Historique
Brief description of the project:
Access to justice is recognized as a critical issue by the Government of the Republic of Belarus.
Through this project the Government of Belarus and the UN continue the joint efforts towards ensuring the rule of law and access to a fair trial for the population of Belarus.
The ultimate goal of the project is to ensure that the population of Belarus, including marginalized and vulnerable groups, enjoys access to justice through an effective and professional court system supported by the specialisation of courts and judges, which has been identified as an important prerequisite for effective and professional court system functioning.
This will be achieved through support for the full-scale specialisation of courts as prescribed in the constitution of the Republic of Belarus and further improvement of the legislation concerning the court system. Further to this goal, the project will contribute to the systematic and continuous professionalization of judges through their life-long education.
The project objectives are as follows:
- To support full-scale specialisation of courts as prescribed in the constitution of the Republic of Belarus and to promote further improvement of the legislation concerning the court system.
- To create a sustainable, high-quality basis for systematic and continuous professionalization of judges, to enhance their capacity to work professionally and efficiently within the court system.
Expected outputs of the project:
- Recommendations towards the improvement of the administration of justice in Belarus, including through the system of specialised courts will be discussed and developed at 6 seminars with participation of at least 500 judges of Belarus;
- The curriculum for training of judges reflecting the specialization of courts in Belarus will be developed.
- The developed curriculum for the training of judges will be tested and further adjusted based on the lessons learned during the pilot phase;
- The text book for judges supporting the trainings based on the specialization of courts will be elaborated, printed and disseminated among the judges of Belarus;
- The best national and foreign practice of administration of justice based on its specialisation will be compiled, collected, published and disseminated among the judges of Belarus.
Devoirs et responsabilités
The incumbent will be responsible for the delivery of a 2-hour lecture (presentation) on administrative justice in the EU countries (Institute for Re-training and Upgrading Qualifications of Judges, Prosecutors and Legal Professionals at the Belarussian State University, Minsk, Belarus, February 13, 2013), and for the following materials:
- Handouts for participants (at least 5 pages);
- Best foreign experience, including case-study, analytics, courts’ statistics, list of appropriate and relevant legal sources and links to journals and online resources on the subject of appellate justice (at least 5 pages).
Duties and Responsibilities:
To perform and provide to the project manager for her approval notes (abstracts/slides) of the supposed lecture, written in English (German and /or Russian, and /or Belarusian) language 5-7 days prior to arrival to Belarus (at least 3 pages);
After the approval of the notes by the project manager to provide the following materials 5 days prior to arrival to Belarus:
- A copy of the handouts to the participants of the seminar (at least 5 pages);
- Examples of the best foreign experience, including case-study, analytical materials, court statistics, a list of appropriate and relevant legal sources and links to journals and online resources on the subject of administrative justice, etc. (at least 5 pages).
To deliver in English (and/or in German, and/or in Russian, and/or in Belarusian) a 2-hours lecture (presentation) on administrative justice in the EU countries (in comparison with Russia and Ukraine) at the seminar for Judges of Belarus.
Compétences
- Essential knowledge in the theory, legislation and practice of administrative justice
Qualifications et expériences requises
Education:- University degree in law or related area (academic degree in law or related area is an advantage).
- Experience in legal research (at least 3 years);
- Experience in performing of presentations/lectures to the legal professionals of the EU countries and Eastern Europe (minimum 3 lectures);
- Common knowledge of organization of justice in the EU and Eastern Europe;
- Experience in judging (considered as an advantage);
- Capability to lecture in one of the following languages: English, German, Russian, Belarussian.
