Historique

The creation of a National Human Rights Institution (NHRI) in Sudan was stipulated both in the Comprehensive Peace Agreement (CPA) and the Interim National Constitution in 2005. In 2009, the National Assembly passed the National Human Rights Commission Act. In January 2012, the National Human Rights Commission (SNHRC or “the Commission”) was formally established by a presidential decree.

As a part of UNDP’s commitment to strengthening human rights promotion and protection mechanisms in Sudan, the UNDP Governance and Rule of Law Unit has been providing capacity building and technical support to the SNHRC since its establishment in 2012. The main objective of the “Strengthening the Capacity of the Sudan National Human Rights Commission” project is to support the SNHRC in the development of its operational, technical and legal capacities in order to become a cornerstone within Sudan’s national human rights protection system.

Based on the results of a capacity assessment of the SNHRC, conducted in September 2013 within the framework of this project, UNDP supported the SNHRC to develop a 5-year Strategic Plan (2014 – 2018), which was adopted and launched by the Commission in March 2014. The Strategic Plan outlines the Commission’s vision, strategic priorities and objectives and contains a detailed and phased result activity framework. Phase I (2014) aims to strengthen Governance and Sustainability of the Commission, by supporting the development of institutional infrastructure and organizational development. Phase II (2015 – 2016) focuses on increased capacity development and human rights programming. The project is aligned with the Strategic Plan and aims to support its implementation.

The Commission is currently composed of 15 Commissioners and a few administrative support staff and is in the process of recruiting staff according to the recently-developed organizational structure, which foresees the creation of four departments: Research and Information; International Relations; Complaints and Monitoring, and Corporate Services (Finance, ICT, HR, Admin). As the first NHRI in Sudan, it is unlikely that the Commissioners or the staff will come to their jobs fully equipped from previous job experiences. As staff are hired,  a more systematic and organized training program is required that addresses learning needs of staff based on their job descriptions (targeted training) and not only generic or ad hoc human rights training. To carry out this key area of the Strategic Plan, UNDP is looking for an international consultant to develop a comprehensive vocational training plan, curriculum and training materials for the entire training program over a three-year period for the SNHRC.

Institutional Arrangement

The consultant will work under the overall supervision of the Team Leader of the UNDP Governance and Rule of Law unit and reports to the Rule of Law Programme Officer. The consultant will work in close cooperation with the SNHRC.

Duration of the Work

The assignment period is expected to be 30 working days, which will commence immediately upon the travel by IC and arrival to Khartoum. The contract will be continuous engagement with 5 working days per week aligning the work week with that of UNDP and National Human Rights Commission.

Devoirs et responsabilités

The objective of this consultancy is to develop a comprehensive vocational training plan, curriculum and training materials for a 3-year training program for the SNHRC. Therefore, the consultant is expected to undertake the following tasks:

  • Conduct an assessment of the Commission’s training needs: The consultant will - in close cooperation and consultation with the Commission - carry out a needs assessment with the aim to identify the capacity building and vocational training needs of the Commission once the managerial and senior staff are hired, taking into consideration the job descriptions and levels of experience of current and future staff positions according to the Strategic Plan and the organizational structure;
  • Develop a comprehensive vocational training plan, curriculum and training material for the Commission: The consultant will develop a comprehensive and phased 3-year vocational training plan, and corresponding curriculum and training material, which addresses the capacity gaps and needs of the Commission.

The training program should feature the following:

  • A participatory and experiential approach for training as a sustainable process and methodology;
  • Basic training and orientation for all staff and Commissioners;
  • Targeted training for Commissioners, managers and staff (according to job descriptions or areas of focus);
  • Best international practices for NHRIs in challenging regional contexts, and solutions from regional human rights institutions;
  • Guidance to meet the needs of short and long term career development;
  • Sustainability through a training of trainers system (TOT) to ensure that the Commission develops internal capacity to provide in-house training, whereby managers and key staff are trained in Phase I and will help to train their staff in Phase II;
  • The preparation of an integrated training package and material based on principles of human rights education and participatory experiences;
  • The establishment of partnerships with civil society organizations and centers concerned with human rights training;
  • Include as participants and trainers journalists, activists, community organizations, students and lawyers, where appropriate, to expand the Commission’s networking and to support these sectors’ independence, awareness of, and commitment to human rights issues.

  • Expert knowledge of mandates, powers and functions of National Human Rights Institutions and demonstrated experience providing technical assistance to NHRIs and government agencies in the area vocational training;

Qualifications et expériences requises

Education:

  • Master's degree or equivalent in Human Rights, Social Sciences, Political Science, Economics, International Relations, International Law, or other disciplines related to the assignment.

Experience:

  • 7- 10 years of relevant work experience in development of vocational training plans/curriculums and/or training provision , preferably in/with National Human Rights Institutions or comparable institutions that have a human rights mandate;
  • Previous work experience in Sudan and/or the region is an asset;
  • Sound experience in developing experiential learning programs with a participatory focus.

Language

  • Proficiency in English and (both spoken and written);
  • Working level of Arabic is essential.

Scope of Price Proposal and Schedule of Payments

The consultancy fee will be determined on a lump sum basis. The lump sum amount must be all-inclusive and the contract price must be fixed regardless of changes in the cost components. Living allowance (LA) and travel fees to the duty station will be included in the lump sum. Payment will be made in installments (%) upon successful completion of the deliverables (see table above).

Recommended Presentation of Offer

  • Brief description of why the individual considers him/herself as the most suitable for the assignment, and a methodology, if applicable, on how they will approach and complete the assignment.
  • Financial Proposal that indicates the all-inclusive fixed total contract price, supported by a breakdown of costs, as per template provided.

Criteria for Selection of the Best Offer

The offers received from the candidates will be evaluated using combined scoring method. The combined scoring method assesses the offers with technical merits of the proposals – where the qualifications and methodology will be weighted a max. of 70%, and later combined with the price offer which will be weighted a max of 30%.

The price proposals of candidates obtaining 49 points and higher (or 70% or above) will only be technically qualified; they will be reviewed and compared for the assessment of overall ranking of the proposals. Those obtaining lower than 49 points (or lesser than 70%) will be technically non-responsive proposals, price proposals of such candidate will not be compared.

Assessment of the Price Proposals (30 Points) or 30%

The lowest priced bid from among the technically qualified Offerors will obtain the full marks of 30 points in the price proposal. Price proposals of remaining qualified bidders will be prorated against the lowest priced bid using the following formula to derive the marks in their price proposal:

Marks obtained by a Bidder = Lowest Priced Bid (amount) / Bid of the Offeror (amount) X 30 (Full Marks).

Award of the Contract/Award Criteria:
 
The contract will be awarded to the candidate (bidder) whose proposal obtains the highest cumulative marks (points) when the marks obtained in technical and price proposals are aggregated together.
