Background

The UNDP Legal Support Office, Bureau of Management is seeking a consultant to provide support in the administrative law practice area.

Duties and Responsibilities

The consultant is required to, inter alia, assist the Senior Legal Adviser of the Administrative Law Practice Group with the research, analysis, drafting and coordination associated with pending matters.  In particular, and in connection with these matters, the consultant’s duties will include:

  • Advising, in coordination with UN/OLA and UNDP OHR as appropriate, UNDP senior management, headquarters units and country offices and other funds and agencies, on the application of the Staff Regulations, Rules and procedures governing the internal justice system and other relevant aspects of human resources management, including disciplinary matters, privileges and immunities, rights and obligations of staff, legal status of staff and their dependents, financial recovery, taxation and insurance issues;
  • Drafting briefs for submission on behalf of UNDP and other funds and agencies, representing the administration before the UN Dispute Tribunal, and support UN/OLA in its representation of UNDP before the UN Administrative Tribunal;
  • Providing advice to senior officials regarding requests for administrative review and certify that administrative issuances are in accordance with Staff Regulations and Rules;
  • Drafting, or assist in the drafting of, policies and rules of procedure related to administrative law issues;
  • Preparing legal opinions and perform extensive legal research and analysis on complex or novel legal issues for the Director and/or the Senior Legal Adviser;
  • Performing other related functions as requested by the Director and the Senior Legal Adviser.

  • Financial proposal in lump sum format, based on outcomes, which should include all related expenses including related benefits and insurance.

Consultants will be evaluated based on the following methodology:

Cumulative analysis:
When using this weighted scoring method, the award of the contract should be made to the consultant whose offer has been evaluated and determined as:

  • Responsive/compliant/acceptable, and;
  • Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation;
  • Technical Criteria weight: 70%;
  • Financial Criteria weight: 30%.

Required Skills and Experience

Education:

  • An advanced degree in law, Masters' level with specialization in international and/or administrative law.

Experience:

  • Membership of a National Bar;
  • A minimum of 7 years' practical experience in the practice of private law with a law firm, a government and/or an international organization's legal office;
  • Extensive experience with the United Nations legal framework, working with personnel/administrative law issues of United Nations organizations;
  • Practical experience in litigation an asset.

Language Requirements:

  • Excellent command of oral and written English;
  • A working knowledge of another United Nations official language would be an advantage
