Policy through Focus Group Discussions

In consultation with Environmental Conservation Department and other key stakeholders, the consultant will identify the focus areas which have strong linkages with environmental conservation.

The consultant will undertake the discussion with focus groups from relevant thematic areas to explore the key issues to be covered under the National Environmental Policy and later to develop Environmental Strategy Framework. Through the consultation process with the stakeholders, the consultant will develop the draft of National Environmental Policy.

With the feedback from the Ministry of Environmental Conservation and Forestry and other key stakeholders on the draft, the consultant will finalize the National Environmental Policy and submit to the Ministry for endorsement.

 Key Result 3: Roadmap for development of Environmental Strategy Framework and Master Plan

The consultant will prepare the roadmap (work plan) for developing Environmental Strategy Framework and Master Plan including identification of different working groups to be formed, the process and the key activities to be followed, required resources and timeframe, etc.

Required Skills and Experience

Education:

  • Advanced degree in Environmental Studies, Environmental Policy and Regulation, Natural Resource Management, or related fields.

Experience:

  • At least 7 years of international working experience in environmental conservation, policy development and environmental legislation;
  • Work experience in drafting environmental policy and law, in other countries with similar context in Myanmar;
  • Familiarity and understanding of environmental governance and natural resource management issues in Myanmar will be considered as an advantages;
  • Experience in working with UN or international organizations or government agencies.

Language Requirements:

  • Excellent language proficiency in English.
