Background

UNDP and the State of Kuwait, represented by the General Secretariat of the Supreme Council of Planning and Development (GSSCPD), strive to enhance institutional capacities at various government agencies by providing them with necessary technical support to strengthen their capacities and skills to perform their expected duties.

Under the framework of the Institutional Capacity Development for Implementation of the Kuwait National Development Plan (ICDI/KNDP) project, UNDP and GSSCPD attempt to support public entities to increase technical expertise and institutional capacities for strategic planning and implementation of Kuwait National Development Plan.

Within this context, UNDP and GSSCPD strive to reinforce the capacity of the Al-Saad Charity for Knowledge and Scientific Research to implement its strategy with the highest possible standards.

Al-Saad Charity for Knowledge and Scientific Research contributes to educational efforts for sustainable development through the promotion of the collaborative responsibility in providing young Kuwaiti with bright future.

The charity aims to establish the principle of participation for sustainable development which was adopted by UNESCO 10 years ago.  It also coordinates with the Ministry of Education as a support tool representing the non-governmental sector and supporting the ministry's efforts to integrate sustainability into the educational curriculum in Kuwait.  The charity strives to maintain its work and support the Ministry of Education through the reliance on international expertise and global partnership.

Within this context, Al-Saad Charity is seeking to recruit a Legal Specialist to formulate a legal document for the establishment of a National Centre for Education and Sustainable Development.

Duties and Responsibilities

Under the direct supervision of the Deputy General Manager for Planning and Development Sector at PAS and with close coordination with the Project Manager of the GSSCPD, the Sports Facilities Investment Specialist will assume the following duties:

  • Draft legal document for the establishment of a National Center for Education and Sustainable Development;
  • Prepare detailed study of the existing (including proposed/draft) legal framework: policies, legal texts and studies, as well as national and international regulations and standards related to the establishment of the center;
  • Provide recommendations  on new legal framework  that needs to be developed for the Center and draft the required legislation;
  • Ensure that all processes and mechanisms follow the national and international regulations.

Deliverables

Output 1: Present Inception report and action plan.

Output 2: Present a PowerPoint presentation of the work progress and first draft formulation of the legal document for the establishment of the Center.

Output 3: Present final draft formulation of the legal document for the establishment of the Center.

Output 4: Final report and PowerPoint presentation that contains:

Clear plan for establishing the National Centre for Education and Sustainable Development;

Clear idea and explanation of the draft formulation of the legal document for the establishment of the Center.

Expected Outputs and Deliverables

The duration of the assignment will be for one months or 4 working weeks. It is envisaged that the output and deliverables are to be ordered and ranked as follows:

Deliverables/ Outputs:

  • Deliverables/ Outputs - Present Inception report and action plan, Target Due Dates: 5 days from contract date, Payment schedule in percentage -10%;
  • Deliverables/ Outputs - Present a PowerPoint presentation of the work progress and first draft formulation of the legal document for the establishment of the Center, Target Due Dates - 2 weeks from contract date, Payment schedule in percentage - 20%;
  • Deliverables/ Outputs - Present final draft formulation of the legal document for the establishment of the Center, Target Due Dates: 3 weeks from contract start date, Payment schedule in percentage - 40%;
  • Deliverables/ Outputs - Final report and presentation contains the mentioned below, Target Due Dates: 3 days before end of contract, Payment schedule in percentage - 30%;
  • Clear plan for establishing the National Centre for Education and Sustainable Development;
  • Clear idea and explanation of the draft formulation of the legal document for the establishment of the Center :3 days before end of contract;
  • The consultant will solely be responsible for the timely delivery and professional quality of his assignment;
  • The consultant will not publish the product of assignment in any form without prior written consent of UNDP;
  • Potential assignment of training after this assignment exists and depends on the approval of the GSSCPD.

Scope of Price Proposal and Schedule of Payments:

Lump Sum Amount

  • The lump sum amount must be “all-inclusive";
  • contract price is fixed regardless of changes in the cost components;
  • Include in its initial payment the actual cost of the IC’s travel to arrive at the designated Duty Station. Such cases therefore imply that the completion of the journey can be considered as one of the deliverables payable upon arrival.

  • Relevance of Education/ Degree:15 points;
  • Years of Relevant Experience:20 points;
  • Regional Experience:15 points;
  • Adequacy of Competencies for the Assignment: 35 points;
  • Language:15 points:

Required Skills and Experience

Education:

  • Master’s degree in Legal Studies or any related field.

Experience:

  • More than 15 years overall experience in the field of legal public administration;
  • Previous experience in preparation of similar studies and tasks is an asset.

Language:

  • Fluency in English is a must. Arabic is desirable.

Evaluation:
Cumulative analysis, the award of the contract should be made to the individual consultant whose offer has been evaluated and determined as:

  • responsive/compliant/acceptable; and
  • Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation;
  • Technical Criteria weight; 70%;
  • Financial Criteria weight; 30%.

Only candidates obtaining a minimum of 70 point would be considered for the Financial Evaluation.

Evaluation will be based on desk review, oral interview might be requested for additional clarification.

Documents to be included when submitting the proposals:

  • Duly accomplished Letter of Confirmation of Interest and Availability using the template provided by UNDP;
  • Personal CV or P11, indicating all past experience from similar projects, as well as the contact details (email and telephone number) of the Candidate and at least three (3) professional references;
  • Brief description of why the individual considers him/herself as the most suitable for the assignment, and a methodology, if applicable, on how they will approach and complete the assignment. A methodology is recommended for intellectual services, but may be omitted for support services;
  • Financial Proposal that indicates the all-inclusive fixed total contract price, supported by a breakdown of costs, as per template provided.  If an Offeror is employed by an organization/company/institution, and he/she expects his/her employer to charge a management fee in the process of releasing him/her to UNDP under Reimbursable Loan Agreement (RLA), the Offeror must indicate at this point, and ensure that all such costs are duly incorporated in the financial proposal submitted to UNDP.
