Background

As part of Turkey’s wider reform agenda aimed at improving the technical and institutional capacities of its public administration system for enhanced democratization and modernization, and in full compliance with Turkey’s efforts to accede to the EU as a full member, the Turkish Government has initiated the ‘Improvement of Civilian Oversight of Internal Security Sector’ Project (ICOISS) designed “to structurally embed expanded enjoyment of civil rights by Turkish citizens and democratic control of internal security in the regulatory system and public administration practice of Turkey” (overall objective).

Upon the request of the Ministry of Interior (main beneficiary), UNDP CO has been selected as the implementing agency responsible for providing technical assistance to the EU-funded ‘Improvement of Civilian Oversight of the Internal Security Sector’ Project. The Project has been officially launched in June 2008, and is due to continue until November 2009.

United Nations Development Programme (UNDP CO) seeks short term consultants to establish a roster of qualified experts to work within the scope of “Improvement of Civilian Oversight of Internal Security Sector” Project.  The project has 3 main components:

Comp. A Legislative Framework: This component is geared towards developing a legislative framework, which will enable MoI and the public administrators (governors and sub governors) to exercise civilian oversight over law enforcement bodies.

Comp. B Capacity Building: This component aims at equipping the Ministry of Interior and the public administrators (governors and sub governors) with the conceptual and institutional tools and resources to oversee policing effectively.

Comp. C Civil Society and Media: The activities to be fulfilled within the scope of Component C will help civil society and the media have the conceptual and institutional tools to engage with policing oversight.

Required fields of specialization of experts:

  • EU Member States’ public administration system and European principles and standards in public administration reform and particularly on civilian oversight of internal security
  • International practices, mechanisms and structures of civilian oversight of internal security forces at central and local level
  • Turkish public administration and internal security system and structures; mechanisms and practices of civilian oversight of internal security forces at central and local level 
  • Turkish and/or EU Member States’ constitutional and legislative as well as institutional structures of internal security oversight
  • Management of participatory processes involving central administration, local authorities, civil society organizations and media
  • Communication strategy design and development
  • Institutional capacity building at central and local level
  • Training needs assessment and training delivery in the field of internal security sector
  • Research and analysis in the field of security governance

Evaluation of Applicants

Applicants meeting the minimum qualifications listed above will be reserved for Project Roster. The listed candidates for the needed positions will be contacted as required. The selection method of the Consultant will be made in accordance with the quality- cost based selection method (70% technical component and 30% price component), for which the applicant will be requested a price proposal.

Duties and Responsibilities

Project Activities, for which short-term (varying from 10 to 60 working days) assignments will be sought include:

A.1.1. Review of the existing legislative framework and obstacles to exercise effective oversight functions over law enforcement bodies including the laws on the police, gendarmerie and secondary legislation.

A.1.2. Support to preparation of secondary legislation within the context of existing laws in order to clarify operationalization of security sector oversight.

A.1.3. Development of legislative framework (body of secondary legislation) proposals that ensure full and effective civilian oversight 

B.1.1. Develop a Communication Strategy in two stages, one for the Project and the other for monitoring reform of civilian oversight of internal security.

B.1.2. Expand knowledge of security sector governance through preparation and publication of guidelines for security sector oversight based on best practices in EU member and candidate countries;

B.1.3. Review of the institutional capacity of MoI at central and province/district level (governorates) to exercise effective civilian oversight and identification of problematic areas.

B.1.4. Development of policies and plans to overcome the identified problems

B.1.5. Assess the most appropriate mechanism for institutional capacity building of MoI, and develop proposals for its effective functioning.

B.1.6. Establish guidelines and protocols as well as practical tools (checklist, handbooks etc.) including minimum tasks for the conduct of civilian oversight of the police and gendarmerie on a regular basis

B.2.1. Review recruitment processes and pre-service and in-service training of governors and sub-governors (MoI inspectors/legal professionals as well as police and gendermarie) to expand and better reflect the areas of oversight; develop pre- and in-service training assessment report.

B.2.2. Deliver training to governors and sub-governors on governance of the security sector and oversight of policing

B.2.3. Deliver training to MoI inspectors/legal professionals and relevant human resources in governorates for backstopping governors' and sub-governors' oversight functions

B.2.4. Deliver training to the Police and Gendarmerie on the basic principles of civilian oversight and key principles of democratic policy

B.2.5. Conduct institutional assessment of selected governorates to ensure the institutionalization of relations between provincial administrators and civil society and to expand the notion of security to include human security

B.2.6. Install a best practices showcase system within the MoI for the Ministry to learn from/monitor oversight capacity/weaknesses

B.3.2. Produce a model for each pilot province for strengthened cooperation between the offices of the governors and district governor and the civil society in security sector oversight with inputs from relevant stakeholders involved

B.3.3. Implement models in 4 pilot provinces through the office of the governors, district governors and local actors (elected in particular)

B.3.4. Prepare and publish a Turkish language practice note on provincial government and civilian oversight based on experiences of pilot implementations

C.1.1. Identify security governance topics for further research and analysis

C.1.2. Expand national knowledge pool on security sector by conducting independent research and analysis in selected security governance fields and publication of such analysis in cooperation with civil society

C.1.3. Establish regular consultation mechanisms for MoI at central and province/district level (governorates) with the civil society on safety and security concerns of citizens and expectations from policing

C.1.4. Organize 3 one-week study visits to EU member states’ security organizations and civil society networks on how to effectively engage in security sector and citizen safety

C.1.5. Organize two provincial level and one national level security sector governance conferences with focus on internal security oversight

C.1.6. Organize roundtables with journalists, columnists and civil society on concepts and definitions (state security, public safety, human security etc.) and to share information and experiences

Competencies

The required specific experience depends on the scope of the specific activities. The following requirements are indicative.

  • For international consultants, extensive knowledge of EU Member States’ (or Turkish) public administration system and reform processes, legal and political context, and constitutional and legislative structures of civilian oversight of internal security.
  • For local consultants extensive knowledge of Turkish public administration system, legal and political context, and constitutional and legislative structures of civilian oversight of internal security.
  • Previous working experience in international projects will be an asset.

Required Skills and Experience

General Qualifications:

  • University Degree in Public Administration, Law (Public Law), Political Science, Sociology of Organizations, Criminology and other fields relevant to the assignment or equivalent (Police / Gendarmerie Degree). Advanced Degree (Masters or equivalent) in any one of the above will be an advantage.
  • Proficiency in English language (spoken and written).
  • Computer-literacy (MS Office).  
  • Good inter-personal and cross-cultural communication skills

Professional experience:

  • For senior consultants a minimum of 10 years of professional experience is required;
  • Consultants that have a minimum of 5 years of international experience (professional and/or academic experience gained in an international environment) are considered international experts;
  • For junior consultants a minimum of 3 years of professional experience is required.
