Background

The project will support the government of Albania through the Ministry of Environment to undertake an initial mercury assessment to identify the national mercury challenges and the extent to which legal, policy and regulatory framework will enable Albania to implement future obligations under the Minamata Convention.

Project Description

Albania became a signatory to the Minamata Convention on 9 October 2014 and it has been also actively participating in the Intergovernmental Negotiating Committee on Mercury.

During the past 10 years, the Ministry of Environment (MoE) has been engaged in policy dialogues involving potential donors in prioritizing interventions to address the problematics of inherited industrial pollution. Currently, the Government of Albania is in the process of transposing European Union legislation related to the management of chemicals, (such as REACH, CLP, POP Regulation, Import-export regulation) into its national legislative framework.

The project’s objective is to undertake a Mercury Initial Assessment to enable the Government of Albania to determine the national requirements and needs for ratification of the Minamata Convention and establish a sound foundation to undertake future work towards the implementation of the Convention. It will do so by implementing four components as specified in the GEF guidelines (GEF/C.45/Inf.05 paragraph 19), as well as a fifth component on mainstreaming.

The experts will work under the guidance of the International Expert and collaborate with the local experts on data collection and institutional assessment, and will be responsible for legislation and by-laws preparation.

Scope of the consultancy:

Law No. 27/2016 of 17.03.2016 “On chemicals management”, has created the legal bases for preparation of the mercury legislations and other chemical related legislation. Preparation of the secondary legislation under the law 27/2016 till April 2018, (the deadline when the law enters force) will ensure the implementation of this law.

In this regard the main duties are as follows:

  1. Develop the DCM “Rules on the banning of exports of metallic mercury and certain mercury compounds and mixtures and the safe storage of metallic mercury and specific criteria for the storage of metallic mercury considered as waste” transposing Regulation (EC) No 1102/2008 of the European Parliament and of the Council of 22 October 2008 on the banning of exports of metallic mercury and certain mercury compounds and mixtures and the safe storage of metallic mercury;
  2.  Develop the DCM “On detailed rules and methods of chemical safety assessment and the specific requirements, content and format of safety data sheets, transposing Annexes I, II, VII, IX, X, XI of REACH Regulation 1907/2006;
  • The above legal acts should be accompanied by the table of Concordance as well as the Technical Relation.
  • Under the guidance of the International Expert, contribute to the preparation of a National Mercury Profile and Mercury Initial Assessment Report (with special focus on Chapter 3: Policy, Regulation and Institutional Framework Assessment).
  • Other duties as required by the Project Management team in line with the objective of this assignment.

The documents related to the DCMs will be developed in Albanian language.

Deliverables are as follows:

The following deliverables are requested:

30%-   Development of the draft-  DCM “Rules on the banning of exports of metallic mercury and certain mercury compounds and mixtures and the safe storage of metallic mercury and specific criteria for the storage of metallic mercury considered as waste”.

40%-     Development of the draft-  DCM “On detailed rules and methods of chemical safety assessment and the specific requirements, content and format of safety data sheets”.

30%-      Development of the final draft DCMs, table of concordance and technical relation for each.

Required Skills and Experience

Required skills and experience include the following:

Education:

  • Advanced university degree in natural sciences, environmental sciences, environmental law, or related fields.

Experience:

  • 5 years of work experience with expertise in legislation
  • Proven expertise in development/assessment of national policies
  • Familiarity with the International Conventions and EU Regulations addressing chemical and waste management

Languages:

  • English, both written and oral.

 

Evaluation Procedure

UNDP applies a fair and transparent selection process that would consider both the technical qualification of Individual Consultants as well as their financial proposals. The contract will be awarded to the candidate whose offer:

  • Is deemed technically responsive / compliant / acceptable (only technically responsive applications / candidates will be considered for the financial evaluation)
  • And has obtained the highest combined technical and financial scores.

Technical Criteria - 70% of total evaluation – max points: 70

Criteria A:  Advanced university degree in natural sciences, environmental sciences, environmental law, legal studies or related fields. – max points: 30

Criteria B: 5 years of work experience with expertise in legislation/ proven expertise in development/assessment of national policies – max points: 20

Criteria C: Brief methodology on how the consultant intends to carry out this assignment – max points: 20

Financial Criteria - 30% of total evaluation – max points: 30
