Background

UNDP focuses on addressing the social, economic and environmental determinants of health, which are primarily responsible for health inequalities.

UNDP is a founding cosponsor of the Joint UN Programme on HIV/AIDS (UNAIDS), a partner of the Global Fund to Fight AIDS, Tuberculosis and Malaria, and a co-sponsor of several other international health partnerships. UNDP’s work on HIV, Health and Development leverages the organization’s core strengths and mandates in human development, governance and capacity development to complement the efforts of specialist health-focused UN agencies.

UNDP delivers three types of support to countries in HIV, health and development. i) UNDP helps countries to mainstream attention to HIV and health into action on gender, poverty and the broader effort to achieve and sustain the SDGs; ii) UNDP works with partners to address the interactions between governance, human rights and health responses. Third, as a trusted, long-term partner with extensive operational experience; iii) UNDP supports countries in effective implementation of complex, multilateral and multi-sectoral health projects, while simultaneously investing in capacity development so that national and local partners can assume these responsibilities over time.

Since 2016 UNDP, AMSHeR and HEARD are jointly implementing a regional project on strengthening legal and policy environments to reduce HIV risk and improve sexual and reproductive health of young key Populations in five Southern African countries with financial support from the Netherlands Ministry of Foreign Affairs. The four-year project 2016-2020 covers Angola, Madagascar, Mozambique, Zambia and Zimbabwe. The project also includes regional level activities that will be implemented with the SADC Secretariat.

In Mozambique, a Steering Committee was created to enhance implementation of Linking Policy and Programming: Strengthening Legal and Policy Environments for reducing HIV Risk and Improving Sexual and Reproductive Health (SRH) for Young Key Populations in Southern Africa LPP Project which comprises the stakeholders of the following institutions: Ministry of Justice, Constitutional and Religious Affairs (MJCR), Ministry of Health (MISAU), National AIDS Council (CNCS), the Private sector ECOSIDA, Academia, the civil society organizations represented by CSO Platform PLASOC-M, LAMBDA, UNGAGODOLI, UNIDOS, REJUSIDA and MULEIDE.

Duties and Responsibilities

The experts will develop the work implementing two-fold interrelated exercises:

Exercise ONE: Legal Environment Assessment

identify and examine all important legal and human rights issues affecting particularly people living with HIV and those at higher risk of HIV exposure such as key and affected populations –women, young people, gay men and men who have sex with men, sex workers, prisoners and people who inject drugs.

It will also focus to determine the extent to which the current legal framework protects rights and/or acts as a barrier to access to HIV-related services.

Exercise TWO: Engagement Scan -

a process that creates a calendar covering the next two years showing when key political events will occur, such as elections, when relevant policy and strategy is due for review, details of when parliamentarians, relevant ministries and the judiciary meet to address relevant issues. This would enable each country to map out when there are opportunities for advocacy.

Produce a tool which tracks important dates and deadlines for key opportunities for advocacy over the next two years;

Identify the key institutions that are relevant to law and policy reform;
Provide a summary of the processes through which law and policy reform occurs;
Identify the key events/processes that are relevant and map the dates for those events/processes; and
Outline the ways in which civil society organisations can engage in these events and processes.

This exercise should produce two key documents:

LEA Report

It includes a useful focus on HIV and health law, criminal law, employment law and social protection and focuses on people living with HIV, women, children, young people, gay men and men who have sex with men, transgender people, sex workers, prisoners, migrant workers and people who inject drugs.

The findings of the national Legal Environment Assessment are expected to form the basis for recommendations and action planning on the review, implementation and enforcement of strengthened HIV-related laws, regulations and policies, and measures to improve access to justice and law enforcement for HIV-related rights.

For the DOCUMENT ONE LEA’s Process

PHASE ONE: An Inception Report and Workplan for the LEA clearly setting out the following:

The process to be followed in the Assessment
Activities to be undertaken in the Assessment
An inventory of laws, regulations, policies and other documents to be reviewed
A list of key stakeholders/focus groups to be consulted
PHASE TWO: Field work
Interview and focus group discussion tools/questionnaires
Measures to be taken to protect the confidentiality of informants and focus group members, where necessary
A report of the consultative Planning Stage as required
PHASE THREE- Draft National Report
A draft National Legal Review Report that assesses the current legal and policy environment to respond to HIV and AIDS with a specific focus on issues and/or populations of priority concerns such as:
Women, HIV and the law
Children, Young people, HIV and the law
Criminal laws and HIV
Access to Treatment
Identifies strengths, weaknesses and gaps in the current legal and policy environment, including the extent to which the current environment complies with human rights obligations, addresses key issues and promotes universal access to HIV prevention, treatment, care and support.
Makes recommendations for strengthening the legal and policy environment in the country so as to ensure a response which complies with international, regional and national human rights obligations, addresses key human rights issues in the context of HIV and AIDS, including the rights of most-at-risk populations, promotes universal access, and balances public health and human rights imperatives

Required Skills and Experience

The Senior consultant leads all the research and provides guidance to the Junior consultant. The required qualifications for the Senior Consultant are:

EDUCATION

Advanced degree in Law, Juridical Science.

Experience:

Minimum of 10 years of “relevant” work experience on human rights, health and the law
Experience of conducting assessments review assessment of the legal environment
Knowledge and Previous experience working with Children, Women and Key Populations
Ability to research, to do a critical review of the Laws and write at a high level
Practical experience on writing reports on legal assessments in particular on HIV and AIDS area;

Practical experience in consultations

Extensive experience with Government and CSO’s;

Proven facilitation skills (workshops, data collection);

LANGUAGE

Good Knowledge of Portuguese and English;

EDUCATION

The Junior consultant works under the total responsibility of the Senior consultant. The required qualifications for the Junior Consultant are:
Degree in Sociology, Anthropology, Social Sciences, Development studies, Political Sciences, Public Health, Medicine, or related fields.

Experience:

Minimum of 7 years of “relevant” work experience in such type of exercise
Practical experience of developing action plans;
Practical experience in consultations and in the implementation of engagement with CSO’s;
Extensive experience on civil society issues;
Proven facilitation skills (workshops, data collection, etc.

LANGUAGE

Good Knowledge of Portuguese and English.
