Antecedentes

Bangladesh’s formal justice system remains relatively inaccessible for the vast majority of the public. Vulnerable groups, including women and children, ethnic minorities, the poor, and people with disabilities face particular difficulty in accessing timely and affordable justice. Large case backlogs, estimated at nearly 2.8 million cases, are slowly overwhelming the court administration and undermining access to justice. There is increasing acknowledgement that these are critical governance, access to justice and rule of law issues that need to be addressed.

 The Justice Sector Facility (JSF) started in July 2012. It is implemented by the Law and Justice Division of the Ministry of Law, Justice and Parliamentary Affairs, with the support of UNDP and DFID. The project’s overall objective is to improve justice sector outcomes through strengthened communication, coordination and cooperation between agencies. The expected outputs of the Facility are:

  • Communication, coordination and co-operation between justice agencies enhanced in two district pilots through establishment of solutions for inter-agency case management;
  • Selected agencies have improved strategic planning, monitoring and evaluation, delivery of government legal aid, and prosecution of cases; and
  • Strengthened cross-sectoral dialogue and sector-wide coordination mechanisms established.

 The immediate beneficiaries of the project are the key justice sector institutions of the Government of Bangladesh, including the Law and Justice Division of Ministry of Law, Justice and Parliamentary Affairs, the Office of the Attorney General, the National Legal Aid Services Organization, the Judicial Administration Training Institute, the Bangladesh Judicial Service Commission, the Law Commission and the Bar Council which are supported to strengthen capacity in several fields, including research, planning, budgeting, monitoring and reporting. In addition, court users and the general public are also expected to benefit from JSF support through the work carried out in the pilot districts and the improved service delivery and quality of justice dispensation.

Scope of Work:

UNDP Bangladesh is looking for an experienced development professional to provide technical expertise and high-quality written drafting skills to two main tasks:

A lessons learned study

JSF has already completed around three years of activities and has generated a good number of lessons and learnings which require to be consolidated and reflected into a high quality lessons learned report. The consultant will prepare an objective and concise document on lessons learned during JSF operations from 2012 to current day. The lessons learned study will be a formal part of JSF project closure and also provide food for thought for future sector-wide justice interventions. The lessons learned report will be max 15-20 pages and will need to cover the areas of executive summary of the report, brief description of JSF, key achievements including gender and specific results, sustainability of the results, scaling up, project innovation and best practices, how project contributed to UNDP CPD outcome, lessons learned, challenges and risks, conclusion along with future strategic guidelines, etc.

Support for the preparation of the annual justice conference

As a critical bridge to the lessons learned study the consultant will also provide technical input into the preparations of the annual justice sector conference. This includes providing technical input and high-quality drafting skills to speeches and other preparations as well as a concise and high quality conference report. In particular:

  • The consultant will draft high-quality, concise and objective documents in preparation of the justice conference as well as speeches for 6-8 guests of the justice conference. Documents will be shared remotely for consultation and comments from project stakeholders;
  • The consultant will attend the justice sector conference and produce a summary report of max 6 pages. The consultant will also be expected to provide technical and drafting guidance on 3-4 background papers for the working groups of the conference.

 In order to carry out the above tasks and produce the expected deliverables, the consultant shall also:

  • Undertake extensive background reading to ensure understanding of the JSF, including project document, various evaluations and project and monitoring reports;
  • Undertake meetings with the project stakeholders in Dhaka and pilot districts to discuss lessons learned and also attend the justice sector conference where a number of the meetings and discussions will take place.

Expected Outputs and Deliverables:

  • Final submission of inception report and action plan- 2 working days;
  • Final submission of 3-4 background papers for justice sector conference- 8 working days;
  • Final submission of 6-8 speeches for the guest of justice sector conference- 8working days;
  • Final submission of summary report of the justice sector conference- 5 working days;
  • Draft submission of lessons learned report of JSF- 10 working days;
  • Final submission of lessons learned report of JSF-7 working days.

Supervision and Performance Evaluation:

  • The Chief Technical Advisor of the Justice Sector Facility will be the contract administrator for the assignment and will supervise the activities of the consultant, evaluate his performance and approve the deliverables;
  • During the contract period, the consultant is expected to conduct one field visit to Bangladesh. The consultant shall meet the key stakeholders in Dhaka and JSF pilot districts to discuss lessons learned as well as attend the justice sector conference;
  • JSF project of UNDP will provide office space (no computer). UNDP JSF will arrange various meetings, consultations, and ensure access to key officials. UNDP JSF will provide transport for the consultant. In addition to this, UNDP will bear the cost of arranging consultation meetings and debriefing sessions and other events as required.

Timeframe and deadlines:

The assignment must be completed by 40 working days within 31 October 2015.

Reports:

The consultant should produce all the expected deliverables by the dates mentioned in “expected outputs and deliverables” section. UNDP JSF will take 2-10 working days to review the draft reports and share feedback with the consultant. Notably, liquidated damages for delay caused by the consultant shall be 0.1% of the price of the contract per each working day of delay but not exceeding 10% of the total value of the contract. UNDP JSF also preserves the right to terminate the contract for serious consequences or impact of any form of delay in the completion of work e.g. deferment of the succeeding phase to the following year, cancellation of the budget for the project and other potential losses to any party involved. In this case, payment will be admissible only for the amount of deliverables accepted by UNDP JSF.

Payment Installment:

  • 10% of the total contract amount will be paid after submission of inception report and upon acceptance by the UNDP JSF Chief Technical Advisor;
  • 30% of the total contract amount will be paid after submission of 3-4 background papers, 6-8 speeches and a 6 pages summary report of the justice sector conference and upon acceptance by the UNDP JSF Chief Technical Advisor;
  • 30% of the total contract amount will be paid after submission submission of draft lessons learned report and upon acceptance by the UNDP JSF Chief Technical Advisor;
  • 30% of the total contract amount will be paid after submission submission of final lessons learned report incorporating all the feedbacl given by Project and upon acceptance by the UNDP JSF Chief Technical Advisor.

Habilidades y experiencia requeridas

Education:

  • Master’s degree in a relevant field of study such as law/development studies/ political science/ international relations/public policy/ justice/ human rights.

Experience:

  • The consultant will have at least 7 years substantive experience at the policy-level on access to justice, security and justice, and the rule of law;
  • The consultant must have experience working in South Asia on access to justice issues, experience in Bangladesh would be an added advantage.

Language:

  • Excellent command of English (oral and written). The consultant must have excellent drafting skill in English.

Evaluation of the Candidate:

The candidates will be evaluated through Cumulative Analysis method. When using the weighted scoring method, the award of the contract should be made to the individual consultant whose offer has been evaluated and determined as:

  • Responsive/compliant/acceptable; and
  • Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

**Only candidates obtaining a minimum of 70% ( 49 out 70 Marks) in technical evaluation will be considered eligible for financial evaluation

Technical Evaluation Criteria (Total 70 marks):

  • Substantive experience at the policy-level on access to justice, security and justice, and the rule of law (20 marks);
  • Excellent drafting skill in English. As a prove, a lessons-learned or another similar kind of report should be submitted (25 marks);
  • Previous experience working in South Asia on access to justice issues, experience in Bangladesh would be an added advantage (25 marks).

Financial Evaluation (Total 30 marks):

All technically qualified proposals will be scored out 30 based on the formula provided below. The maximum points (30) will be assigned to the lowest financial proposal. All other proposals receive points according to the following formula:
