Antecedentes

As a result of the conflict that occurred in Kosovo during 1998 and 1999, the uncertainty to property rights relating to private immovable property including agricultural and commercial property has presented serious challenges in protection of Human Rights - and negatively affecting the economy and returns of the displaced population.
 
Under UNMIK Regulation No. 2006/10, promulgated 4 March 2006, as amended by UNMIK Regulation 2006/50, and Assembly of Kosovo Law 03/L-079, the Kosovo Property Agency (KPA) was established as an independent administrative agency to assist the judiciary in its efficient and effective resolution of claims relating to private immovable property on the territory of Kosovo.

Purpose and Scope of Assignment
The position is located within the Enforcement Unit and under the supervision of the Head of Enforcement Unit. The incumbent is responsible for supporting assigned field activities, with special emphasis on the implementation of claims through repossession of private immovable property and supporting the operation of the voluntary rental scheme through the eviction of illegal occupants. The KPA requires that an international staff member be present at each eviction that the KPA undertakes along with Kosovo Police assistance. The nature and number of evictions is dependent on the issuance of warrants and up to twenty five evictions are scheduled per week.
 
The international presence is required to ensure that the eviction team who perform the required work carries out the eviction without interference from the evictees and to liaise with the police in order to ensure that the eviction is undertaken.
  • Oversight of the Eviction Team undertaking the implementation of a claim through repossession or the release of an illegally occupied property under the administrative authority of the KPA.
  • Provision of advice and guidance to the Eviction Team prior to and during the eviction and acts as the primary point of contact with the KPA HQ and the police officers assigned to the specific eviction.
  • Provides a detailed written report on a daily basis on the evictions undertaken. Ensures that the reason for any failed eviction is brought to the attention of the Head of Enforcement Unit verbally as soon as practically possible.
  • Reviews on a regular basis and proposes amendment to standard operating procedures where necessary in coordination with the Head of Unit.
  • Supports the Head of Unit in the performance of administrative, personnel and logistical responsibilities.
  • Undertakes quality control of case procedures and pre and post-enforcement documentation.

Monitoring and Progress Controls

  • Reports on a daily basis on the evictions undertaken and immediately in cases where the eviction has not been undertaken.
  • Reviews Standard Operating Procedures and proposes amendments to ensure that the administrative and operational aspects of the enforcement activities and of the KPA are undertaken in an optimum manner. 
  • Monitors the work of the Enforcement Team to ensure efficient and effective work practices are implemented and maintained throughout.
  • Provides input to the Enforcement Units weekly report in relation to the nature and number of evictions completed. 
Final Product
  • For up to 25 evictions per week provide a narrative report on the evictions undertaken on a daily base. 
  • All Standard Operating Procedures which relate to activities and tasks undertaken by the Enforcement Unit are reviewed on a quarterly basis or more often as required and where necessary a report proposing amendments should be prepared.
  • Provision of advice and guidance to the Enforcement Team prior to, during and post eviction.
  • Provides a written report on a weekly basis highlighting any problems encountered during the performance of any of the enforcement activities.

Habilidades y experiencia requeridas

Education:

  • University Degree in management, social sciences, law or equivalent field. Relevant work experience in enforcement may substitute for the requirement for a university degree.
  • Substantive knowledge of international legal standards and international peace keeping operations.
  • Extensive knowledge of computer and MS Office applications

Experience:

  • Minimum 6 years relevant professional experience
  • Previous experience from international organizations is desirable
  • Familiarity with Property law will be an advantage.
  •  Effective in dealing with local and international counterparts and ability to work in a multi-ethnic and multi-national environment.
  • Excellent organizational skills as well as process and procedure formulation, implementation and evaluation skills.
  • Strong commitment to non-discrimination.
