Background

Strengthening the sustainability of the protected area system of Montenegro emerged as a major systematic effort to assist in capacity development of institutions and individuals mandated with protected, conservation and management of protected areas. The main objectives of this project are to expand and rationalize the protected area system in order to ensure better habitat representation and more secure conservation status as well as to strengthen the capacity of protected area institutions to more effectively manage a representative system of protected areas. Under the project “Catalyzing financial sustainability of protected areas in Montenegro’’ UNDP will assist in capacity development of institutions and individuals mandated with protection, conservation and management of protected areas. This project will improve the financial sustainability of PA system in MNE through enabling legal and policy environment for improvement of financial sustainability, securing revenue streams for PA, and development of institutional and individual capacities of PA institutions to raise PA management cost-effectiveness, while the project Sustainability of the Protected Area System of Montenegro will strengthen capacities of the protected area institutions to design, plan and manage a more representative system of PA through expanding and rationalizing PA system to ensure better habitat representation and more secure conservation status, and through strengthening capacities of PA institutions to effectively manage a more representative PA system. 

Duties and Responsibilities

Objectivities of assignment:  In an effort to provide assistance in order to obtain best legislative solution in area of National Parks management international  consultant will be recruited to assist National Parks authority and line ministry units in providing suport, analysis and opinions, based on the respective laws and by-laws, on the following topics:

  • Provide expert advice and guidance in preparation of Law on National Parks;
  • Contributing to the reform of PA regulations (specifically relating to the funding, and financial management, of PAs);
  • Assessment of legal options for the integration of biodiversity offsets (that are linked to protected areas) into formal Environmental Impact Assessment decision-making;
  • Development of an incentives framework to retain skilled and competent protected area planning and management staff in the conservation sector; evaluation, and strengthening, of the regulatory framework for PPP tourism concession agreements;
  • Development of formal procurement procedures and contractual templates for the outsourcing of PA planning and operational functions;

Job content: The Contractor shall provide analyses and opinions, based on the respective laws and by-laws, on mentioned topics (together with the quotation of the references to the legal act to be analyzed):

  • Provide expert advice and guidance in preparation of Law on National Parks;
  • Selected candidate will be responsible to provide support in preparation on new Law on National Parks (LoNP). Special emphasis will be on securing alignment of LoNP with Law on Nature Protection and other relevant legislation that could affect or influence work of National Parks management authority; regulate jurisdiction and responsibilities of National Parks management authority in law enforcement area (responsibilities, jurisdiction and duties of park rangers);
  • Regulate jurisdiction in resource usage within territory managed by National Parks management authority;
  • Contributing to the reform of PA regulations (specifically relating to the funding, and financial management, of PAs). This may include providing technical support to the local and national government institutions in: development of regulations (or by-laws) that prescribe the rules, procedures and administration  for each of the different funding mechanisms provided for in national legislation and/or recommended by the National Protected Areas Financial Plan;
  • Development of an incentives framework to retain skilled and competent protected area planning and management staff in the conservation sector; evaluation, and strengthening, of the regulatory framework for PPP tourism concession agreements;
  • Assessment of legal options for the integration of biodiversity offsets (that are linked to protected areas) into formal Environmental Impact Assessment decision-making and approval processes for large-scale development with significant environmental impact.
  • Development of formal procurement procedures and contractual templates for the outsourcing of PA planning and operational functions; Selected consultant is expected to provide support through electronic communication and one field visit in May.


Expected Results/Deliverables: 

  • Legal baseline survey Mid May, 2012;
  • One visit to Podgorica (up to one working week)  Mid May, 2012;
  • Recommendations prepared for the Law on Nature Protection  second half of May, 2012;
  • Participation in consultation process  May – mid December , 2012;
  • Development of an incentives framework to retain skilled and competent protected area planning and management staff in the conservation sector; evaluation, and strengthening, of the regulatory framework for PPP tourism concession agreements May – mid December , 2012;
  • Development of formal procurement procedures and contractual templates for the outsourcing of PA planning and operational functions; May – mid December , 2012

Timing of the work:   The planed tasks will be executed within 60 working days during the period from May, 2012 – mid December, 2012. All planed activities will be implemented in Podgorica, Montenegro.

Required Skills and Experience

Education:

  • University degree in Law; Advanced Degree in the relevant field would be an advantage.

Experience:

  • Proven relevant experience in development and implementation of similar activities.
  • Minimum 5 years of relevant working experience.
  • Familiarity with Public Administration Reform issues and institutions at central and local levels, especially in transitional economies, would be an advantage.
  • Familiarity with national policy priorities in the area of Environment, economic development and public finance management.
  • Familiar with nature protection related issues in the national context.
  • Demonstrated ability to manage and motivate people in a complex political environment and achieve set goals under time pressure.
  • Initiative and strong team-building, communication and negotiation skills.
  • Ability to analyze and generalize;
  • Ability to work in a team.
  • Excellent communications and writing skills in domain.

Language: 

  • Fluency in English; knowledge of local language will be considered as an asset.
