Background

BACKGROUND

Following many changes in context in Sri Lanka since 2015, and the universal commitment made in September 2015 to ensure the achievement of sustainable development by 2030, UNDP embarked on a process of re-defining the alignment and strengthening the design of its access to justice/ rule of law, human rights, Parliamentary support and peacebuilding portfolio.

UNDP from 2017 will support Sri Lanka with innovative programmatic and operational design and implementation of priority actions identified in key policy frameworks and plans. To this end, UNDP will work in collaboration with several stakeholders, including government, semi-government, civil society, private sector, UN agency and development partners and through increased engagement with the people of Sri Lanka, on the above mentioned inter-linked and complementary thematic areas of focus, to provide integrated and high quality technical advisory and support services.

The present National Police Commission was established under the 19th amendment to the Constitution of Sri Lanka. The underlying purpose of establishing the NPC was to ensure independence; freeing the Police Service from interference or undue influence; and to instill respect for the Rule of Law among all ranks of the Police Service and to perform their duties impartially and fearlessly. The key functions of the NPC are human resources management of the police service  and investigating into public complaints against police.

Building on the work undertaken in 2016 and early 2017, UNDP Sri Lanka seeks to provide support to the National Police Commission (NPC) to strengthen its efficiency and effectiveness as an independent oversight body relating to policing.

 

SCOPE AND OBJECTIVES

The objective of this assignment is to review, analyze and make recommendations to improve and streamline work flow process of the NPC with the aim of strengthening the development of automated case management system.

The UNDP Sri Lanka is looking for a FULL-TIME consultant to carry out the above assignment in consultation with the NPC.

 

Duties and Responsibilities

RESPONSIBILITIES

The consultant shall be expected to;

  • review existing laws, rules, regulations and other documentation applicable for  case management and functions of the NPC;
  • review current work flow of the different divisions/provincial offices of the NPC;
  • interview respective divisional heads and relevant staff including the senior management of the NPC;   
  • liaise with officers involved in the development of automated case management system   as required;
  • analysis of available literature of the NPC in connection to the work flow process;
  • comparative analysis with complaint mechanism system of relevant international jurisdictions.

 

The following deliverables and outputs are expected from the Consultant;

1. Presentation to   the NPC on an analysis of the existing work flow process of the NPC (including its provincial offices) along with identification of gaps, unnecessary entry points and bottlenecks which hinder the process.

2. Presentation to the NPC on

- recommendations to address the gaps and clear bottle necks;

- recommend most effective process to expedite the work flow;

- proposition of an effective monitoring & evaluation system.

3. Present a draft report which contains above 1- 2 to the NPC for their review and feedback;

4. Present the finalized report to the NPC incorporating suggestions made by the NPC.

Competencies

CONSULTANT PROFILE

  • The consultant will be identified based on relevant experience in a similar prior capacity of work, analytical skills and familiarity with the working scope and legal mandate of independent commissions. Prior working experience with the NPC, Sri Lanka Police or education and knowledge in the fields of public administration, legal, management would be an added advantage;
  • 7-10 years of experience in the fields of law, police investigations or management;
  • Previous experience in working with the UN is preferred;
  • Fluency in English and sufficient knowledge in Sinhala and Tamil both oral and written, is a necessary requirement.

 

COMPETENCIES

Technical work

  • Knowledge on functions & operational mechanism of independent commissions on Policing in Sri Lanka or another country;
  • Excellent knowledge in the area of investigations/inquiries and legal case handling;
  • Knowledge in handling police investigations would be preferred.

Partnerships

  • Maturity and confidence in dealing with senior members of national institutions;
  • Displays cultural, gender, religion, race, nationality and age sensitivity and adaptability;
  • Excellent coordination skills and result oriented collaboration with colleagues.

Results

  • Promotes the vision, mission, and strategic goals of UNDP and NPC;
  • Builds strong relationships with clients, focuses on impact and result for the client and responds positively to feedback;
  • Good team player who has ability to maintain good relationships.

 

Required Skills and Experience

QUALIFICATION

Education

Master’s degree in Law, Public Administration, Management or related field. A combination of relevant academic qualifications or an Attorney-at-law with extensive experience in criminal law practice or police investigations may be accepted in lieu of the Master’s degree.

Note: Payments will be based on invoices on achievement of agreed milestones i.e. upon delivery of the services specified in the TOR and certification of acceptance by the UNDP. The applicant must factor in all possible costs in his/her “All Inclusive Lump Sum Fee” including his/her consultancy and professional fee, travel (economy class flights is required to and from the Duty Station) honorarium, board and lodging, and any other foreseeable costs in this exercise. No costs other than what has been indicated in the financial proposal will be paid or reimbursed to the consultant. UNDP will only pay for any unplanned travel outside of this TOR and Duty Station on actual basis and on submission of original bills/invoices and on prior agreement with UNDP officials. Daily perdiums and costs for accommodation/meals/incidental expenses for such travel shall not exceed established local UNDP DSA rates.

For an Individual Contractor who is 62 years of age or older, and on an assignment requiring travel, be it for the purpose of arriving at the duty station or as an integral duty required travel under the TOR, a full medical examination and statement of fitness to work must be provided.  Such medical examination costs must be factored in to the financial proposal above. Medical examination is not a requirement for individuals on RLA contracts. 

 

PAYMENT FOR SERVICES

The Consultant –shall receive payment in three installments from UNDP as follows, upon NPCs acceptance of the deliverables and UNDP certification of deliverables:  

  • 10% - On Completion of Deliverable No. 1
  • 35% - On Completion of Deliverable No. 2
  • 55% - On Completion of Deliverable No. 4
