Background

Ukraine continues to be one of the least energy efficient countries in the world and has one of the highest GHG emissions level per unit of GDP among CIS countries. Ukraine ranks 19th among the world’s largest emitters of GHGs. Overall, Ukraine is one of the countries in Europe with the lowest energy-efficiency. Moreover, the efficient use of energy resources in Ukraine's economic and social sphere is very low. Currently, the power consumption in relation to the gross domestic product in Ukraine is more than twice higher than in the industrialized countries of Western Europe and it keeps on growing. In the pre-crisis period the Ukraine’s energy saving potential amounted to 40 - 45% of energy consumption, but during the crisis it has grown even more. In order to gain the actual power savings, it is imperative to retain high economic efficiency. Cost per tonne of equivalent fuel gained by energy conservation is several times less than the costs of its recovery/production or purchase. Therefore, in Ukraine, the energy efficiency and energy conservation becomes a strategic line of economic and social development in the short and in the long run as well. That is exactly the way that has been taken by the industrialized countries, and the most of success in the increasing of the efficiency has been achieved by the ‘power-hungry’ countries such as Japan, Italy, etc.

The major strategic line for the increase of energy efficiency, including EE lighting and employment of energy saving potential, is to create an administrative, legal and economic mechanism promoting energy efficiency and energy savings. Enabling environment for the introduction of energy efficient lighting technologies shall be created based upon the effective policies. A fundamental condition for the increase of energy efficiency is to develop relevant legal and regulatory framework that would make it impossible to operate in the country energy-inefficient lighting technologies noncompliant with applicable international standards.

The overall Project’s objective is to facilitate the market’s transition over to EE lighting technologies, by phasing-out energy inefficient lighting, introducing minimum energy performance standards and compliance programme and effective insuring quality control system for EE lighting products.

Duties and Responsibilities

Description of responsibilities / scope of work

The Consultant will deal with the following groups of tasks:

Phase-out and promotion programs:
  • Overview of introduction and impacts (monitoring or evaluation results) of phase-out programs of lighting equipment in various countries (e.g. the USA, EU, India, China, etc.) for the last 5 years, including the analysis of regulatory basis of the programs (legislation, standards in force, methodologies accepted) and the tendencies of their harmonization or transformation;
  • Analysis and development of a list of lighting equipment subject to phase-out in Ukraine;
  • Critical review of international practices on the implementation of demand stimulation programs;
  • Development of proposals on promotion of energy saving products for a national program of actions;
  • The proposals should include indicators and a system of direct and/or indirect subsidies for consumers;
  • Development of the draft phase-out program in Ukraine.
Compliance program:
  • Analysis of the situation in Ukraine (compliance with energy efficiency requirements) and development of the structure of the national compliance regime, including justified choices of voluntary or mandatory program, identification of the main stakeholders, their responsibilities and possible interactions with each other;
  • Development of proposals for the compliance program implementation, including key activities (creation of verification and information-educational centres, public and market sector education, etc.);
  • Development of proposals for creating a network of national verification centers (including municipal, regional and national level);
  • Overview of the risks of compliance program implementation in other countries. Development of risk mitigation proposals for the national compliance program implementation;
  • Development of proposals for a national priority list of minimum energy performance standards for lighting equipment and lighting systems;
  • Development of a log-frame for the compliance program results, including indicators of introduction and efficiency of the compliance program;
  • Development of the recommendations on procedures of evaluation and analysis of the compliance program results;
  • Development of an indicative budget for the energy-efficient lighting compliance program.
National test laboratories:
  • Evaluation of the role of testing laboratories (independent national verification centers) as a component of the national compliance program;
  • Overview of possible ways, description of mechanisms (brief guidelines or sets of actions) and development of proposals for national test laboratories (national verification centers) on obtaining international accreditation and on becoming a part of the international verification system;
  • Calculation of minimal costs of the laboratory facilities (equipment) and annual expenses on maintaining the status of an accredited laboratory;
  • Assistance in preparation of the National Modernization Plan for the upgrading of National Test Laboratories.
Other tasks:
  • Support to the project manager upon request on technical and program development issues throughout the implementation period of this project;
  • PowerPoint presentation of all the key outputs of the present ToR implementation;
  • Presentation of key findings of the work including the draft final report at suitable international workshop/seminar/event with key stakeholders in Kyiv).
Deliverables

The Consultant is expected to produce the following documents during the assignment:
  • Report 1 covering tasks from group 1 scheduled on 25 September 2014;
  • Report 2 covering tasks from groups 2 and 3 scheduled on 25 October;
  • Final report, including addressed comments to Reports 1 and 2 and covering tasks from group 4 scheduled on 25 November.
All reports shall be in concise and grammatically correct English and Russian/Ukrainian and presented in electronic form in MS Word format.

The International Consultant on ‘Efficient Lighting Promotion and Compliance Program’ is expected to work 60 working days within the following tentative timeframe:
  • Workplan and methodology 1st week of September 2014 (1st week after signing the contract);
  • First mission to Ukraine beginning of September 2014;
  • Report 1 25 September 2014;
  • Report 2 25 October 2014;
  • Second mission to Ukraine end of November 2014;
  • Final report 25 November 2013.
Responsibility for expenses and their reimbursement

Consultant will be responsible for all personal administrative and travel expenses associated with the assignment which includes all printing, stationary, telephone and electronic communications, and report copies included in this assignment.

The remuneration of work performed will be conducted as follows:
  • First payment: 20% of the total contract amount upon submission of a detailed workplan and methodology;
  • Second payment: 50% of the total contract amount upon submission and approval of Report 2;
  • Final payment: 30% of the total contract amount upon submission and approval of the Final Report.
Monitoring/reporting requirements

Transforming the Market for Efficient Lighting Project Manager will supervise the work of the Consultant via personal workshop meetings and email/or telephone communication.
The documents should be submitted in electronic or paper form in English, Russian or Ukrainian.

Required Skills and Experience

Education:
  • Master degree or MBA in engineering, environmental science, economics or administration.
Experience:
  • At least 10 years of professional experience in the field of product energy efficiency, of which at least 5 years of professional experience with standards and labels development for energy-efficient lighting, and at least 5 years of professional experience with the design and implementation of EE lighting promoting programs;
  • Work experience in Russian and/or Ukrainian speaking countries including former CIS countries on product energy efficiency related projects and on the transposition of EU energy efficiency standards and regulations to non-EU countries is a plus;
  • Experience in working with international organizations, including UNDP, is preferred but not required.
  • Experience in working with various governmental agencies related to quality assurance and energy efficiency;
  • Experience in testing, preferably of EE lighting products;
  • Excellent English writing and communication skills.
Language:
  • Russian and/or Ukrainian language skills would be a great asset.

Financial proposal - Lump sum contract

The financial proposal shall specify a total lump sum amount. Payments are output based i.e. upon satisfactory delivery of the agreed products and services as specified in the Terms of Reference for individual consultant.
The Consultant will be responsible for all personal administrative expenses associated with undertaking this assignment including office accommodation, printing, stationary, telephone and electronic communications, and report copies incurred in this assignment.

Evaluation criteria

UNDP will use a two-stage procedure for evaluating applications with an evaluation of the technical proposal being completed prior to any price proposals are compared. The technical part will be evaluated on the basis of its relevance to the Terms of Reference. The following criteria will be rated as indicated below:

Technical Criteria – 70% of total evaluation – max. 70 points:
  • Master degree or MBA in engineering, environmental science, economics or administration (10 points) (PhD or MBA – 10 points, master degree - 5 points);
  • At least 10 years of professional experience among which at least 5 years in either of the following areas: product energy efficiency, standards and labels development for energy-efficient lighting, preferably in the European Union, design and implementation of compliance programs (5 years – 5 points, 7 years – 7 points, 10 years – 10 points);
  • Experience in designing/implementation/participation of national and international Phasing-out programs (10 points);
  • Experience in working with various governmental agencies related to quality assurance and energy efficiency (10 points);
  • Experience in testing, preferably of EE lighting products (10 points);
  • Work experience in Russian and/or Ukrainian speaking countries including former CIS countries on product energy efficiency or related projects and on the transposition of EU energy efficiency standards and regulations to non-EU countries is a plus (10 points);
  • Experience in working with international organizations, including UNDP (5 points).
  • English and Russian or Ukrainian language skills (5 points – English and Russian/Ukrainian; 2 points - English).
Maximum available technical score - 70 points.

Evaluation method: Cumulative analysis

Contract award shall be made to the incumbent whose offer has been evaluated and determined as:
A) responsive/compliant/acceptable, and
B) having received the cumulative highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

Technical Criteria weight: 70%
Financial Criteria weight: 30%

Only candidates obtaining a minimum 70% from the maximum available technical score would be considered for the Financial Evaluation
The maximum number of points assigned to the financial proposal is allocated to the lowest price proposal and will equal to 30. All other price proposals will be evaluated and assigned points, as per below formula:
30 points [max points available for financial part] x [lowest of all evaluated offered prices among responsive offers] / [evaluated price].

The proposal obtaining the overall cumulatively highest score after adding the score of the technical proposal and the financial proposal will be considered as the most compliant offer and will be awarded a contract.

Payments will be made only upon confirmation of UNDP on delivering on the contract obligations in a satisfactory manner.
Individual Consultants are responsible for ensuring they have vaccinations/inoculations when travelling to certain countries, as designated by the UN Medical Director. Consultants are also required to comply with the UN security directives set forth under dss.un.org
