Background

Overview:

 

Since 2016, UNDP has promoted regional efforts to implement the UN Guiding Principles on Business and Human Rights (UNGP), focusing on advocacy, policy development, technical support, and capacity building. In 2018, UNDP accelerated this commitment by launching the Business + Human Rights Asia (B+HR Asia) Unit. B+HR Asia leverages UNDP’s trusted relationships throughout the region and convenes governments, private sector actors, civil society, and national human rights institutions for greater coherency on collective action for business and human rights progress.

 

The growing reach and impact of business enterprises have given rise to a debate about the roles and responsibilities of such actors with regard to human rights and have led to the placement of business and human rights on the UN agenda. The UN Guiding Principles on Business and Human Rights (UNGPs) were unanimously endorsed by the Human Rights Council in June 2011, within the UN “Protect, Respect and Remedy” Framework, to identify standards of corporate responsibility and accountability for transnational corporations and other business enterprises with regard to human rights.

 

Today, there is a stronger business case for addressing the adverse impact of business operations through due diligence efforts and company-level grievance mechanisms.

 

During its second Universal Periodic Review in May 2016, the Royal Thai Government received a recommendation to develop, enact, and implement a NAP on business and human rights (UPR recommendation 158.49 by Sweden). The Thai government accepted this recommendation. The Rights and Liberties Protection Department of the Ministry of Justice is now leading the process of developing a National Action Plan on Business and Human Rights.

 

To be able to respect human rights, companies need to understand their actual or potential impacts on affected groups and especially the most vulnerable in society. The National Action Plan can serve as a framework for governments, business and civil society to work together in ensuring that human rights is protected and respected in business conducts. This is in line with Sustainable Development Goal 17, which seeks to strengthen global partnerships to support and achieve the ambitious targets of the 2030 Agenda, bringing together national governments, the international community, civil society, the private sector and other actors.

 

UNDP Thailand is recruiting an experienced national consultant to conduct a comprehensive stakeholder mapping of private sector agencies. The mapped stakeholders will be proactively engaged in Thailand’s implementation of the National Action Plan on Business and Human Rights.

Duties and Responsibilities

Scope of work:

 

As per the objectives of the assignment and expected deliverables, it is proposed that the timeline for carrying out the consultancy, will be from 21 June – 9 August 2019. The consultant will be responsible for delivering the following outputs:

 

  • A comprehensive mapping matrix of private sector actors in Business and Human Rights
  • Facilitated discussions at a workshop of private sector actors mapping

Institutional Arrangement:

 

Under the overall guidance of the Programme Specialist/Team Leader, of the Democratic Governance and Social Advocacy Unit, the national consultant will report directly to and work closely with the Project Manager – Business, Human Rights and LGBTI. Review/approval time required to review/ approve outputs prior to authorizing payments is 7 – 10 days.

 

 

Duration of the Assignment:

 

The duration of the assignment is 21 June – 9 August 2019. With a maximum of 15 working days.

Required Skills and Experience

I.             Academic Qualifications:

 

  • A degree in Human Rights, Business and Management, Social Sciences, Law or other related fields.

 

II.            Years of experience:

  • At least 2 years of relevant experience corporate social responsibility or related field, including business and human rights.

 

III.           Language:

  • High proficiency in written and spoken Thai and written English and experience in writing UN reports.

 

IV.          Competencies:

  • Strong familiarity with Thai business community;
  • Substantive experience in conducting a mapping exercise of stakeholders;
  • Experience in facilitating workshops on development issues;
  • Previous experience working with the UN, development partners, government agencies, and/or civil society organizations is an advantage.

 

This position is for National Consultant only

 

 

Price Proposal and Schedule of Payment :

 

Consultant must send a financial proposal based on the lump sum amount.

 

The total amount quoted shall be all-inclusive and include all costs components required to perform the deliverables identified in the TOR, including professional fee, travel costs, living allowance (if any work is to be done outside the IC´s duty station) and any other applicable cost to be incurred by the IC in completing the assignment. The contract price will be fixed output-based price regardless of extension of the herein specified duration. Payments will be done upon completion of the deliverables/outputs and as per below percentages:

First payment at 30% shall be made upon satisfactory receipt of a first draft of the mapping matrix by sector of all the relevant private sector actors.

Second payment of 30% shall be made upon successful delivery of a mapping workshop with private sector and other participants, to receive inputs in the draft mapping matrix, validate and discuss B&HR challenges.

Third (final) payment of 40% shall be made upon a satisfactory receipt of a final mapping matrix by sector of all the relevant private sector actors, incorporating inputs from the workshop of private sector actors mapping.

In general, UNDP shall not accept travel costs exceeding those of an economy class ticket. Should the IC wish to travel on a higher class he/she should do so using their own resources.

 

In the event of unforeseeable travel not anticipated in this TOR, payment of travel costs including tickets, lodging and terminal expenses should be agreed upon, between the respective business unit and the Individual Consultant, prior to travel and will be reimbursed. Travel costs shall be reimbursed at actual but not exceeding the quotation from UNDP approved travel agent.

 

 

Criteria for Selection of the Best Offer:

 

Cumulative analysis

 

The award of the contract shall be made to the individual consultant whose offer has been evaluated and determined as a) responsive/compliant/acceptable; and b) having received the highest score out of set of weighted technical criteria (70%). And financial criteria (30%). Financial score shall be computed as a ratio of the proposal being evaluated and the lowest priced proposal received by UNDP for the assignment.

 

Technical Criteria for Evaluation (Maximum 70 points)

  • Criteria 1 Relevance of education – Max 10 points
  • Criteria 2 Special skills, language, etc.- Max 10 Points
  • Criteria 3 Relevance of experience in area of specialization (e.g. business, human rights) – Max 15 points
  • Criteria 4 Relevance of experience in key areas (e.g. conducting a mapping exercise, facilitating a workshop) – Max 15 points
  • Criteria 5 Assessment of approach/methodology to assignment – Max 20 Points

 

Only candidates obtaining a minimum of 70% of the total technical points would be considered for the Financial Evaluation.

 

 

Documents to be included when submitting the proposals:

 

Interested individual consultants must submit the following documents/information to demonstrate their qualifications. Please group them into one (1) single PDF document as the application only allows to upload maximum one document:

 

  • Letter of Confirmation of Interest and Availability using the template provided in Annex III;
  • Personal CV, indicating all past experience from similar projects, as well as the contact details email and telephone number of the Candidate, and at least three (3) professional references;
  • Financial Proposal that indicates the all-inclusive fixed total contract price supported by a breakdown of costs, as per template provided. If an Offeror is employed by an organization/company/institution, and he/she expects his/her employer to charge a management fee in the process of releasing him/her to UNDP under Reimbursable Loan Agreement (RLA), the Offeror must indicate at this point, and ensure that all such costs are duly incorporated in the financial proposal submitted to UNDP.
  • Proposed methodology of mapping (a minimum of 3 pages)
