UNDP Afghanistan Mission Statement

UNDP supports stabilization, state-building, governance and development priorities in Afghanistan. In partnership with the Government of the Islamic Republic of Afghanistan (GIROA), the UNDP, the United Nations system, the donor community and other development stakeholders, has contributed to institutional development efforts leading to positive impact on the lives of Afghan citizens. Over the years UNDP’s support has spanned such milestone efforts as the adoption of the Constitution; Presidential, Parliamentary and Provincial Council elections; institutional development through capacity-building to the legislative, the judicial and executive arms of the State, Ministries, Government agencies and commissions at the national and sub-national levels.

UNDP has played a role in the management of the Law and Order Trust Fund for Afghanistan (LOTFA), which supports the Government in developing and maintaining the national police force and in efforts to stabilize the internal security environment. Major demobilization, disarmament and rehabilitation and area-based livelihoods and reconstruction programmes have taken place nationwide. UNDP Programmes in Afghanistan have benefited from the very active support of donors. UNDP Afghanistan is committed to the highest standards of transparency and accountability and works in close coordination with the United Nations Assistance Mission in Afghanistan (UNAMA) and the UN system to maximize the impact of its development efforts on the ground.

Organizational context

UNDP is committed to augmenting the capacity of the GIROA to administer Rule of Law and improve security and justice service-delivery for all Afghan citizens. As the lead Rule of Law institution in the country, improving the ability of the Ministry of Interior Affairs (MOIA) to fulfill its mandate remains critical to the overall stability of Afghanistan and its people. As the UNDPs primary development agency, and a longstanding development partner to GIROAs Rule of Law and Security sector, UNDP Afghanistan plays a leading role in facilitating institutional reform and development of MOIA.

UNDP has operated the LOTFA since 2002. LOTFA up to 2017 has supported the payment of salaries of officers of the Afghan National Police (ANP) and the General Directorate for Prison and Correction Centers (GDPDC), institutional development of the MOIA and police professionalization of the ANP, through two separate projects un-der LOTFA, namely the Support to Payroll Management (SPM) and MOIA and Police Development (MPD) pro-jects. In 2015, LOTFA was restructured with the objective to ensure the full handover of the payroll functions currently managed by UNDP to the GIROA and to develop national capacity for its effective, efficient and accountable management by 31 December 2016. In December 2016, Government and donors agreed to extend the SPM project until Government and donors agree on the moment for payroll transition.

Based on consultations conducted between UNDP, the GIROA and donors during 2017, a growing view emerged that the scope of LOTFA should be expanded to include the entire justice chain (police, courts and prisons) and cover all institutions across the entire Rule of Law sector, with an increased focus on anti-corruption. Accordingly, the following three Thematic Windows have been identified for the Strategic Framework: 1) Security; 2) Justice; 3) Anti-Corruption; and 4) MOIA Payroll.?

Subsequently, the LOTFA structure has been revised to bring it more in line with international standards and best practices on Trust Fund management and administration. The new Trust Fund Terms of Reference (TOR) was approved by the LOTFA Steering Committee on 25 November 2018. Under the revised structure, a Trust Fund Management Unit (TFMU) will be established to support the LOTFA Steering Committee and the UNDP Country Office in the coordination of the technical, administrative, financial and operational aspects of Trust Fund management and administration.

The new Trust Fund Terms of Reference (TOR) and Strategic Framework specifically emphasize on the establishment of a robust M&E Framework for LOTFA. M&E sits at the heart of LOTFA. LOTFA is building a compelling evidence base about what works and what doesn’t in Afghanistan’s law and justice sector so that it can confidently plan and implement initiatives that bring greatest impact to the lives of Afghan citizens. LOTFA is rolling out a comprehensive M&E approach: M&E will be part of all project designs through to implementation and wrap-up and will provide real time information flow and feedback to support a flexible, adaptive management approach and an evidenced-based understanding of LOTFA outputs and impact.

The improved M&E system will enable LOTFA stakeholders, donors and national institutions to make informed decisions on the direction of future Trust Fund planning and programming. It will enable the use of evidence-based adaptive management alongside traditional methods so that it meets the requirements stated in the MISP 2018-2022 for local solutions that respond to local needs.

 

Duties and Responsibilities

SCOPE OF WORK AND DELIVERABLES

Objective of the assignment:

There are many stand-alone, one-time assessments and studies apart from a very few regular analysis conducted in Afghanistan on human security and rule of law, however UNDP feels in-depth, regular analysis for decision making is necessary to connect afghan people to decision makers.

The Rule of Law survey will serve a flagship product of UNDP’s LOTFA providing reliable, timely, representative data on the thematic sectors impacting the rule of law in Afghanistan such as corruption within key government service providers, safety and security, access to justice. The survey results are expected to inform not only UNDP and LOTFA’s donors but widely development actors including government officials and other development players.

As its primary objective, the survey will be utilized for LOTFA’s evidence base and keeping stakeholders and partners informed of the broader ‘rule of law’ related developments in the country, UNDP decided to launch the “country-wide Rule of Law Survey”.? This survey will also serve as a focal point for baseline for development programming and citizen’s feedback collection to be injected into decision making. The survey will be implemented on an annual basis until at least 2024.

The survey should strengthen key government stakeholders’ ability to collect, aggregate, analyze data from citizens of Afghanistan.

For the survey, UNDP expects to use complementary sampling approaches as well as innovative data collection and analysis tools. The International Consultant/ Rule of Law Survey Coordinator under direct guidance of the Senior international M&E Advisor will be responsible for the following tasks.

Tasks:

  • Undertake consultations with key stakeholders, local and international experts in the area of rule of law on the scope and design of the country-wide survey;
  • Suggest methodological options following stakeholder and expert consultations and decide on the most suitable and effective way for a country-wide Rule of Law Survey, tailored as well as to the needs and implementation of current and foreseeable LOTFA projects;
  • Design detailed concept note, methodology, sampling approach and implementation plan;
  • Identify and support recruitment and contracting ?of a suitable data collection company for undertaking such a survey;
  • Train the supervisors and enumerators on the survey methodology and data collection tools (at central, provincial, district and village levels;
  • Supervise and QA the data collection and analysis side of the survey;
  • Coordinate data analysis for all the sections of the Rule of Law Survey in coordination with the M&E, Justice, Anti-Corruption and Security teams;
  • Provide strategic advice to the Senior Managers of LOTFA on the rule of law, access to justice and anti-corruption thematic areas;
  • Ensure quality of the narratives for the data analysis sections of the report; ensure descriptive text reflects findings of the survey; analyze gaps in thematic areas;
  • Provide recommendations on strengthening LOTFA’s programming as well as broadly refer to the relevance of state-priorities;
  • Ensure a proper uptake approach to the decision- makers inside and outside the GOA.

Expected Deliverables:

Deliverable 1:Inception Report: Concept Note and Implementation plan Structure of the “Whole Country Rule of Law” Survey

Deliverable 2:Progress Report 1: Detailed survey questionnaires and assessment tools finalized and validated by Senior M&E Advisor and Senior Justice Advisor as well as approved by GOA.

Third Party data collectors hired

Deliverable 3:Progress Report 2: Data Collectors trained on survey and their survey work plans finalized

Deliverable 4:Progress Report 3: Pilot data collection initiated

Deliverable 5:Progress Report 4: All survey data collected

Deliverable 6:Final Report: Analysis of data completed, presented to the M&E Team and validated by Justice team

Payment Modality, Schedule and Percentage:

Payments under the contract will be linked to deliverables and made on receipt of the specific milestones indicated above, and including a timesheet according to UNDP procurement formats for individual contractors:

  1. The first payment upon completion of the first deliverable (22 working days, 10%);
  2. The second payment upon completion of the second deliverable (22 working days, 18%);
  3. The third payment upon completion of the third deliverable (22 working days, 18%)
  4. The fourth payment upon completion of the third deliverable (22 working days, 18%);
  5. The fifth payment upon completion of the third deliverable (22 working days, 18%);
  6. The last payment upon completion of the fourth deliverable and Final Report (22 working days, 18%).

The payments will be paid upon the full completion and acceptance of contractual obligations whereupon the Chief of UNDP Rule of Law and Human Security (ROLHS) Unit signs the certification of acceptance.

Required Skills and Experience

Education requirements

  • Master’s degree in social sciences, law, gender studies and relevant fields or Bachelor’s degree with 7 years of direct experience in the area of complex social and behavioral research and related fields.

Required expertise and experience:??????

  • At least 7 years of demonstrable expertise in conducting complex research, surveys and assessments in rule of law, security, justice and/ or corruption sectors

  • At least 5 years of experience in developing complex survey methodologies, data collection tools with digital data analytical tools (preferable in the Rule of Law sector)

  • Deep knowledge and proven experience of research, evaluations as well as quantitative and qualitative research methods that are internationally recognized

  • Experience working with digital data collection tools, companies, experience and knowledge of ODK and metadata tools

  • Solid experience with high-quality (publicly available) perception surveys in fragile states

  • Overall at least 10 years of hands on experience conducting research, evaluations, surveys and data analytics

  • Excellent communication skills both written and verbal

  • Report design capabilities

  • Proven experience setting up and managing multi-cultural teams, plans, building excellent relationships with donors and partners

  • Experience of working in fragile conflict affected states and (desirable) specific experience and expertise in post-conflict reform of law and order.

    Language:

  • Excellent written and oral English.

Price Proposal and Schedule of Payments:

The contractor shall submit a price proposal as below:

  • Daily Fee – The consultant shall propose a daily fee, which should be inclusive of her/his professional fee, local communication costs and insurance (inclusive of medical health insurance and evacuation). The professional daily fee, all inclusive of the above elements, shall be paid upon submission of timesheet. The number of working days for which the daily fee shall be payable under the contract is 132 working days maximum.

  • UNDP/LOTFA will provide accommodation free of charge to the Consultant. The contractor is NOT allowed to stay in a place of his choice other than the UNDSS approved places. UN will provide MORSS compliant accommodation in UNOCA to the contractor;

  • Travel & Visa – All airfares and travels costs for 4 trips, including visa on arrival charges will be borne by the project.

  • Payment schedule - Payments shall be done upon verification of completion of specific reports, deliverables and approval by the consultant’s supervisor.

Evaluation Method and Criteria

Individual consultants will be evaluated based on the following methodology:

Cumulative analysis

The award of the contract shall be made to the individual consultant whose offer has been evaluated and determined as:

  • Responsive/compliant/acceptable; and

  • Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

    Technical Criteria weight 70%;

    Financial Criteria weight 30%.

    Only candidates obtaining a minimum of 49 points (70% of the total technical points) would be considered for the Financial Evaluation.

    Technical Criteria 70 points:

    Qualification and Experience (30 marks) [evaluation of CV]:

  • General Qualification (15 marks);

  • Experience relevant to the assignment (15 marks).
