Background

UNDP Indonesia's mission is to be an agent for change in the human and social development of Indonesia. We aim to be a bridge between Indonesia and all donors as well as a trusted partner to all stakeholders. We work in four key areas of development: Governance Reforms, Pro-Poor Policy Reforms, Conflict Prevention and Recovery, and Environment Management, with the overarching aim of reducing poverty in Indonesia. Besides the four priority areas, UNDP Indonesia is also engaged in a variety of crosscutting initiatives focused on HIV/AIDS, gender equality, and information and technology for development.

I. Organizational Context

Under the guidance of the Deputy Country Director, the Human Rights, Legal and Justice Sector Reform acts as an advisor to Senior Management and Team Leader of Democratic Governance Unit on all aspects of CO programme particularly that relate to the Human Rights, Legal and Justice Sector Reform issues.

The Senior adviser will be expected to play a significant role in providing advisory and guidance to current work of Democratic Governance Unit (DGU) in the area of Human Rights, Legal and Justice Sector Reform cluster (HRLJSR cluster) as well as designing possible future UNDP support on legal reform sector as reflected the upcoming Country Programme Document (CPD). The Human Rights, Legal and Justice Sector Reform Programme (HRLJSR cluster) is managing three projects namely Legal Empowerment and Assistance for the Disadvantaged (LEAD), Strengthening Access to Justice for Peace and Development in Aceh (Aceh Justice project) and Enhancing Communications, Advocacy and Public Participation for Legal Reform (CAPPLER). The cluster also currently develops two pipeline projects namely support to improve internal oversight mechanism of Judiciary, Attorney General’s Office and Police and support to strengthen the capacity of National Human Rights Institutions (NHRIs).

LEAD is focusing its activities to promote better access to justice in Indonesia through grant support to civil society organizations in three targeted provinces in Indonesia namely Central Sulawesi, Southeast Sulawesi and North Maluku. At the national level, LEAD is supporting National Planning and Development Agency (BAPPENAS) the development as well as future implementation of the National Strategy on Access to Justice which was recently launched by BAPPENAS. Further, UNDP supports is needed to ensure the National Strategy on Access to Justice particularly its action plan can be implemented by GoI.

Aceh Justice Project is a sister project of LEAD that only focusing its activities in Aceh. The Aceh Justice Project has various activities including support to improve access to administration of justice, legal awareness among the vulnerable, conflict and tsunami affected populations of Aceh, strengthening institutional capacity of informal justice system, and increase capacity of civil society to monitor and advocate the rights of the disadvantaged as well as perform an oversight function for the justice system.

CAPPLER is only working at the national level with the Ministry of Law and Human Rights (Depkumham) and focusing to improve access to information at the Depkumham and reform at national as well as local legislation with particular aspect on harmonization in legislation making process and human rights, gender and sustainable development based local regulation. CAPPLER will be ended in early 2010 with some activities will be likely to be transferred to LEAD Project as part of implementation phase of National Strategy on Access to Justice.

Additionally, HRLJSR cluster is developing two pipeline projects that will work to support National Human Rights Institutions in Indonesia and internal oversight mechanism at Judiciary and two law enforcement institutions in Indonesia namely Attorney General Office (AGO) and National Police (POLRI).

The Senior Advisor may also be required to give feedbacks or review on any other strategic documents such as Country Programme Action Plan (CPAP) and UNDP Indonesia Governance Strategy.

The Senior Adviser works in close collaboration with the Management Support and Business Development, Operations team in the CO, Programme staff in other UN Agencies, UNDP HQs staff and Government officials, technical advisors and experts, multi-lateral and bi-lateral donors and civil society to successfully implement the UNDP programme.

 

 

Duties and Responsibilities

  • Ensuring the strategic direction of UNDP programme
  • Design project portfolios and promote organization’s capacity as a reliable partner with national counterparts.
  • Ensure coordination of sectoral activities with broader country programme.
  • Provision of top quality policy advice services to the Government and facilitation of knowledge building and management 

1. Ensuring strategic direction of UNDP Indonesia programme in the area of Human Rights, Legal and Justice Sector Reform by providing advice to internal UNDP particularly Democratic Governance Unit and our national counterparts. Technical advice to Democratic Governance Unit will include following activities:

  • Thorough analysis of the political, legal, social and economic situation in the country and collaborative preparation/revision of CCA, UNDAF, CPD, CPAP, AWP and other documents.
  • Identification of strategic programme areas of cooperation in the area of Human Rights, Legal and Justice Sector Reform including possible cooperation on anti-corruption related issue.
  • Operationalization of UNDAF/ CPD in collaboration with the main partners and other UN Agencies. Identification of possibilities for joint programming.
  • Engagement with Government of Indonesia and other stakeholders (including judiciary, law enforcement agencies, parliaments and broader civil society) on the implementation of National Strategy on Access to Justice and its Action Plan

2. Design project portfolios and promote organization’s capacity as a reliable partner with national counterparts. Four main functions are as follows:

  • Together with national counterparts, the senior adviser will facilitate donor coordination on Human Rights, Legal and Justice Sector reform related issues including but not limited to Access to Justice Donor Coordination meeting.
  • Design strategic initiatives development of current and pipeline projects of Democratic Governance Unit’s Human Rights. Legal and Justice Sector reform (HRLJSR) projects. 
  • Design and formulation of CO programme within Human Rights, Legal and Justice Sector Reform area, translating UNDP priorities into local interventions. Coordination of programme implementation with the executing agencies.

3.  Ensure coordination of sectoral activities with boarder country programme, establishes and maintains strategic partnerships and supports the resource mobilization in cooperation with the Management Support and Business Development Team  focusing on achievement of the following activities:

  • Support Team Leader and Programme Managers of Democratic Governance Unit (DGU) in ensuring coordination and synergy among DGU’s clusters are in place. The Senior Advisor will also play a significant role in advocating other units in relation to works related to Human Rights, Legal and Justice Sector issues.
  • Implementation of the CO partnerships and resources mobilization strategies to achieve programme outcomes.
  • Creation and coordination of partnerships with the UN Agencies, IFI’s, government institutions, bi-lateral and multi-lateral donors, private sector, civil society etc.
  • Determination of programmatic areas of cooperation, based on strategic goals of UNDP, country needs and donors’ priorities.
  • Analysis and research of information on donors, preparation of substantive briefs on possible areas of cooperation, identification of opportunities for cost-sharing.

4.  Ensures provision of top quality advisory services and facilitation of knowledge building and management in the area of Human Rights, Legal and Justice Sector Reform with a particular focus including but not limited to the implementation of Government of Indonesia’s National Strategy on Access to Justice and its relevant policies and regulations. This will be achieved through following activities:

  • Identification of sources of information related to policy-driven issues. Identification and synthesis of best practices and lessons learned directly linked to programme country policy goals.
  • Coordination of development of policies and institutions that will address the country problems and needs in collaboration with the Government and other strategic partners.
  • Establishment of advocacy networks at national level and linked to international networks. Relevant, high-impact advocacy campaigns are implemented with key partners.
  • Sound contributions to knowledge networks and communities of practice.
  • Organization of trainings for the operations/ projects staff on programme.

III. Impact of Results

The key results have an impact on the overall success of the country programme and reaching UNDAF/ CPD goals. In particular, the key results have an impact on the design, operation and programming of activities, creation of strategic partnerships as well as reaching resource mobilization targets.

Required Skills and Experience

V. Recruitment Qualifications

Education: 

  • Master’s Degree or equivalent in Law, Business Administration, Public Administration, Economics, Political Sciences, Social Sciences or related field.

Experience: 

  • Minimum 10 (ten) years experience in human rights, legal and justice sector reform issues.
  • Outstanding track record in publishing materials on human rights, legal and justice sector reform;
  • Proven experience in participatory planning approaches;
  • Proven experience in providing advisory service
  • Proven leadership and facilitation skills;
  • Strong analytical and people skills, demonstrated in facilitating high-level dialogues and consultation on strategic issues, as well as in catalyzing buy-in process by prospective stakeholders
  • Strong understanding of Indonesian government systems, its judiciary and law enforcement agency such as Attorney General Office and Anti Corruption Commission (KPK) as well as political issues and relevant key players
  • Excellent communication skills including: proven writing skills, inter-personal skills, and public speaking in formal settings; and
  • Familiarity with UNDP system is an asset
  • Fluency in English and Indonesian.

Language Requirements

  • Fluency in the UN and national language of the duty station.
