Antecedentes
I. Background
UNDP Indonesia's mission is to be an agent for change in the human and social development of Indonesia. We aim to be a bridge between Indonesia and all donors as well as a trusted partner to all stakeholders. We work in four key areas of development: Democratic Governance, Regional Development and Poverty Reduction, Conflict Prevention and Recovery, and Environment and Climate Change. Besides the four priority areas, UNDP Indonesia is also engaged in crosscutting initiatives such as HIV/AIDS and gender equality.
II. Organisational Context
Over the past four years UNDP has provided support for both the Government of Indonesia (GoI) and Indonesian civil society to undertake activities that strengthen access to justice (A2J) in manifold ways. Through the Legal Empowerment and Assistance for the Disadvantaged Project (LEAD), UNDP facilitated the GoI’s formation of the National Strategy on Access to Justice (NSA2J), launched by BAPPENAS in October 2009, and provided grants for NGOs to undertake a diversity of A2J activities in a number of provinces. In Aceh province, UNDP has also provided timely and comprehensive access to justice support in post-Tsunami and post-conflict context under the Aceh Justice Project (AJP) by strengthening institutional capacity of the Aceh formal and informal justice system.
Both LEAD and AJP projects have been implemented since 2007. This 2011 is a crossing path between completion of both projects and coming in of a new project of so called “Strengthening Access to Justice in Indonesia” (SAJI).
SAJI project presents continuation and expansion of these two UNDP projects that will be geared towards improved access to justice of Indonesian citizens and thereby contribute to the alleviation of poverty, good governance practices, and empowerment of the disadvantaged, vulnerable, and marginalized people.
In accordance with Jakarta Commitment and the principle of supporting national priorities and policies, SAJI Project will use as guiding framework GoI’s National Strategy on Access to Justice (NSA2J) and other relevant Indonesian policy instruments, directly linking the policy and local interventions such as the National Action Plan on Human Rights. SAJI will help realize Indonesia’s 2005-2025 Long Term Development Plan (LTDP), which emphasizes that, consistent with its vision of “A Just Indonesia,” development is to be carried out from the people, by the people and for the people.
The Project
SAJI Project is developed based on experiences, best practices, and lessons learned from LEAD and AJP Projects. SAJI consists of the following four components:
1. Institutional mechanisms, legal and regulatory framework, and capacities of government institutions strengthened to implement the recommendations and Action Plans of the National Strategy on Access to Justice
At the national level, SAJI will therefore provide support to the implementation of the National Strategy by working through the National Secretariat for Access to Justice within BAPPENAS (already established with UNDP support)
2. Improved public complaint and grievance handling mechanisms (PCGMs) in government institutions at both national and subnational levels
Development and functioning of effective public complaint handling mechanisms are critical to increasing people’s access to justice. Although various state institutions have to date attempted to strengthen their PCM, there are still many challenges ahead to ensure effective handling of and responses to public complaints, particularly with a special attention to the interests of the poor and disadvantaged in the country.
3. Access to Justice in informal justice channels increased, particularly for women and vulnerable groups.
A majority of Indonesians resort to the customary/informal justice mechanisms available in their communities when resolving disputes and grievances. Informal justice systems are often the ‘system of choice’ in dealing with a significant proportion of civil and (usually petty) criminal matters such as disputes, family and community problems, land and resource issues. Despite advantages of being quicker, cheaper and easier than the formal institutions, informal justice systems have various challenges which include limited capacity of the actors, absence of guidelines and common standards, and insufficient accountability and safeguards for their justice outcomes. Given the challenges, SAJI will improve the transparency, fairness, and clarity of the informal justice systems, with a particular attention to the rights of women and indigenous people, following the recommendations of the NSA2J.
4. Knowledge management to inform policies and initiatives to effectively strengthen access to justice and to contribute to Indonesian reporting on the implementation of human rights instruments
SAJI’s experiences, results, and lessons learned will be captured as to provide valuable resources for advocacy, improvement of access to justice initiatives, as well as policy making. The knowledge products will also be used as the valuable information and recommendation on the progress of Indonesia towards their obligations under the key ratified international human rights instruments whereby SAJI will contribute into the development of both periodic state and independent reports.
The first component will be implemented mainly through the extension of LEAD Project, a project under the umbrella of SAJI Project. While originally set to be expired at the end of December 2011, both UNDP and BAPPENAS decided to extend duration of the LEAD Project until end of June 2013. Such extension is aimed to ensure uninterrupted provision of supports for the implementation of the National Strategy on Access to Justice that has been launched at the end of 2009.
Under the overall guidance of National Project Director (NPD) and Programme Manager of Access to Justice, Participation and Representation Cluster, the Project Manager assumes managerial responsibility for project implementation of SAJI and LEAD projects.
He/she will be responsible for regular reporting to the Programme Manager and Team Leader of Democratic Governance Unit of UNDP Indonesia. He/she must maintain close communication with UNDP and NPD over operational issues as well as strategic opportunities arising from the project implementation.

III. Functions / Key Results Expected

1. Ensuring the strategic direction and implementation of project strategies focusing on achievement of the following results:
- Effective application of RBM tools, establishment of management targets and monitoring achievement of results;
- Work closely with the National Project Director (NPD) to oversee and ensure the overall quality of project planning, management, reporting, monitoring and evaluation;
- Ensure efficient use of resources and report it in transparent and accountable manner;
- Responsible for managing critical issues and provide solutions to the overall processes of project implementation
- Identify expertise and prepare TORs for consultants as well as programme activity proposals;
2. Ensures provision of top quality advisory services and facilitation of knowledge building and management focusing on achievement of the following results:
- Identification of sources of information related to policy-driven issues.
- In collaboration with the Government and other strategic partners, support to development of policies that will address the country problems and needs on access to justice.
- Identification and synthesis of best practices and lessons learnt directly linked to programme country policy goals.
- Sound contribution to knowledge network and community of practice
- Provision of capacity building and transfer of knowledge to government counterparts.
3. Ensures effective oversight of planning, budgeting, implementing and monitoring of the project, tracking use of financial resources focusing on the achievement of the following results:
- Coordination of project implementation with the executing agencies;
- Financial and substantive monitoring and evaluation of the projects, identification of operational and financial problems, development of solutions.
- Participation in audit of nationally implemented projects.
- Follow up on audit recommendations on a timely basis
- Performing the function of Authority level 1 in Atlas (as delegated) to approve requisition
4. Assurance of effective results of the national secretariat on access to justice and management of the team focusing on achievement of the following results:
- Provide strategic direction and substantive guidance to project team, experts, working groups and consultants to perform their role under project;
- With the other team members, prepare annual and quarterly work plans/reports, elaborate action plans; assists working groups in finding information on specific topics (seeking donor and government support for technical inputs when needed);
- Ensure timely submission of quarterly/progress reports to National Project Director, Head of Democratic Governance Unit UNDP, donors, counterparts and other relevant stakeholders; along with other reports which may be required, such as media briefings;
- Create monitoring and evaluation mechanism and quality standards of performance, to measure the achievement of working group activities;
- Along with the experts, constantly identify challenges and provide recommendations to manage risk of the project and ensure the smooth implementations
- Maintain close coordination with other projects working under the national secretariat on access to justice to ensure achievement of the secretariat’s goals;
5. Ensure creation of strategic partnership and support to the implementation of the resource mobilisation focusing on achievement of the following results:
- Establish and maintain good working relationship with the relevant public and development partners principal counterparts for the project;
- Creation and coordination of partnership with the UN Agencies, government institutions, bi-lateral and multi-lateral donors, private sector, civil society, etc;
- Analysis and research of information on donors, preparation of substantive briefs on possible areas of cooperation, identification of opportunities for initiation of new projects, active contribution to the overall office effort in resource mobilisation;
- Take a lead in organizing regular coordination meetings and dialogues with donors and other relevant stakeholders;
IV. Impact of Results
Project implementation must be in line with the objectives of the project and UNDP rules, regulations and procedures which are critical to ensure the achievement of UNDP Country Programme outcomes. A client-oriented and efficient approach has impact on the image of UNDP Country Office.

VI. Recruitment Qualifications
Education:
Master’s Degree or equivalent in Law, Business Administration, Public Administration, Economics, Political Sciences, Social Sciences or related field
Experience:
1. Minimum 3 years of relevant experience at the national or international level in development areas, with project or programme management, preferably in the legal reform and governance sector.
2. Proven experience in providing management advisory services, hands-on experience in design, monitoring and evaluation of development projects.
3. Understanding of the region, its local religions, culture and economic conditions, and understanding of current political and economic policies in Indonesia is essential.
4. Demonstrated knowledge and experience in working on improving access to justice and democratic governmence is essential.
5. Demonstrated skills in strategic communication and good relations with the donors and government partners.
6. Familiarity of UNDP system, rules and procedures is not required but would be an advantage.
7. Experience in the usage of computers and office software packages and in handling of web-based management system.
Language Requirements:
Fluency in written and spoken English with excellent English report-writing skills
