Antecedentes

Changes and amendments to the Law on mediation were adopted by the Parliament of Montenegro in June 2012 and their implementation started in January 2013. The first step undertaken in the scope of the implementation of the new Law was the development of the capacities of the National Mediation Center and its territorial units in the northern and southern part of the country. For the purpose of monitoring and evaluation, mediation module/database will be created in the scope of the Judicial Information System (PRIS), in cooperation with the Judicial Council and its IT and Multimedia Department. Further and enhanced promotion of mediation in the country will be generated, and partnerships, including in the region, will be established. The overall aim is to create sustainable mediation system in Montenegro.

Although mediation has taken foot in the country, it is necessary to work on the further promotion of this method of dispute resolution and the creation of conditions for the conduct of mediation proceedings. This will not only significantly contribute to the ongoing judicial reform, but will also put the country forward on its EU accession. Efficiency of the judicial system needs to be further enhanced and lengthy court procedures remain a cause for concern. Mediation would therefore provide a desirable alternative.

Sustainability of the mediation system in Montenegro will be enabled by means of two important factors. Firstly, the changes and amendments to the Law on mediation that are adopted by the Parliament of Montenegro in June 2012, stipulate that the Center for Mediation will have the status of a governmental institution. As such, the Center will be funded by the state budget and the salaries of its employees will also be covered through public budget allocation. Also, changes and amendments to the Law on mediation stipulate remunerations for mediators, which will make mediators more motivated to perform this job. Secondly, the amendments introduce an obligation for judges to acquaint their parties with the benefits of mediation for several types of civil disputes and propose it as an alternative dispute resolution tool. These two factors will provide for the sustainability of mediation, as one of the most often used alternative dispute resolution tools. There is a necessity for further promotion of the institute of mediation in order to acquaint people with its benefits, so that they would use it to a higher extent for the resolution of disputes.
 
Having in mind the above said, the intention of the UNDP Rule of Law and Human Rights Programme is to support the implementation of the new Law on mediation through the organization of initial and advanced trainings of mediators and establishment of the mediation module/database that will enable monitoring of the effectiveness of the implementation of the Law. The creation of the mediation database / module in the scope of the Judicial Information System (PRIS) will be used for obtaining the quantitative and qualitative data on the operation of the system of mediation. Through the database, the information on the number and type of cases which were referred to mediation will be obtained, along with the outcome of the cases.

In the aim of fulfilling all the mentioned tasks in a successful manner, UNDP Rule of Law and Human Rights Programme plans to support the promotion of the institute of mediation through engaging three Programmers to create a comprehensive situation analysis and provide programming assistance for the establishment of the Mediation module in the scope of the Judicial Information System (PRIS).  

The Programmers will be working in the scope of the project Improving the efficiency and accessibility of judiciary through implementation of the Law on legal aid and promotion of mediation, implemented in a close partnersip of the UNDP and Ministry of Justice of Montenegro.

Deberes y responsabilidades

Objectives of the assignment:

Provision of assistance to the officials of the Department for ICT and multimedia in the Judicial Council Secretariat in the analysis and development of a Mediation module for JIS (PRIS).

Job content:

Consultant / Programmer (3 positions) will be engaged under Individual Contract and will work in a close cooperation with the Department for ICT and multimedia in the Judicial Council Secretariat and the Center for Mediation, under the supervision of the UNDP Rule of Law and Human Rights Programme Manager.

The Consultant Programmer is expected to perform the following tasks:

  • Create overview of the legal acts and by-laws related to the institute of mediation in Montenegro;
  • Create overview of the current state of the Judicial Information System (PRIS), ICT infrastructure in the courts and possibilities for the upgrade of the existing system and integration of the Mediation module;
  • Make recommendations for the future steps to be taken in the further development of the ICT system;
  • Make estimation of costs for the implementation of the overall system;
  • Provide introduction to the JIS system, application solution, database and other technical details;
  • Participate in planning of the security aspects of the implementation of the modules and solutions in partnership with ICT Department;
  • Provide introduction to the Analysis module for mediation and other documents;
  • Participate in the team in charge of creating Mediation module, composed of officials of the ICT Department;
  • Conduct an analysis on the opportunities and building functionality to create forms for Mediation and digital signature;
  • Link the system with the mail server of the judiciary in partnership with the ICT Department;
  • Plan the process of linking the Mediation module with other systems, and programming functionality for data exchange with other parts of the JIS and other systems with technical possibilities;
  • Prepare documentation and statistical reports for the Mediation module, in cooperation with officials of the ICT Department;
  • Participate in the preparation of user manuals for the Mediation module;
  • Test and launch the system.

Expected results/ deliverables:

  • Mediation module for JIS created, in cooperation with the ICT Department;
  • Analysis on the opportunities and building functionality to create forms for Mediation and digital signature conducted;
  • The system, in cooperation with the ICT Department, linked with the mail server of judiciary;
  • Linking the Mediation module with other systems, and programming functionality for data exchange with other parts of the JIS and other systems with technical possibilities, realized;
  • Documentation and statistical reports for the Mediation module prepared, in cooperation with officials of the ICT Department;
  • Documentation for the Mediation module prepared;
  • User manuals for the Mediation module prepared;
  • System tested and launched.

Duration:

Consultant Programmer (3 positions) will be engaged for the period of 30 working days.

Habilidades y experiencia requeridas

 Education:

  • University degree obtained at the field of Informatics, Electrical Engineering, Mathematics and Natural Sciences.
Experience:
  • At least five (5) years of relevant professional experience;
  • Extensive knowledge of ICT systems, database software operation, etc.;
  • Knowledge and experience in technologies underlying the Judicial Information System (JIS) - Oracle Forms, Reports, and Oracle DB;
  • Knowledge of Linux operating system;
  • Experience in working with digital signatures and certificates;?Experience related to data and information systems safety;
  • Possession of Certificate ISO 27001 Internal Auditor or Lead / External Auditor will be considered as an advantage;
  • Previous experience in working with JIS will be considered as an advantage;
  • Previous work experience with UN/UNDP or other international organizations will be considered as an advantage.
Language:
  • Knowledge of written and spoken English language.
