Background

 

The United Nations Development Programme South Sudan (UNDP) Support to Access to Justice and Rule of Law Programme aims to contribute to national priorities as articulated in the South Sudan Development Plan (SSDP) Conflict Prevention & Security Pillar. The specific Rule of Law Sector Objective isto strengthen the Rule of Law in South Sudan by enforcing and maintaining law and order, providing equitable access to justice and a functioning criminal justice system, increasing security in communities, and promoting and protecting human rights for all.” UNDP’s strategy in promoting rule of law is twofold. First, providing support to the priorities of the rule of law institutions (Judiciary, Ministry of Justice (MoJ), Police and Prison) as articulated in their institutional Strategic and/or Action plans. Second, promoting access to justice by linking the rule of law institutions with community and civil society initiatives.

Since South Sudan acquired statehood on 9 July 2011, it accepted its obligations under the United Nations Charter and undertook to fulfill them. The Republic is now a responsible member of the international community and respects its international law obligations. Upon that background the Ministry of Justice with support of UNDP is strengthening the capacity of Public Prosecutors in International Justice through a two weeks capacity building training.

The Individual Consultants will work under the guidance of the Chief Technical Advisor Ministry of Justice (CTA-MoJ). He/she will, further, be supported by the Project Support staff, which is embedded in the MoJ.

Duties and Responsibilities

Work Objectives:

To facilitate capacity building training for 25 five prosecutors in the following topics:

  • Constitutional law.
  • International criminal law (Substantive and Procedural).
  • International human rights law.
  • International humanitarian law.
  • The Right to Fair Trial.
  • Legal English.

Functions / Key Results Expected

Under the direct guidance and supervision of the UNDP Access to Justice and Rule of Law Chief Technical Advisor and the MoJ, the resource person will perform the following duties:

  • Prepare and finalize course content in collaboration with UNDP Access to Justice and Rule of Law Chief Technical Advisor and the Ministry of Justice.
  • Select and conclude course materials to in consultation with the CTA and the MoJ, and provide advance copies in electronic version.
  • Conduct full course lectures.

Scope of Assignment:

Prepare and deliver in-depth lectures over a period of 5 days to be conducted in Juba, South Sudan.

Deliverables and Timelines:

The Consultancy will be for a total of  7 days and is scheduled as follows:

  • Prepare, select and finalize course content and course materials and provide soft copies in collaboration with UNDP CTA and the MoJ. 2 days  home based ( from July 30-31, 2015)
  • Conduct full course lectures in Juba South Sudan  5  days ( August 3 -7, 2015 or Aug 10-14, 2015)

Required Skills and Experience

Education:

  • PhD or Masters level degree in International Law: Interested persons must be highly qualified scholars in the relevant area.

Experience:

  • Minimum of 7 years of relevant experience as a lecturer in a University or researcher or a trainer.
  • Proven experience  in teaching and research in any of the following areas: International Criminal Law, International Human Rights Law, International, Humanitarian Law, Constitutional Law and Right to Fair Hearing.
  • Proven experience or knowledge in designing and facilitating trainings in the required areas.
  • Previous experience working with high-level government counterparts and development partners.
  • Previous experience of facilitating trainings of similar nature in a post/conflict environment in particular South Sudan is highly desirable.
  •  Past experience with UNDP or other UN Agencies or International Non-Governmental Organizations in similar positions constitutes an advantage.
  • Strong computer skills (Word, Excel, Power point and etc.)
