Background

In 2015, UNDP Philippines, along with 192 countries, adopted the Sustainable Development Goals (SDGs) at the United Nations General Assembly. With 17 ambitious and wide-encompassing targets that aim to end poverty, protect the planet, and ensure prosperity for all, the SDGs will not only require significant financing but will also entail cooperation and participation of all sectors. Under SDG 17 (Partnerships for the Goals), two indicators state: “Businesses operate according to internationally recognized standards of responsible business conduct” and “Businesses contribute directly to the Goals according to capacity and expertise.” Clearly, with the private sector’s ability to create sustainable, innovative, and scalable market solutions to address the world’s problems, they play a critical role in ensuring the achievement of SDGs by 2030. However, corruption has been cited by private sector as the most significant challenge in doing business in the Philippines as well as in other ASEAN countries, which discourages investment and threatens sustainability of economic and social development.

With the momentum coming from the Agenda 2030 for Sustainable Development, it is encouraged that government and private sector to forge strong partnerships to promote fair, transparent and predictable business environments, and to remove barriers to economic and social growth. Private sector and government partnerships that will create a virtuous cycle of shared prosperity.

In 2018, the United Nations Development Programme (UNDP) and UK Government launched the Regional Project called ‘Promoting a Fair Business Environment in ASEAN” for South East Asia under the new Prosperity Fund. The project aimed to lead the way for a multi-stakeholder effort to promote enabling environment for private sector, minimize corruption risks and shape sustainable business practices in ASEAN. Specifically, the project prioritize areas including: (1) forging stronger partnerships between government and Private sector; (2) reforming procurement and infrastructure; (3) promoting sustainable business practices; and (4) strengthening anti-corruption, accountability and judicial mechanisms. Output 3 of the Regional Project is, “Strengthening Business Integrity and Corporate Governance Practices in the Private Sector” and is aimed at supporting private sector collective action and responsible business conduct initiatives among six target countries in ASEAN.

UNDP Philippines will contribute to the output via a country-level project entitled “Business Integrity PACTS (Partners for Accountable, Clean and Transparent Sustainable Enterprise)”. The project will run for 12 months to promote ethical business practices in the Philippines and minimize leakages in private to private business contracts. The main objectives of the project are as follows:

  • Effectively monitor the compliance of enterprises operating within the Philippines through a standard Code of Conduct for doing business;
  • Encourage companies to invest more in their organization’s anti-bribery/corruption, ethics and compliance as well as sustainability programs, in pursuit of competitiveness and a level playing field; and
  • Enable partnerships and collaboration among the Philippines’ business community and develop co-created strategies in addressing unethical business practices in the value chain.

 UNDP will recruit a Coordinator to support the Country Office in ensuring effective management of implementation of the Business Integrity PACTS and in strategic and effective engagement with partners and stakeholders.

Duties and Responsibilities

The Coordinator will report directly to the Team Leader of Management Support and will be required to work closely with the UNDP Philippines Country Office Senior Management and Programme Teams. The work will also be closely coordinated with the Country Office’s project for Output 3 of the Regional Project, entitled “Mitigating Integrity Risks in Public Procurement in the Philippines”.

On a regular basis, s/he will also coordinate with the Regional Project Focal based in the UNDP Bangkok Regional Hub and the UK Prosperity Fund focal of the UK Embassy in Manila.

The Coordinator  will work with relevant organizations and business associations such as, but not limited to the Makati Business Club, Philippine Chamber of Commerce and Industry, Global Compact Network Philippines, AIM Ramon V. del Rosario Center for Corporate Responsibility and Isla Lipana & Co and other regional and local stakeholders.

The Coordinator will be responsible for the following:

Act as UNDP PH coordinator for the implementation of Integrity PACTS focusing the delivery of the following:

  • Provide regular updating and reporting to Senior Management and BRH;
  • Draft and submit quarterly and annual reports;
  • Monitor budget and work plan in regular basis;
  • Revise and update workplan as necessary

Draft the Terms of References for following:

  • Scoping Study on existing business integrity practices in the local value chain, particularly SME business partners of Philippine conglomerates to examine the extent, range and nature of existing business integrity practices in the local value chain, particularly SME business partners of Philippine conglomerates.
  • Exploratory/feasibility research on the utilization of blockchain technology in procurement/ supply management to assess the practicality of applying blockchain technology in procurement/ supply management.

Closely coordinate with co-implementer of the Integrity PACTS Makati Business Club (MBC), Philippine Chamber of Commerce and Industry, Global Compact Network Philippines, AIM Ramon V. del Rosario Center for Corporate Responsibility and Isla Lipana & Co. ) and manage partners and stakeholders.

Provide effective oversight and management to the implementation of Integrity PACTS activities and sub-activities including but not limited to the following:

  • Conduct of scoping study on existing business integrity practices in the local value chain, particularly SME business partners of Philippine conglomerates to examine the extent, range and nature of existing business integrity practices in the local value chain, particularly SME business partners of Philippine conglomerates.
  • Conduct an exploratory/feasibility research on the utilization of blockchain technology in procurement/ supply management to assess the practicality of applying bockchain technology in procurement / supply management.
  • Creation of business integrity / anti-corruption indicators* for SMEs and Business Partner Code of Conduct (c/o PwC and AIM)
  • Creation of Technical Working Group to manage and oversee implementation of the Initiative
  • Development and pre-testing of training module, including conduct of pilot training workshops for SME vendors/business partners

Provide technical-level support and guidance to the SDGs is Our Biz Business Advisory Council and Technical Working Group, including the finalization of  the “Transformational Business: Philippine Private Sector Contributions to the UN SDGs 2019 edition”; and

Other relevant and related tasks as may be requested by immediate supervisor and the Resident Representative.

Institutional Arrangements

The Coordinator shall directly report to the Management Support Unit Team Leader of UNDP Philippines.  Deliverables will be reviewed by the Management Support Unit, in coordination with the UNDP Philippines Senior Management Team. 

The Consultant shall render intermittent service, equivalent to 60 person days spread from May  to November 2019, to execute the scope of the tasks and deliverables indicated in this terms of reference.

 

Duration of Assignment, Duty Station and Travel 

The assignment is sixty days spread over six months, commencing on May 2019 and completed on 30 November 2019, unless revised in a mutually agreed upon timetable between the Coordinator and the Management Support Team Leader  and subject to performance and availability of funds.

Duty station: UNDP Philippines Country Office, Rockwell Business Center Sheridan, Mandaluyong City, Philippines. The Consultant is not required to report on a daily basis at the duty station, but shall have an agreed weekly reporting schedule with the Management Support Team Leader.

Travel: As may be deemed relevant to the assignment, the Consultant may be required to travel within the Philippines or the Asia-Pacific region. Travels will be endorsed by the Management Team Leader for approval by the Resident Representative. Travel expenses, to be covered by the Project, shall be agreed prior to travel and a travel report is to be submitted after trips are completed.

 

Scope of Plan of Proposal and Schedule of payment

The Consultant must send a financial proposal based on a lump-sum amount for the delivery of the outputs identified below. The total amount quoted shall include all costs components required to deliver the goods and services identified above, including professional fees and any other applicable costs (i.e., such as transportation/travel to and from residence for meetings within Metro Manila, supplies and materials, equipment, reproduction, communications, etc.) to be incurred by the Consultant in completing the assignment.

The contract price will be fixed output-based price. Any deviations from the outputs and timelines, as well will need to be agreed on between the between the Consultant and the Management Support Team Leader.  Travel, as deemed relevant by UNDP, will be covered and arranged by UNDP, following UNDP Financial Rules and Regulations.

Payments will be done upon satisfactory completion of the deliverables by target due dates. Outputs will be certified by the Management Support Team Leader prior to payments.

Education:

Experience

  • Proven professional experience (at least 2 years) in business integrity and corporate governance practices in the Philippines
  • Established (at least [1] one) local network of Philippine companies and business associations

Language

  • Prior work experience with UNDP/UN is an advantage

 

Criteria for Evaluation of Offers

Offers will be evaluated based on combined scoring method – where the Technical Proposal will be evaluated based on qualifications in the CV and brief description of previous work. The Technical evaluation is weighted a max. of 70%.

The Financial Proposal that will be evaluated through submission of the Offeror's Letter to UNDP Confirming Insterest and Availability for the IC including Financial Proposal Template and combined with the price offer will be weighted a max of 30%;

For the evaluation of the Technical Proposal, the selection of the successful consultant must be based in the following qualifications (with the appropriate obtainable points):
