Background

Government of Malaysia with the assistance of UNDP is looking for a suitable candidate (hereby referred to as National Consultant) to assist in the establishment and development of a financial and funding mechanisms established for ABS proceeds.

Malaysia has obtained GEF funding to develop a national legal and institutional framework on ABS. The Project’s Goal is to contribute to the conservation and sustainable use of globally significant biodiversity in Malaysia. The Project objective is to strengthen the conservation and sustainable use of biological and genetic resources in Malaysia through the development of  the national framework for the implementation of Access and Benefit Sharing under the Convention on Biological Diversity (CBD).

Hence, one of the key features in an ABS mechanism is the benefit sharing element out of the utilization of biological resource (BR), traditional knowledge (TK) or both. Malaysia has recently established a National Conservation Trust Fund for Natural Resources (NCTF) in the year 2014. One of the ways envisaged to share benefits via the NCTF is the resource is bio-prospected at Federal land or the resource is found in more than one state. It too may involve knowledge which cannot be apportioned to any particular ILCs. Besides NCTF, the Consultant could propose other mechanisms both at Federal and State level.

Duties and Responsibilities

Key Responsibilities

Under the supervision of UNDP, and NRE, the National Consultant shall undertake the following responsibilities:

  • Conduct a feasibility study to review how such ABS financial and funding mechanisms have been designed in comparable situations in other countries including the National Conservation Trust Fund;
  • Based on the draft ABS law that is currently being developed/finalized, the consultant will study and propose how best the mechanism for financing ABS activities at the Federal and States level;
  • To study and propose the legal, administrative and socio-economic context for introducing such a system in Malaysia, the legal and institutional measures required, and a comparative review of the advantages and constraints of different options for the introduction of such a mechanism in Malaysia for review by NRE and other key stakeholders;
  • Prepare a detailed design of the selected financial mechanism(s) to be established at state and federal levels for review by NRE, MOF, EPU and other key stakeholders;
  • Prepare a paper on the proposed financial mechanism(s) for NRE to present and seek approval by the relevant decision-making body for the establishment of such a mechanism(s).

Methodology

The methodology includes survey and data collection, desk research, interviews, meetings, workshops and discussions with relevant stakeholders. The consultant shall suggest the best methodology taking into account the duration and context of the consultancy.

Expected Outputs/Deliverables

  • Draft presentation -  mid-term or where necessary;
  • 2 workshops with all stakeholders - a) to brainstorm and assess current practices, b) to share the final outcome of the study and to get feedback from stakeholders;
  • Final report -  1 month before the end of the contract;
  • The format of the report, among others, must contain - 1) Introduction, 2) Methodology, 3) Situational study and gaps, 4) Proposed mechanisms and options, and 5) Way forward;
  • The Final report which is in English, should have an Executive Summary in both Bahasa Malaysia and English;
  • The Final report should also be transposed to a Power Point Presentation (English) for NRE’s use;
  • The consultant shall submit reports of the study that shall cover all texts, tables, figures etc;
  • The Government shall be the sole proprietor of the study. Any duplication or extraction of any part of the reports from this study for educational or non-profit purposes is permitted provided acknowledgement of the source is made;
  • Until the report is published, all matters pertaining to the data, information, findings and recommendations of the study shall be considered confidential;
  • Details schedule of output by the consultant will be developed after the appointment.

Duration

The consultancy is for 3 man-months over a period of 12 months.

Required Skills and Experience

Education:

  • Degree in financing, environmental economics and/or environmental law;
  • An advance degree or professional certification in the above mentioned fields will be advantage;
  • Experience in biodiversity conservation or natural resources.

Experience:

  • A minimum of 10 years of relevant working experience is required;
  • Experience in implementation of technical assistance projects;
  • An ability to assess the institutional capacity and incentives required;
  • Understanding of socio-political, economic and institutional issues associated with biodiversity governance and the management if resources at federal and state level;
  • Excellent English writing and communication skills;
  • Excellent in human relations, coordination, planning and team work.

Language:

  • Proficient in English;
  • Proficiency in Bahasa Malaysia will be an added advantage.
