Background

The UNDP Being LGBTI in Asia (BLIA) programme aims to reduce marginalization and exclusion of LGBTI people. Initiated in 2012, the programme addresses inequality, violence and discrimination on the basis of sexual orientation, gender identity or intersex status, and promotes universal access to health and social services. It provides a platform for multiple stakeholders – governments, national human rights institutions, civil society, private sector, media, faith and community leaders, and educators – to engage in dialogue around LGBTI issues.

Studies have reported that many transgender people in Thailand face stigma, discrimination, social exclusion, and stereotyping. This is apparent especially in areas where there is a high visibility of transgender people involved with sex work. Furthermore, although transgender inclusive standards of procedure is available in some prisons, arrested transgender people who are transferred to correction facilities possibly encounter certain challenges when living among other cis-gender inmates in closed settings.

To address these issues, the Department of Rights and Liberties Protection (DRLP) of the Ministry of Justice (MOJ), and UNDP through their partnership under the MOJ established a Steering Committee on Protecting the Rights of LGBTI Individuals in the Justice Process, and are jointly conducting activities that will improve the Thai government’s engagement with transgender people in law enforcement and closed settings.

Duties and Responsibilities

Objective of Assignment and Scope of Work

  1. To conduct a desk review of existing protocols or other relevant reports for the management of transgender people in closed settings;
  2. To develop an assessment (SWOT analysis) by field visits to observe and interview key informants of the current management of transgender inmates in selected correctional facilities within the MOJ;
  3. To produce a report in both Thai and English;
  4. To provide a set of recommendations on how to improve the management and system, and develop a guideline based on these recommendations.

Expected Outputs and Deliverables

The Consultant is expected to produce the following deliverables:

  1. Submit a work plan including the guided questions for interview and data collection forms for conducting the situation assessment by 9 June 2017.
  2. Produce a report on the situation assessment of the management of transgender inmates in the Thai Justice System, in Thai and English language.
    1. Provide first draft of the situation assessment report in Thai and English by 23 June 2017
    2. Provide final version of the situation assessment report in Thai and English by 21 July 2017
  3. Provide a set of recommendations that can be used as a guide to develop an institutional guideline to improve the management of transgender inmates in Thai prisons by 26 July 2017

Institutional Arrangements

Under the overall guidance of Policy Advisor on HIV, Health and Development Practice, the national consultant will report directly to and work closely with the UNDP Thailand National Project Officer on Governance, Human Rights and LGBTI. The time required to review and approve outputs prior to prior to authorizing payments is 7 – 10 days.

Duration of Assignment:

 The duration of the assignment is 29 May – 31 July 2017 for a maximum of 20 days.

 Duty Station:

 Bangkok, Thailand (Domestic travel may be required). Consultant may be required to travel to other provinces outside of Bangkok. Travels will be authorized by Project Manager when required. Travel expenses (local transport) shall be agreed prior to travel and reimbursed after trips completed.

 

Competencies

Functional Competencies:

  • Substantive experience in assessing regulations and policies of government agencies from a human rights perspective;
  • Extensive experience in data collection for an assessment;
  • In depth knowledge of SOGIE, particularly transgender issues, and human rights;
  • Previous experience working with the UN, development partners, government agencies, and/or civil society organizations is an advantage.

Required Skills and Experience

Qualifications:

I. Academic Qualifications:

Thai National Only with a Master’s Degree in Human Rights, Sociology, Psychology, Social Sciences or other relevant fields.

II. Years of experience:

At least 3 – 5 years of relevant experience and qualitative research studies

III. Language:

High proficiency in oral and written Thai and English, and has extensive experience in writing UN reports in both languages.

Price Proposal and Schedule of Payment :

Consultant must send a financial proposal based on the lump sum amount.

Deliverables/Outputs

Payment

First payment of 30% shall be made upon successful receipt of a work plan, guided questions for interview, and data collection forms for conducting the assessment.

Payment of 30%

Second payment at 30% shall be made upon satisfactory receipt of a first draft of assessment report.

Payment of 30%

Third (final) payment of 40% shall be made upon satisfactory receipt of the final assessment report.

Payment of 40%

Criteria for Selection of the Best Offer

Cumulative analysis

The award of the contract shall be made to the individual consultant whose offer has been evaluated and determined as a) responsive/compliant/acceptable; and b) having received the highest score out of set of weighted technical criteria (70%). and financial criteria (30%). Financial score shall be computed as a ratio of the proposal being evaluated and the lowest priced proposal received by UNDP for the assignment.

Technical Criteria for Evaluation (Maximum 70 points)

  • Criteria 1 Relevance of Education – Max 15 points
  • Criteria 2 Special skills, Language, etc.- Max 10 Points
  • Criteria 3 Relevance of experience in area of specialization (e.g. human rights) – Max 15 points
  • Criteria 4 Relevance of experience in key areas (e.g. leading assessment team) – Max 15 points
  • Criteria 5 Assessment of approach/methodology to assignment – Max 15 Points

Only candidates obtaining a minimum of 70% of the total technical points would be considered for the Financial Evaluation.

Interested individual consultants must submit the following documents/information to demonstrate their qualifications. Please group them into one (1) single PDF document as the application only allows to upload maximum one document:

  1. Letter of Confirmation of Interest and Availability using the template provided in Annex III;
  2. Personal CV or P.11, indicating all past experience from similar projects, as well as the contact details email and telephone number of the Candidate, and at least three (3) professional references;
  3. Financial Proposal that indicates the all-inclusive fixed total contract price supported by a breakdown of costs, as per template provided. If an Offeror is employed by an organization/company/institution, and he/she expects his/her employer to charge a management fee in the process of releasing him/her to UNDP under Reimbursable Loan Agreement (RLA), the Offeror must indicate at this point, and ensure that all such costs are duly incorporated in the financial proposal submitted to UNDP.

Incomplete proposals may not be considered.
