Background

The Revolutionary Government of Zanzibar recognises access to justice as a critical component of its governance and development programme. This is evident in the Zanzibar Strategy for Growth and Reduction of Poverty, also known as MKUZA III (2016 - 2020) where it informs that “access to justice by all citizens represents an important way of ensuring that both men and women can be assured of their human and other rights. Moreover, a functioning and fair legal sector are fundamental to democratic systems, an essential prerequisite for other elements of good governance to succeed, and a driver of foreign investment and pro-poor economic growth.”  This ties in with the Sustainable Development Goals 16 and aligns in with the Democratic Governance, Human Rights and Gender Equality outcome of the United Nations Development Assistant Plan (UNDAP) (2016 – 2021) which is broadly aimed at promoting effective, transparent, accountable and inclusive national governance. These critical documents, the legal and policy framework and the political will of the Revolutionary Government provides a favourable context for the cooperation and engagement on the development assistance and support in reinforcing access to justice and human rights.

Zanzibar is comprised of Unguja and Pemba and some small islets which home to an estimated 1.3 million people are. The population of Zanzibar is predominantly Muslims, with the religion playing a significant role in the daily lives and in defining how the people of Zanzibar seek and access justice. In Zanzibar, statistics on poverty depict a rather gloomy picture with 30.4% of the local population below the poverty line and 27% of the youthful population out of gainful employment. Key institutions in Zanzibar remains weak, and despite ongoing reforms and capacity building efforts, effective service delivery remains a crucial challenge. Civil society is under-empowered and unable to operate as required. For many Zanzibaris, access to justice remains unattainable and is impeded by limited legal awareness, unaffordable costs and undue delays in the delivery of justice services.

For years now, UNDP has been resolute in enhancing access to justice for the people of Zanzibar and from 2014 – 2017 implemented the Support to Zanzibar Legal Sector Reform Programme (LSRP). By way of this programme, UNDP has supported the modernisation and reform of laws; establishment of a case management system for the Judiciary, development of a policy and legal framework for the provision of legal aid in Zanzibar and the capacity building of the Office of the DPP for the provision of prosecutorial services. The LRSP has laid the foundations and created the ideal environment for sustaining meaningful engagements aimed at reinforcing capacity and enhancing service provision in the justice sector in Zanzibar. Critical issues that continue to limit access to justice in Zanzibar include 1) the absence of an oversight mechanism for the provision of legal aid; 2) limited capacity of the government and local actors to implement a sustainable model of legal aid services as well limitation in capacity, financial and logistical resources; 3) inadequate financial, logistic and technical capacity building support to the Kadhis Court  and the resultant challenges associated with interpretation of laws and weak compliance with court rules and procedures of the court. These issues continue to impact on how the ordinary Zanzibari is able to seek and access justice.

The development of the proposed project is therefore informed by the above-mentioned gaps and challenges, as well as a consensus of the government and legal sector actors on the need to sustain engagements for effective justice service delivery. The proposed project shall adopt the rights-based approach to justice service delivery which shall involve the broad-based participation of all stakeholders and a focus on legal empowerment for the vulnerable and marginalised and respect for human rights. Suggested interventions shall include among others enhancing coordination among justice and rule of law sector institutions; furthering the reform and modernization of laws; improving efficiency of case management and addressing backlogs in cases; promoting effectiveness of oversight and legal aid service delivery and initiating a community-based paralegal programme to enhance grassroots access to justice; reinforcing the human rights and documentation capacity of the Kadhis Court; initiatives that explicitly promote the rights dignity and legal protection needs of women and children; enhancing the human rights knowledge and skill of magistrate, judges and public prosecutors etc.

Duties and Responsibilities

  • Work closely with the Technical Specialist, supported by the Programme Specialist to develop a project document utilizing the UNDP project document format;
  • Conduct the review and synthesis of relevant documents including laws, policy, strategies and   reports relevant to the functioning of the legal sector in Zanzibar to inform the development of the project document;
  • Conduct consultations with relevant government stakeholders, civil society group and private sector entities and identified potential project partners and designate roles and responsibilities for implementing partners;
  • Conduct consultations with relevant stakeholders to analyse how vulnerable groups such as the elderly, children and women are integrated into project activities;
  • In collaboration with the legal sector in Zanzibar, gather and analyses data to be incorporatedinto baselines and indicators for the proposed project activities;
  • Ensure synergies and complementarity between project document and UNDP Tanzania UNDAP 2016 - 2021; UNDP Country Programme Document (2016 – 2021) and ongoing programme;
  • Ensure that a detailed budget is created in compliance with UNDP project financial requirements;
  • Develop a detailed work plan; Outlining the methodology and project timeline for the deliverables (This should include any research to be conducted for baselines and indicators, stakeholder consultations and focus group discussions);
  • Develop a Draft Project Document inclusive of power point to be presented to Local Project Appraisal Committee (LPAC);
  • Produce Final Project Document incorporating recommendations from LPAC and UNDP;

Required Skills and Experience

Academic Qualifications

  • A Master’s degree in Law, Political and Social Sciences or related subject area.

Experience

  • At least 10 years of professional experience in project design, project/programme management and/or advisory services related either Access to Justice, Rule of Law, Trust building, Social Cohesion, Governance, Community Development or Social Justice;
  • Ability to work rapidly with multiple teams in various locations and remotely in writing and where necessary revising the proposal;
  • A proven track record of work related to project design, monitoring and evaluation;
  • Excellent organizational skills; Strong analytical, research, data gathering, writing and communication skills;
  • Fluency in English and strong interpersonal and communication skills; commitment to teamwork and to working across disciplines;
  • Prior experience working with UNDP or another UN agency an asset;

Language requirements

  • Fluency in English.
