The consultancy is planned under the umbrella of the Technical Assistance Facility (TAF) for Newly Elected Local Government Leaders (the Facility), an intervention co-funded by the Government of Sweden and the United Nations Development Program (UNDP), and administered by UNDP. As part of the Project for Improving Performance of Local Services (PIPLS) in Bosnia and Herzegovina, UNDP BiH’s Local Development Program, and the Good Governance Sector’s portfolio, the Facility aims to inject speed and purpose to the implementation of the newly elected local government leaders’ reform agenda through the provision of expert technical assistance across several priority sectors. Working with newly elected mayors and legislatures, the Facility will offer specialized expert assistance across four principle thematic areas: digital governance, service delivery and infrastructure, financial management and local economic development.    

One of the key focus areas within the Local Development Strategy[1] of Centar Sarajevo Municipality (the Municipality) is achieving competitiveness, which discusses and proposes actions for improving economic structure, investment attraction and business enabling environment. Acknowledging challenges with traditional financing of public infrastructure projects in BiH, the Municipality adds on and expands its strategic approach with the development of new investment models, such as models based on construction rights, concessions, and public-private partnerships (PPP).

In January 2020, the Municipality explored the potential of new investment models to boost the implementation of local strategy, which resulted in a list of 20 potential PPP projects[2]. Having in mind the findings of the PPP policy environment research in Canton Sarajevo[3], the Municipality intends to launch preparation of its first PPP project – the Underground Parking Garage located in Merhemica Trg.

The purpose of this consultancy is to provide technical support to the Municipality with the preparation of the PPP feasibility study and launching the public call for a selection of a private sector partner for this project.

Duties and Responsibilities

The PPP Expert (the Expert) will be responsible for supporting the Municipality, through a participatory process, by preparing the PPP feasibility study and public call for the selection of a private sector partner in line with the relevant BiH legal framework, primarily but not limited to Canton Sarajevo PPP Law and accompanying by-laws.

The entire service will be delivered in the languages of BiH people. The expected timeframe for delivery of the service is December 2021 – April 2022.

More specifically, the Expert will be expected to perform the following tasks:

Task 1: Facilitate the establishment and functioning of an effective municipal PPP project team

As a first step, the Expert will have a discussion with the UNDP project team to agree on a timeline of the process.

To ensure institutional ownership and learning among the municipality staff, the process of the development of the PPP feasibility study and public call will be steered by the municipal PPP project team (the PPP project team). The Expert is expected to support the preparation of the scope of work and responsibilities of the PPP project team, to be endorsed by the Mayor.

Following the appointment of the PPP project team, the Expert will prepare and facilitate a one-day workshop.

The level of effort envisaged for this task is 2 days.

Task 2: Support preparation of draft PPP feasibility study

Under this task, the Expert will regularly meet with the PPP project team, at least once in 14 days to provide technical assistance and guidance on the feasibility study preparation. The Expert is particularly expected to advise and guide the PPP project team in the following key phases:

  1. Collecting and reviewing existing information relevant for the PPP project (land ownership, spatial planning documents, information about the current and future parameters of the designated public service (parking) from strategic documents, fiscal capacities, technical design, and its alignment with relevant legal standards – environment, safety, etc., preliminary calculations of CAPEX and OPEX, et al).
  2. Collecting/updating additional data, if needed (depending on the results from phase one). This phase may include providing support with preparing and facilitating public consultations (survey, citizens’ meetings, consultations with cantonal stakeholders such as relevant ministry, Institute for public planning, et al) and participating in dialogue with potential/interested private partners. 
  3. Defining PPP project’s output specification (in terms of targeted public service – parking) and public sector’s expected standards/conditions (qualitative criteria which are used in later PPP-specific analyses, such as Public Sector Comparator)
  4. Preparing/updating preliminary technical design in line with earlier established standards and conditions, with CAPEX and OPEX cost estimate
  5. Conducting financial and economic analysis which needs to include also public sector’s fiscal capacity assessment, PPP risk analysis with PPP risk allocation matrix, Public Sector Comparator analysis
  6. Reviewing results of all analyses and providing recommendations for the final implementation model.

The Expert is required to prepare an introductory training with practical guidance, including case studies/templates if needed, at the beginning of each phase. The Expert will provide support to the PPP project team with drafting sections of the feasibility study after each phase.

The Expert will also assist the PPP project team in preparing a presentation of the draft PPP feasibility study for the Mayor and other key stakeholders and will advise the Municipality on legal steps towards its adoption (by the Municipal Council or Canton, depending on the final model).

Once the draft PPP feasibility study has been prepared, the Expert will prepare a brief report on Task 1 and 2 which will be sent to the UNDP project team for approval.  

The level of effort envisaged for this task is 25 days.

Task 3: Support preparation of draft public call for selection of private sector partner

Within this task, the Expert will prepare and deliver a half-day training to the PPP project team on public call preparation. The Expert will asist the PPP project team in preparation of the first draft of the public call based on the relevant legal framework and the final findings of the feasibility study (as per recommended model). Furthemore, the Expert will advise the PPP project team on preparation of a draft contract which will be an integral part of the public call. The draft public call will be presented and discussed with the PPP project team, as well as other stakeholders as needed (such as Public Defender’s Office), and completed in accordance with relevant feedback provided.

The envisaged level of effort for this task is 10 days.

Task 4: Review of lessons learned and reporting

Under this task, the Expert is expected to compile key lessons learned in this process, to be used in further implementation of PPP projects by the Municipality (and other local governments in Canton Sarajevo), as well as to be potentially considered in the process of regulatory changes when it comes to PPP in Canton Sarajevo. 

The expert will asist the PPP project team in preparation of meeting minutes as well as in preparation the final report for the Mayor and/or Municipal Council.

Further, the Expert is expected to prepare brief reports after completion of each task, including deliverables, and the final report.

The envisaged level of effort for this task is 5 days.

Required Skills and Experience

Academic Qualifications/Education:

  • Advanced university degree in law, economy, public/business administration, or a related field.

Experience:

  • At least 10 years of experience in provision of expert support to public sector development (strategic planning, good governance, EU accession, local and rural development, etc.);
  • At least 5 years of extensive experience with public-private partnerships (PPP policy making and implementation; PPP capacity building; preparation of PPP feasibility study, drafting public call for selection of private partner, preparation and participation in PPP contracting);
  • Proven multiple stakeholder groups' facilitation and coaching skills;
  • Strong communication and presentation skills;
  • Previous experience in working with international organisations, preferably UNDP.

Languages Requirements:

  • Fluency in both written and spoken English language is required;
  • Fluency in official languages in Bosnia and Herzegovina.

Other Requirements:

  • Excellent computer skills (MS Office applications) and ability to use information technologies as a tool and resource.
