Background

Development losses caused by disasters as well as population and GDP exposure to hazards are continuously being increased in Bosnia and Herzegovina (BiH). The country is exposed to various hazards, with most common ones being earthquakes, floods, droughts, heatwaves, wildfires, landslides and man-made hazards with climate change forecasts predicting an acceleration of extreme weather phenomena. Numerous challenges the country faced after the war, combined with political deadlocks and weak economic situation, resulted in non-prioritization of disaster risks. This lead not only to weak general capacities of civil protection but also to unabsorbing of improvements and new approaches in dealing with disaster risks. Today, disasters in the country range from high-frequency small disasters to devastating events such as May 2014 floods that caused total of 2 billion EUR losses and damages.

Disaster risk reduction (DRR) sector in the country requires a strategic roadmap and actions strengthened with new tools and approaches moving away from business as usual. To address these challenges Interlinking Disaster Risk Management in BiH Project was launched. Project will strengthen DRR capacities at all government levels in BiH by putting in place legal and policy frameworks and implementation of disaster and climate risk management measures. Project is supported by Italian Agency for Development Cooperation and implemented by UNDP.
Under the direct supervision of the Project Manager, the Civil Protection Legislation Expert is to contribute to revision of relevant civil protection legislation of Republika Srpska. Expected result of the assignment is improved quality of legislative environment of DRR in RS, fully in line with relevant EU accession requirements. Concretely, it will address recognized and identified deficiencies of the civil protection system such as engagement and financing of volunteers, financing, functioning of inspections and sanctions, etc.
The Assignment will be delivered through coordinated and participative approach which will include close cooperation with governmental institutions that are members of the project working group, and other relevant partners as well as an international civil protection legislation expert.
 

Duties and Responsibilities

Scope of work
Technical support to drafting of new Law on Protection and Rescue in Emergency Situations in Republika Srpska, as follows:

  • Deliver a workplan for the assignment that will include detailed list of relevant domestic and international documents that will be reviewed (regulations, law, policies, studies) including best practices and international standards related to civil protection legislation, list of interviews/meetings to be conducted with relevant domestic and international stakeholders. Final workplan will be approved by UNDP.
  • Provide analysis of the existing legal framework regulating civil protection in Republika Srpska and analysis of the concept of institutional organization of the Directorate for Civil Protection of Republika Srpska 
  • Provide comparative analysis of harmonization of the legal framework in Republika Srpska with countries in the region and EU
  • Provide legal and technical support and expertise to the working group drafting the new Law on Protection and Rescue in Emergency Situations thorough development of legal concepts and the thesis, active participation in relevant meetings,  formulation of legal expert opinions and explanations for the application of laws and other regulations in accordance with standards related to civil protection in Republika Srpska, development of new legal solutions related to the development, establishment and operation of the civil protection in  Republika Srpska.
  • Deliver the final report with observations, conclusions and recommendations related to drafting of the new Law on Protection and Rescue in Emergency Situations in Republika Srpska. Final report will be approved by UNDP.

Required Skills and Experience

Academic Qualifications/Education

  • University degree (BA) in disaster risk management, law, environment or development or other related fields.

Experience

  • At least 7 years of relevant working experience in the area of law;
  • Understanding of disaster risk reduction and civil protection;
  • Proven knowledge and previous experience in preparation of legislation analysis and reports.

Languages Requirements

  • Fluency in written and spoken B/C/S language is required for this assignment.

Other desirable skills

  • Proficiency in computer applications such as MS Office.

Individual consultants will be evaluated based on the following methodology:

Cumulative analysis

When using this weighted scoring method, the award of the contract should be made to the individual consultant whose offer has been evaluated and determined as:
a) responsive/compliant/acceptable, and
b) Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.
