Background

The UNODC project TC/XAC/X50 Strengthening Criminal Justice Capacities of Central Asian Countries to Counter Terrorism in Compliance with Principles of Rule of Law seeks to promote a regional approach to counter terrorism in Central Asia and, at the same time, strengthen capacities of the respective states to address terrorism-related issues at the national level while respecting the rule of law. These two objectives will be achieved by (i) contributing to the improvement of the domestic laws, (ii) developing sustainable national capacity building training courses for the main parties in the criminal justice process, (iii) increasing the effectiveness of international cooperation in terrorism-related casework and (iv) supporting effective preventive measures via criminal justice responses to terrorism incitement and recruitment and facilitating regional dialogue between civil societies and the states for the purpose of preventing radicalization and violent extremism that lead to terrorism.
 
The purpose of this short-term assignment is 1) to design and develop a training course for judges in Kazakhstan, Kyrgyzstan, Tajikistan and Turkmenistan on effective adjudication of domestic anti-terrorism legislation and international standards, incorporating the rule of law and 2) to organize and conduct a minimum 2-day training exercise in each country respectively. 

Duties and Responsibilities

Under the supervision of UNODC ROCA International Project Coordinator and coordination of UNODC ROCA XAC/X50 respective Project Assistant, the training consultant will perform the following tasks:

To design and develop a practical training course (in English or Russian) on effective adjudication of domestic anti-terrorism legislation and international practice, based on the rule of law for judges in Kazakhstan, Kyrgyzstan, Tajikistan and Turkmenistan.
  • The training course should be adapted according to the national practice of each country and include a case study based on at least two relevant cases from each country and/or outside the region;
  • The training course should include curricular and lesson plans, reading materials, exercises, cases for analysis/discussion, sources of law, and other materials;
  • The training course should be shared in at least two drafts with the respective national training centres and UNODC and feedback considered and incorporated.
To organise and conduct minimum 2-day training for judges in the four countries using judicial trainers, at the respective national training centres, based on the above-mentioned training course and a detailed training agenda.

Indicators to evaluate the consultant’s performance

The Training Consultant will be evaluated as follows:

  •  Timely submission of the above-mentioned training course;
  • Effective use of national anti-terrorism legislation and relevant case law, including procedural guarantees for fair trial;
  • Effective use of the universal anti-terrorism legal instruments and relevant UN standards and norms in crime prevention and criminal justice, UNODC/TPB relevant Legal Training Curriculum and Digest of Terrorist Cases and any other materials provided by UNODC and national training centres;
  • Content: Substantive and comprehensive nature of the training course;
  • Form: The training course shall be interactive and include as a minimum: (i) an overview of relevant international instruments and national legislation, (ii) at least two practical case studies, iii) questions for evaluation and (iv) recommendations for further course development;
  • Comments from UNODC and national training centres on training course considered/integrated as requested;
  • Feedback from national trainers/training centres.

Required Skills and Experience

Education:
  • University degree in law, preferably with a specialization in criminal law.
Experience:
  • A minimum of two years work experience in the field of judicial training, preferably in the field of counter-terrorism or proven equivalent capacity;
  • Work experience in a judicial capacity would be desirable;
  • Practical experience of adjudication of terrorism-related cases, based on the rule of law would be desirable.
Language:
  • Excellent legal, analytical and communication skills in English or Russian.
