Background

The Crisis Response and Resilience Programme (ICRRP) of the United Nations Development Programme (UNDP) aims to build the resilience of the communities that are most affected by displacement of refugees and internally displaced Iraqis. 

Component one of the ICRRP is focused on supporting the Government of Iraq (GoI) and the Kurdistan Regional Government (KRG) in enhancing their institutional and technical capacities in crisis response coordination and progressively build national systems and frameworks for effective disaster and crisis management. UNDP’s support to the GoI and KRG constitutes an investment in the important national and regional agendas to solidify the regulatory, institutional and administrative arrangements for holistic and effective disaster risk reduction, effective societal preparedness, timely and efficient response to emergencies and rapid recovery in the aftermath of a disaster/crisis. UNDP’s support to the KRG is channeled primarily through the Ministry of Interior’s Joint Crisis Coordination Centre (JCC) and its offices in the three governorates of Erbil, Dohuk and Slemani (Suleymanieh).

The JCC was established in September 2014 and officially launched in May 2015. It is established through order #5719, – September 2014 and the mandate (No 1, of 2015) of the KRG Council of Ministers. The head office is a directorate general within the Ministry of Interior and headed by a Director General under the direct supervision of the Minister of Interior. The governorate offices are directorates within the offices of their respective Governors. These offices have an administrative line of reporting to the governors and a dotted technical reporting line to the JCC head office. The network of JCC offices are formally mandated to coordinate all matters related to crisis management and response in the Kurdistan Region. The head office focuses on strategic matters while the governorate offices are mandated to coordinate and support operational management and response to crises.

 

In May 2017, the KRG Council of Ministers endorsed the JCC’s strategic plan for 2017-2020 to lead the KRG in building a full-scale disaster and crisis management system. As a first and principal step towards system building, the strategic plan calls for a comprehensive study in order to develop a system blueprint based on international experiences, guidelines and best practice but tailored to the contextual reality and conditions of the KRI. The JCC and UNDP have therefore agreed to compose a team of national and international experts to carry out the study and develop a blueprint. An important member of this team is an international specialist in disaster and crisis management law and policy formulation.

Duties and Responsibilities

Scope of the Full Study

The study will include four components that are described below. Additional details are available in the Study Concept Note annexed to these ToR.

Component I:     Conduct an international and national disaster/ crisis management law and policy review;

Component II:   Conduct a disaster and crisis management system analysis, including a KRI geopolitical, administrative, cultural and socio-economical context analysis;

Component III:  Draft a disaster and crisis management law for the KRI

Component IV:  Design an institutional blueprint for disaster and crisis management in the KRI for all levels;   

The study will be carried out by a team of 3 experts and an assistant under the overall supervision of the Director General of the Joint Crisis Coordination Center (JCC), and in close consultation with the UNDP Crisis Response Specialist. The study team will include; i) an international Disaster and Crisis Management System Expert with multi-country experience who will also be the Team Leader; ii) an international Law and Policy Specialist with experience in crisis and disaster risk management legislation/policy making; iii) a national Law and Governance Specialist with an in-depth knowledge of the KRG legal system and experience in law and policy review; and iv) a Study Assistant to support and facilitate the work of the study team.

C.           Scope of Work of the Disaster and Crisis Management Law and Policy Specialist

The Specialist will be responsible for undertaking of the first and third components - crisis management law and policy review and preparing a carefully considered and appropriate law for disaster and crisis management in the KRI. The findings of the law and policy review will feed into the design of a blueprint for a disaster and crisis management system in the KRI. The law and policy review and recommendations must draw from international guidelines and best practice but also tailored to the particular context of the KRI. The Specialist will report to the UNDP Crisis Response Specialist and the JCC Director General (who will also be the team leader for the study). More specifically, the specialist shall assume the following duties:

 

  • Conduct a desk study of legal and policy frameworks for disaster and crisis management and/or civil protection systems from other countries, describing best practices with possible considerations for the KRI context;
  • With the assistance of the National Law and Governance Specialist, review exiting KRI laws and policies related to disaster and crisis management;
  • Work closely with the international Disaster and Crisis Management System Expert, the national Law and Governance Specialist, and the DG JCC to reach a common understanding about the approach to develop the legal and policy framework for the KRI in line with international best practices;
  • With the assistance of the national Law and Governance Specialist, organize and facilitate seminars and round-table discussions to present the core concepts and best practices for a legal and policy framework for disaster and crisis management and possible options for the KRI;
  • Review the studies conducted by other team members about the best practices of disaster and crisis institutional systems and citizen participation through volunteerism (and any other relevant studies), and take into account the recommendations from these studies in drafting the legal and policy framework for the KRI;
  • Prepare a draft of the KR-I Disaster and Crisis Management Law for establishing a Crisis and Disaster Management System in the KRI;
  • Through the consultative workshops and meetings, capture the perspectives, understandings and recommendations of key KRI experts, stakeholders, departmental, governorate and local level officials about the Draft Law and help the stakeholders to arrive at a common understanding about the contents of the KR-I Disaster and Crisis Management Law;
  • Revise the draft of the KR-I Disaster and Crisis Management Law and present it to senior policy makers for their feedback and approval;
  • Based upon feedback from senior policy makers finalize the draft of the Law and submit to the JCC;

WORKING ARRANGEMENTS  

Institutional Arrangements:

 

  1. The consultant is expected to work as a member of the study team and report to the study team leader and the UNDP Crisis Response Specialist,
  2. The consultant is expected to adjust and harmonize his working hours, location and priorities with the work of the study team;
  3. The consultant will fall under the UNDSS security regulation.

Required Skills and Experience

Academic Qualifications:

An advanced university degree in a relevant field of study such as law, civil protection, disaster management, crisis management, public law and policy, public administration and other similar fields of study. Additional trainings relevant to the assignment are an asset.

Years of experience:

Minimum ten (10) years of professional experience in a relevant field with an emphasis on national law and policy frameworks for disaster management, crisis management and/or civil protection;

  • Past experience in analyzing and formulating national laws or policy frameworks for disaster and crisis management; 
  • Experience in national disaster management in conflict-prone and volatile environments;
  • Previous work experience from the Kurdistan Region of Iraq or the Middle East is an asset;
  • Past experience in conducting studies focused on disaster and crisis management or civil protection law and policy frameworks;
  • Past experience in planning and facilitating seminars, conferences and other similar consultation and discussion events

PRICE PROPOSAL AND SCHEDULE OF PAYMENTS (Standard text  - do not change)

Scope of Bid Price and Schedule of Payments

Interested professionals are invited to submit their bid consisting of a financial and technical proposal for completion of this assignment.  The technical proposal shall include:

  1. CV of the applicant;
  2. A description of approach and methodology for completion of the assignment;
  3. An indicative work plan placing the planned activities along a time-line;
  4. Any other information that the applicant finds relevant.

The financial proposal shall indicate the total amount required for covering all aspects of the assignment broken down into the following categories:

  • Professional fees presented as daily or monthly units.
  • Price of two-way ticket to and from the place of residence of the consultant to Erbil
  • Expected Daily subsistence allowance (DSA);

Note:

  • In case of any travel outside Erbil to other governorates, the actual costs will be reimbursed as per the UNDP policy

The full contracted amount will be disbursed as per the below payment plan unless otherwise agreed between UNDP and the consultant.

Criteria for Selection of the Best Offer

The following criteria shall serve as basis for evaluating offers:

  • Combined Scoring Method – where the qualifications and methodology will be weighted a maximum of 70%, and combined with the price offer which will be weighted with a maximum of 30%.
  • Only candidates obtaining a minimum of 70% points in the technical evaluation will be considered for financial evaluation.

Note:  In addition to the desk review of the CV and technical proposal, an interview might be held with the shortlisted candidates.
