Antecedentes

The Accelerating Digitization in the Justice System of Bangladesh is an innovative project to be implemented by UNDP. The project will be led by UNDP in close collaboration with the Ministry of Law, Justice and Parliamentary Affairs, Supreme Court of Bangladesh, National Legal Aid Services Organizations. The project will provide technical and program support in developing the digital justice service systems in the Higher and Lower Courts in Bangladesh. Through the scope of this project, innovation injustice and legal aid services will also be introduced to put in place towards facilitating effective, timely, low cost digitalized justice service more effectively mobilize required resources from public and private sources for attaining SDGs by 2030.

The project focuses on reducing the existing case backlog and delivering low-cost, easily accessible automated justice services during and beyond C19. The objective is fully aligned with the Government’s vision and development needs as well as forward-looking and future-oriented in supporting national recovery and development efforts. The major activities of this program will create synergies between key justice sector duty bearers on strengthening access to justice for the justice seekers from left-behind communities.

Specific objectives:

  • Conducting legal research, desk reviews, data analysis, facilitation for the ongoing justice reform initiatives of UNDP.
  • Prepare periodic legal analysis and research on the case data analysis from Legal Aid cases, National Legal Helpline Center, Workers Legal Aid Cells, gender-based violence cases, and related jurisdictions.
  • Comparative desk review on the best practices of Digital Justice System and thematic legal research;
  • Provide support to prepare quarterly reports, program reports;
  • Provide support to develop program documentation, advocacy tools and communication materials, etc for the overall justice-oriented initiatives;
  • Any other activities guided by the supervisor.

Scope of works: the scope of work would be focused on

  • Relevant research, desk reviews, comparative legal analysis on legislations, ongoing legal issues including best practices,
  • compiling the program reporting,
  • activity-based program support concerning the ongoing justice sector reform initiatives including the planned actions of the Accelerating Digitalized Justice System in Bangladesh project.

Competencias

Additional Capacity:  

  • Proven experience in analytical research, report writing in law and human rights, the justice reform initiatives.
  • Prior experiences of working with UNDP or other international development agencies will be an added advantage. 
  • Experience working in a development project with justice sector institutions, e,g. Supreme Court, Ministry of Law, NLASO will be an asset.
  • Working knowledge on usage of computer and office software package. 

Language

  • Fluency in written and spoken English and the ability to writing reports are required.

  • Strong background in promotion of peace and human rights, Demonstrated knowledge on community-sensitive mechanisms in Bangladesh;

The consultant should produce all deliverables by the dates. The Human Rights and Justice Programme of UNDP will review the draft document and share feedback with the consultant. 

Supervision and Performance Evaluation:

The Consultant will closely work with the Human Rights and Justice Programme of UNDP and the justice portfolio of DG Cluster. UNDP will assist to get relevant justice reform-focused information from the concerned stakeholders. UNDP will also provide necessary logistic supports if required. The Consultant will report to the Chief Technical Advisor of the Human Rights and Justice Programme, Democratic Governance cluster of UNDP Bangladesh.  

 

 

Duration of the Work and Duty Station

The assignment is for a total of 120 working days from its commencement, between October 2021 and June 2022(Tentative). Workstation would be will be based at HRJP, UNDP in Dhaka, Bangladesh.

Travel and DSA:

No DSA will be paid at the duty station. If unforeseen travel outside the duty station not required by the Terms of Reference is requested by UNDP, and upon prior agreement/approval, such travel shall be UNDP’s expenses and the individual contractor shall receive a per-diem not to exceed United Nations daily subsistence allowance rate in such other location(s).

FINANCIAL PROPOSAL

Price Proposal and Schedule of Payments

The consultant must send a financial proposal based on a Lump Sum Amount. The total amount quoted shall be all-inclusive and include all costs components required to perform the deliverables identified in the TOR, including professional fee, travel costs, living allowance (if any work is to be done outside the IC´s duty station) and any other applicable cost to be incurred by the IC in completing the assignment. The contract price will be a fixed output-based price regardless of the extension of the herein specified duration. Payments will be done upon completion of the deliverables/outputs and as per below percentages-

In general, UNDP shall not accept travel costs exceeding those of an economy class ticket. Should the IC wish to travel to a higher class he/she should do so using their own resources. Lodging, meals, and transport cost for field visits related to this assignment will be paid by the project as per UN standard.

In the event of unforeseeable travel not anticipated in this TOR, payment of travel costs including tickets, lodging, and terminal expenses should be agreed upon, between the respective business unit and the Individual Consultant, prior to travel and will be reimbursed.

EVALUATION

Cumulative analysis:

When using this weighted scoring method, the award of the contract should be made to the individual consultant whose offer has been evaluated and determined as:

a) responsive/compliant/acceptable, and

b) Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

All technically qualified proposals will be scored out of 30 based on the formula provided below. The maximum points (30) will be assigned to the lowest financial proposal. All other proposals receive points according to the following formula:

µ = price of the lowest-priced proposal
z = price of the proposal being evaluated

Recommended Presentation of Offer

Interested individuals must submit the following documents/information to demonstrate their qualifications.

a) Duly accomplished Letter of Confirmation of Interest and Availability using the template provided by UNDP;

b) Personal CV or P11, indicating all past experience from similar projects, as well as the contact details (email and telephone number) of the Candidate and at least three (3) professional references;

c) Brief description of why the individual considers him/herself as the most suitable for the assignment and a methodology on how she/she will approach and complete the assignment.

d) Financial Proposal that indicates the all-inclusive fixed total contract price, supported by a breakdown of costs, as per template provided

e) Suppose an organization/company/institution employs an Offeror and he/she expects his/her employer to charge a management fee in the process of releasing him/her to UNDP under Reimbursable Loan Agreement (RLA). In this case, the Offeror must indicate this at this point and ensure that all such costs are duly incorporated into the financial proposal submitted to UNDP.
