Background

Organizational Context

 The Government of Sierra Leone in close collaboration with donors and development partners, through multi stakeholder consultations, developed a programme that aims at establishing an Integrated National Civil Registration system in Sierra Leone.  The programme will cover the period from 2015 to 2017.  The programme will support the GoSL to record (on a continuous, permanent, compulsory and universal basis) the occurrences and characteristics of vital events and other civil status events related to its citizens and residents, as provided by and in accordance with an established legal framework. Those events will include marriage, divorce, births, deaths, adoptions, and legal changes of names.  This programme will be essential in strengthening the national process of issuing identity documents such as national ID cards, birth certificates, passports, and driving license.  The programme will receive technical and financial assistance from UNDP, UNICEF, and Plan international.

Duties and Responsibilities

Functions/ Key Results Expected:

Summary of key functions

Working under the supervision of the Program Coordinator Civil and Voter Registration, and in partnership with the NRS, the Civil Registry Data Protection Legal Expert will:

  • Undertake review of legal instruments, if any, concerning citizen’s rights and data protection and production of a draft legal framework pertaining to data protection and its usage;
  • Assist NRS and Ministry of Interior in drafting a Bill on intergraded national civil registry for the parliament.

Deliverables/Final Products Expected:

This assignment is to be completed within 30 working days.

The main outputs of the work will result in:

  • A draft legal framework pertaining to data protection and its usage in accordance with the policy paper approved by the cabinet;
  • Draft Bill on an intergraded national civil registry for the parliament in accordance with the policy paper approved by the cabinet.

Impact Results:

  • NRS, NEC and the Ministry of Internal Affairs benefit from UNDP legal technical assistance and resultant legal framework will provide legal basis for the new Integrated National Civil Registry.  NEC is able to extract voter registers from the civil registry from NRS.  NEC is able to receive regularly updated voter register from the NRS.  NEC’s voter registration is sustainable, cost effective, and integrated with the civil registry.

Required Skills and Experience

Education: 

  • An advanced degree (Masters) in Law.

Experience:

  • 8 years or more of functionally-related professional legal advisory experience;
  • Proven track record of working with Electoral Management Bodies (EMBs);
  • Excellent analytical, communication, writing and presentation skills;
  • Previous work experience in Sub-Saharan Africa an advantage;
  • The post requires considerable cultural and political sensitivity and an ability to meet deadlines;
  • The Suitable candidate for this consultancy shall have extensive experience in civil registration.

Language: 

  • Excellent written and oral communication skills in English.

Duration of the consultancy:

  • The tasks are expected to take 30 working days to complete.

Payment Modalities:

  • Payment to the consultant will be made on monthly basis upon certification of satisfactory completion by the Program Coordinator Civil and Voter Registration.

Evaluation of Criteria and Weighting:

  • The expert will be evaluated against a combination of technical and financial criteria. Maximum score is 100% out of a total score for technical criteria equals 70% and 30% for financial criteria.

The technical evaluation will include the following:   

  • Background and minimum educational qualification as defined above-10%;
  • Practical previous experience relevant to the TOR - 30%;
  • Substantial professional knowledge and experience in legal domain -50%;
  • English language fluency -10%.
