Background

United Nations Development Prorgramme (UNDP) intends to engage a legal / procurement expert to review and report on similarities and differences in procurement procedures and times between procurement activities performed in accordance with the Government Rules (in various countries) and UNDP rules.

 

Procurement and Consultancy recruitment in the public sector should be done in a fast, efficient and transparent manner. Comparing different rules will indicate the speed and efficiency in the different steps in the procurement system.

 

In this study, several Government Rules in Asia Pacific will be examined and compared with the rules and regulations of the UNDP. Indicating and describing each step in the processes of procurement of goods and services and Consultancy recruitments.

Duties and Responsibilities

Scope of Work

The Consultant will work under the direct supervision of the regional partnership advisor (with support of the Regional Procurement Advisor in UNDP Bangkok Regional Hub, and the Accountability Transparency project manager in UNDP Bangkok Regional Hub)

In this context, s/he will analyze Procurement Rules: including but not limited to:

  • Conduct a general scanning of procurement and recruitment laws in various Asia Pacifc countries.

  • Describe the different systems used in the countries (per ministry, departments).

  • Obtain and review the national procurement laws, summarize main steps in procurement process based on the thresholds followed in the law, measure times (minimum and where possible average of common times between steps)

  • Compare with the rules and times of UNDP procurement and recruitment methods

  • Conduct Interviews with procurement staff in country office and if applicable with governments (where encountered documents good practices at country level).

  • Build upon the survey, interview and research, draft a report per country (minimum 6 reports) which can be used as template for other countries.

  • Based on the above, draft government financing approach with recommendations and action plan per country.

  • Possible lay out of the report:

           chapter 1: description procurement lay of land of country X

           chapter 2: UNDP procurement;

           chapters 3: similarities and differences between the systems

  • Divide the analysis between goods (procurement) and services (consultants); describe the process (similarities and differences) per threshold (Micro purchasing, other procurement strategies, direct contracting, tender review committees etc).

  • Produce 6 reports, advise on regional approach with rolling out the same study in 24 CO’s

Expected Outputs and Deliverables

The consultant is expected to achieve the following outputs:

  • Scanning of procurement laws in 6 countries

  • Design, conduct interviews with relevant persons

  • Draft reports comparing country rules with UNDP rules, with recommendations and action plan

  • Draft presentation PPT explaining the flexibility and speed the UNDP can offer in Procurement (in comparison with national laws)

  • Provide UNDP with links/ literature on Government Procurement Rules and Regulations with the sources for any updates.

Institutional Arrangement

a) The consultant will report directly to the Regional Advisor on Partnerships and Resource Mobilization, and seek advice and support from the Regional Procurement Advisor.

b) The consultant is expected to provide a progress report bimonthly.?

c) The Consultant will continuously liaise and interact with the procurement offices in the six country offices, as well as the Regional Advisors for Resource Mobilization and Procurement.

d) The consultant will work independently with guidance from the Regional Partnerships and Resource Mobilization Advisor.

Duration of the Work

1 April 2019 – 31 December 2019 (a maximum of 50 working days)

Duty Station

Bangkok, Thailand with no travel.

Required Skills and Experience

Education Qualifications

  • University degree or equivalent in Law, Business Administration, Economics or similar field.

Experience

  • Ability to conduct research and write proposal at UN standards

  • Ability to meet deadlines and work under pressure

  • Ability to work across teams and effectively promote information-sharing, collaboration and cooperation

  • Experience with Public Procurement working with government / procurement or in the

  • development field is an advantage

Language

  • Excellent English (written and spoken)

  • Excellent writing, presentation and communication skills

Price Proposal and Schedule of Payments

The contract will be based on Daily Fee

Consultant shall quote an all-inclusive Daily Fee for the contract period. The term “all-inclusive” implies that all costs (professional fees, communications, consumables, etc.) that could be incurred by the IC in completing the assignment are already factored into the daily fee submitted in the proposal. If applicable, travel or daily allowance cost (if any work is to be done outside the IC’s duty station) should be identified separately. Payments shall be done on a monthly basis based on actual days worked, upon verification of completion of deliverables and approval by the IC’s supervisor of a Time Sheet indicating the days worked in the period. In general, UNDP shall not accept travel costs exceeding those of an economy class ticket. Should the IC wish to travel on a higher class he/she should do so using their own resources

In the event of unforeseeable travel not anticipated in this TOR, payment of travel costs including tickets, lodging and terminal expenses should be agreed upon, between the respective business unit and the Individual Consultant, prior to travel and will be reimbursed.

Travel costs shall be reimbursed at actual but not exceeding the quotation from UNDP approved travel agent.? The provided living allowance will not be exceeding UNDP DSA rates. Repatriation travel cost from home to duty station in Bangkok and return shall not be covered by UNDP.

 

Evaluation Method and Criteria

Individual consultants will be evaluated based on the following methodology;

Cumulative analysis

The award of the contract shall be made to the individual consultant whose offer has been evaluated and determined as a) responsive/compliant/acceptable; and b) having received the highest score out of set of weighted technical criteria (70%) and financial criteria (30%). Financial score shall be computed as a ratio of the proposal being evaluated and the lowest priced qualified proposal received by UNDP for the assignment.

Technical Criteria for Evaluation (Maximum 100 points)

  • Criteria 1: Relevance of Education – Max 30 points

  • Criteria 2: Relevance working experience in the area of law, public procurement rules, public finance rules and regulations - Max 50 Points

  • Criteria 3: Excellent report writing and communications skills in English – Max 10 points

  • Criteria 4: Experience working with Governments, UN agencies other international organizations – Max10 Points

Only candidates obtaining a minimum of 70 points (70% of the total technical points) would be considered for interview and Financial Evaluation respectively.

Documentation required

Interested individual consultants must submit the following documents/information to demonstrate their qualifications. Please group them into one (1) single PDF document as the application only allows to upload maximum one document:

  • Letter of Confirmation of Interest and Availability using the template provided in Annex II.

  • Personal CV indicating all past experience from similar projects, as well as the contact details (email and telephone number) of the Candidate and at least three (3) professional references.

  • Financial proposal, as per template provided in Annex II. Note: National consultant must quote price in U.S. Dollar that indicates the all-inclusive fixed total contract price, supported by a breakdown of costs, as per template provided. If an Offeror is employed by an organization/company/institution, and he/she expects his/her employer to charge a management fee in the process of releasing him/her to UNDP under Reimbursable Loan Agreement (RLA), the Offeror must indicate at this point, and ensure that all such costs are duly incorporated in the financial proposal submitted to UNDP. Kindly indicate the costs related to the 3 aforementioned missions under a separate heading;

  • Technical proposal, including a) a brief description of why the individual considers him/herself as the most suitable for the assignment; and b) a methodology, on how they will approach and complete the assignment.
