Background

The Ministry of Health of Ukraine initiates the Reform of Health Expert Commissions into the system based on the International Classification of Functioning, Disability, and Health with integrated rehabilitation system. The efforts to reform of Health Expert Commissions aims to implement the rehabilitation system with transparent and simplified procedures, reduced corruption component that allows saving public funds. The Rehabilitation and Health Expert Commissions reform is one of the government priorities according with the Medium-Term Priority Action Plan by 2020.

Since 2015, UNDP has started providing technical support to the Ministry of Health of Ukraine with regards to support anti-corruption and transparency efforts, legal and policy advice. Acknowledging the challenges of the reforming current health expert commissions system in line with recently adopted main health care reforms laws and action plan for the year 2018, the Ministry of Health of Ukraine has requested the UNDP to support the legislative framework development for the Reform of Health Expert Commissions into the system based on the International Classification of Functioning as an emergency measure.

UNDP seeks an Individual Consultant to provide legal support and expertise to the Ministry of Health of Ukraine to support the Reform of Health Expert Commissions and Rehabilitation. The Consultant will be responsible for facilitation and assistance in developing the concept of the reform, preparing legal framework and updating regulation on the classification of functioning, disability and rehabilitation.

Administrative arrangements: Contractor will not use project’s office space. UNDP will provide some essentially required consumables (e.g. stationeries) based on the needs assessment.

Duties and Responsibilities

MAIN OBJECTIVES OF THE ASSIGNMENT

UNDP seeks an Individual Consultant to provide legal support to the Ministry of Health (MOH).

DESCRIPTION OF RESPONSIBILITIES / SCOPE OF WORK

  • In cooperation with the Senior Consultant on legal support to the Ministry of Health on the Rehabilitation and Health Expert Commissions Reform provide comprehensive legal support during the Reform of Health Expert Commissions and Rehabilitation.
  • Provide inputs to the concept for the Reform of Health Expert Commissions and Rehabilitation and facilitate the adoption process.
  • In cooperation with the Senior Consultant on legal support to the Ministry of Health on the Rehabilitation and Health Expert Commissions Reform provide technical assistance and recommendations as for necessary amendments to the national legislation and policies, support with developing and adoption of changes to the current regulations and normative acts to enable the use of the International Classification of Functioning, Disability, and Health in Ukraine.
  • Provide legal services during the process of adoption of developed amendments to the current legislation or normative acts to the departments of the MOH or other central bodies;
  • Drafting necessary documents to the Ministry of Health, other governmental or non- governmental bodies to ensure comprehensive legal support to the implementation of action plan of the reform.
  • Participate in the meetings organised by the MOH and other relevant public authorities, prepare minutes of meetings to ensure proper implementation of the developed amendments to the national legislation and policies for the Health Expert Commissions and Rehabilitation reform.
  • Collaborate with other consultants and participate in other relevant meetings, round tables and seminars to ensure national legal expertise among all national and international stakeholders.
  • Provide legal support in, not necessarily limited to, drafting of amendments to the national legislation and policies for the Health Expert Commissions and Rehabilitation reform.
  • Perform other duties upon request.

MONITORING/REPORTING REQUIREMENTS

Work-progress reporting/monitoring meetings will be held with the Consultant on a regular basis. While UNDP will be the final authority to administrate the work, the MOH will be responsible for all control of quality and evaluate work-progress of the Consultant’s performance. No reports or documents should be published or distributed to the third parties without prior approval of the MOH and UNDP.

Required Skills and Experience

Minimum qualifications and experience:

Education:

  • Advanced university degree in Law, Political Science, Social Sciences, Public Administration or other relevant areas.

Experience: 

  • At least 1,5 year of relevant experience in the field of law, social or health policy.
  • At least 1 year of experience in delivering capacity development, advisory and advocacy services to the national or local public institutions.

Languages:

  • Fluency in Ukrainian, Russian is required. Good knowledge in English will be an asset.

FINANCIAL PROPOSAL

Lump sum contract

The financial proposal shall specify a total lump sum amount, and payment terms around specific and measurable (qualitative and quantitative) deliverables (i.e. whether payments fall in instalments or upon completion of the entire contract). Payments are based upon output, i.e. upon delivery of the services specified in the TOR.  In order to assist the requesting unit in the comparison of financial proposals, the financial proposal will include a breakdown of this lump sum amount and number of anticipated working days. 

Travel costs

All travel arrangements will be handled separately if such travel is deemed necessary.

EVALUATION CRITERIA

  • Advanced university degree in Law, Political Science, Social Sciences, Public Administration or other relevant areas - 15 points max {10 pts – Specialist/Master’s; 15 pts – PhD };
  • At least 1,5 year of relevant experience in the field of law, social or health policy - 30 points max {30 pts – 4 years or more; 25 pts – 2-3 years, 20 pts – 1,5 -2  years}; 
  • At least 1 year of experience in delivering capacity development, advisory and advocacy services to the national or local public institutions - 10 points max {10 pts – 2 years or more, 5 pts – 1 year};
  • Fluency in Ukrainian, Russian is required. Good knowledge in English will be an asset - 15 points max {10 pts – Ukrainian, Russian, 15 pts – Ukrainian, Russian and good knowledge English}.

Maximum available technical score - 70 points.

EVALUATION METHOD

Cumulative analysis:

Contract award shall be made to the incumbent whose offer has been evaluated and determined as:

a) responsive/compliant/acceptable, and

b) having received the cumulative highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

* Technical Criteria weight: 70%

* Financial Criteria weight: 30%

Only candidates obtaining a minimum 70% from the maximum available technical score (49 points) would be considered for the Financial Evaluation.

The maximum number of points assigned to the financial proposal is allocated to the lowest price proposal and will equal to 30. All other price proposals will be evaluated and assigned points, as per below formula:

30 points [max points available for financial part] x [lowest of all evaluated offered prices among responsive offers] / [evaluated price].

The proposal obtaining the overall cumulatively highest score after adding the score of the technical proposal and the financial proposal will be considered as the most compliant offer and will be awarded a contract.
