Background

The objective of the project “Catalyzing Environmental Finance for Low-carbon Urban Development” is to leverage investment for transformational shift towards low-carbon urban development in Bosnia and Herzegovina thereby promoting safer, cleaner, and healthier cities and reducing urban GHG emissions. To enable this transformational shift, the project will facilitate implementation of technically and economically feasible low-carbon solutions in key urban sectors and promote their wider uptake by municipalities and private sector via dedicated financial mechanism established within the national environmental finance framework. The project will also accelerate the implementation of a policy and regulatory framework supportive of low-carbon investment in cities.
To this end, the project will facilitate investment in technically and economically feasible low-carbon solutions in key urban sectors, and then promote their wider uptake by municipalities and the private sector via dedicated financial mechanism and funding windows established within the environmental finance frameworks in BiH, as well as by accelerating implementation of a favorable policy and regulatory framework at the entity and national levels. The project will facilitate the transformation of the market for low-carbon urban solutions by creating and expanding opportunities for businesses such as ESCOs and waste management companies to get involved in the provision of low-carbon services and products in cities.

The purpose of the position is to develop the amendment Law on waste management of Republika Srpska. The revision of existing Law on waste management in Republika Srpska is to be conducted while decision on amending specific parts of the Law (i.e. Basic provisions, Types and classification of waste, Waste management planning, Waste management planning, Waste management responsibilities and obligations, Organizations of waste management, Management of special waste streams, Waste management permits, Cross-border movement of waste, Supervision, Penal provisions, Transitional and final provisions) shall be made in consultation with representatives of the Ministry of spatial planning, civil engineering and ecology of Republika Srpska.
In addition, the consultant will develop an appropriate bylaw act to set the legal framework for the Waste information system, to be developed under another component of the Urban LED project. National consultant will communicate and agree details with representatives of the Ministry of Spatial Planning, Civil Engineering and Ecology of RS and Fund for Environmental Protection and Energy Efficiency of RS.

Duties and Responsibilities

National consultant for amending the Law on waste management of Republika Srpska will work under direct supervision of the Environmental Development Project Manager and under coordination of the representatives of Ministry for spatial planning, civil engineering and ecology of Republika Srpska (who will approve and confirm the quality of outputs) to complete all activities specified in this Terms of Reference.

Scope of work

National consultant for amending the Law on waste management of Republika Srpska will develop amendment Law on waste management in Republika Srpska through analysis of current Law on waste management in Republika Srpska as per specific chapters of the Law (i.e. Basic provisions, Types and classification of waste, Waste management planning, Waste management planning, Waste management responsibilities and obligations, Organizations of waste management, Management of special waste streams, Waste management permits, Cross-border movement of waste, Supervision, Penal provisions, Transitional and final provisions).
Selected national consultant will support preparation of required amendment of the Law on waste management of Republika Srpska and provide technical support to the Ministry of spatial planning, civil engineering and ecology of Republika Srpska and facilitate its adoption by relevant authorities.

Consultant will conduct a development of amendment of the Law on waste management of Republika Srpska by focusing on following aspects:

  • Providing thorough analysis of current Law on waste management of Republika Srpska together with institutional framework, legal and strategic documents of waste sector at level of Republika Srpska (including BiH level, as appropriate).
  • Development of amendment of the Law on waste management of Republika Srpska, in close cooperation with representatives of the Ministry of Spatial Planning, Civil Engineering and Ecology of Republika Srpska. This activity includes the prior assessment of the impact of regulations, and during the process of preparing amendment of the Law to include public hearings and public involvement, as needed.

It is envisaged that the level of effort for these tasks will not exceed 25 expert days including potential field visits to relevant institutions across BiH, as needed. The assignment will not require presence in the UNDP premises. The assignment will include regular consultation/clarification meetings in the UNDP Sarajevo office or premises of Ministry for spatial planning, civil engineering and ecology of Republika Srpska.

Academic Qualifications/Education

  • Masters’ degree in an appropriate subject (technical background – engineering, environmental sciences); PhD would be considered an asset.

Experience

  • At least 10 years of experience in conducting research and providing consultancy services related to institutional, legislative, and strategic frameworks of environmental sector or similar (experience from B&H preferred);
  • Proven experience in developing strategic and planning documents in field of waste management (experience from B&H preferred);
  • Experience in data collection and thorough identification of documents for at least 2 different projects in field of environment (experience from B&H preferred)
  • Experience working with multilateral organizations and the UN system preferred

Languages Requirements

  • Knowledge of local languages and English (excellent writing, editing and communication skills) demonstrated in submitted one-page local and English segment of any relevant study/publication/written document compiled in order to assess language skills.

Evaluation

Individual consultants will be evaluated based on the following methodology:

Cumulative analysis

When using this weighted scoring method, the award of the contract should be made to the individual consultant whose offer has been evaluated and determined as:
a) responsive/compliant/acceptable, and
b) Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

Financial Proposal

  • Lump sum contracts

The financial proposal shall specify a total lump sum amount, and payment terms around specific and measurable (qualitative and quantitative) deliverables (i.e. whether payments fall in installments or upon completion of the entire contract). Payments are based upon output, i.e. upon delivery of the services specified in the TOR.  In order to assist the requesting unit in the comparison of financial proposals, the financial proposal will include a breakdown of this lump sum amount (including travel, per diem, and number of anticipated working days).

Travel;
All envisaged travel costs must be included in the financial proposal.
