Background

In 2005 in the context of the new European Neighbourhood Policy, RM and EU signed an agreement: EU-Moldova Action Plan (EUMAP) for a period of 3 years, where a series of actions were included in order to intensify cooperation between the two parts. At the end of the period of the Action Plan, the European Council adopted in February 2008 a decision regarding a principle availability of the EU to initiate new negotiations with the RM with the aim of singing of a new agreement.   parallel with the Action Plan, RM has signed with EU an agreement for a facilitated visa regime, as well as obtained from EU a preferential trade regime for most of the goods produced in Moldova. In 2010 Republic of Moldova started and conducted successful negotiations with EU for an Association Agreement and the country has today undertaken concrete steps toward a deeper relationship with the EU. Moldovan institutions have started preparing themselves for the post-negotiation phase of the Association Agreement and need for valuable international expertise in implementation of the agreement is more than ever needed.

The Project „Building Institutional Capacity of the Ministry of Foreign Affairs and European Integration” aims to contribute to the development of the capacities of the MFAEI and the Negotiation Team (comprising representatives of the Ministry of Health) for European Integration, with immediate focus on the negotiation and post-negotiation phase of the Association Agreement (AA) between the European Union and the Republic of Moldova and implicitly its implementation.
In 2010 the Project provided Ministry of Health with support in the preparation of feasibility studies for the implementation of the EU legal acts stipulated at the specific annex of the public health chapter of the AA, in the context of their further transposition and effective implementation. The Ministry of Health requested additional assistance in “tissues and cells” transplant area.

Duties and Responsibilities

Objectives
The Project will contract an International Consultant to provide consultancy services to the Ministry of Health of the Republic of Moldova (further referred as Ministry).

Key activities

  • Analyze the existing Moldovan legal framework in health sector and other documentation available.
  • Prepare a preliminary and feasibility impact assessment study (not full RIA) for the Directive 2010/53/EU of the European Parliament and of the Council of 7 July 2010 on “standards of quality and safety of human organs intended for transplantation”.
  • Prepare, on the basis on the available impact assessment studies, detailed action plans for the effective implementation of the listed below EU legal acts related to “Tissues and cells” medical area:
    a)      Directive 2004/23/EC of 31 March 2004 on “setting standards of quality and safety for the donation, procurement, testing, processing, preservation, storage and distribution of human tissues and cells”.
    b)      Directive 2006/17/EC of 8 February 2006 implementing Directive 2004/23/EC on “certain technical requirements for the donation, procurement and testing of human tissues and cells”.
    c)       Directive 2006/86/EC of 24 October 2006 implementing Directive 2004/23/EC on “traceability requirements, notification of serious adverse reactions and events and certain technical requirements for the coding, processing, preservation, storage and distribution of human tissues and cells”.
    d)      Directive 2010/53/EU of the European Parliament and of the Council of 7 July 2010 on “standards of quality and safety of human organs intended for transplantation”
    Deliver 2 (two days) presentation / training on the practical implementation of the delivered action plans.
    Deliver one-day comprehensive presentation on “Current and future opportunities for Moldovan Ministry of Health to apply for new funds from the EU programs”.

Competencies

  • Knowledge of the EU assistance available for Moldova at current stage and after the conclusion of the AA with EU.
  • Extensive knowledge and wide experience in drafting and/or implementing EU legislation in public health sector focus on transplant.
  • Experience in performing incipient estimative economic analysis of EU Legal acts in Health Sector before their transposition in a national legal framework.
  • Experience in assisting government institutions within projects funded by international organizations.
  • Qualification and/or proven skills in project coordination, credibility in dealings with governmental officials, strong team leadership abilities and communication skills.
  • Excellent analytical and communication skills.

 

Required Skills and Experience

Education:

  • Advanced degree in the area(s) of Medicine, Public Health, EU Law, Social Science or similar field or equivalent working experience in the sector.

Experience:

  • Minimum 5 years of working  experience in the area of expertise.
  • Demonstrated knowledge and experience in drafting and/or implementing the EU legislation in public health sector.

Language:

  • Fluency in written and spoken English
  • Knowledge of Romanian or Russian would be an advantage.
