Background

UN Women, grounded in the vision of equality enshrined in the Charter of the United Nations, works for the elimination of discrimination against women and girls; the empowerment of women; and the achievement of equality between women and men as partners and beneficiaries of development, human rights, humanitarian action and peace and security. Placing women's rights at the centre of all its efforts, UN Women leads and coordinates United Nations system efforts to ensure that commitments on gender equality and gender mainstreaming translate into action throughout the world. It provides strong and coherent leadership in support of Member States' priorities and efforts, building effective partnerships with civil society and other relevant actors.

Albanian has made important steps in the area of gender equality and end of violence against women. The country is party to key human rights treaties, including the Convention for the Elimination of all Forms of Discrimination against Women (CEDAW) and the Council of Europe Convention on preventing and combating violence against women and domestic violence (Istanbul Convention) and has adopted a national legal framework to address domestic and other forms of violence against women. At the policy level, a “National Strategy and Action Plan on Gender Equality 2016-2020” (NSGE 2016-2020) was adopted in 2016, which includes a specific objective related to reduction of gender-based and domestic violence.

In Albania, UN Women provides technical assistance to national partners (governmental and non-governmental institutions) on the implementation of existing international and national commitments to women's rights and gender equality. Currently, a UN Joint Programme “Ending Violence against Women” (UNJP on EVAW) funded by Government of Sweden is being implemented by UNDP, UN Women and UNFPA in partnership with Albanian Government. The Joint Programme is in line with Output 2.5 of the UN’s Programme of Cooperation for Sustainable Development (PoCSD) with the Government of Albania (GoA) and aims at: (i) strengthening the normative and accountability framework related to gender-based violence; (ii) improving institutional practices, services and coordination for survivors of violence; and (iii) challenging norms pertaining to violence against women at the state, community and individual levels.  These results aim at bringing institutional and behavioral change in preventing and responding to gender-based violence, thereby contributing to freeing women and girls from all forms of violence and from the threat of such violence.

An important component of the programme is increasing the confidence of women and girls to report violence to relevant authorities. Despite some progress over the years, violence against women remains largely unreported. Disclosure is especially rare in public spaces, including public administration.  A study from 2017 on sexual harassment in public administration indicates that about 58% consider this phenomenon with low incidence, while only 15% consider it as being present in the public administration. Additionally, only 8% of those surveyed admitted of being sexually harassed in their workplace in public administration. (1)

Over the years, UN Women has made efforts to address the issue of sexual harassment in public administration, especially among the Police forces. In the context of UN Support to the Albanian Government to implement the UN Security Council Resolution on Women, Peace and Security (UN SCR 1325), the Albanian State Police adopted in 2014 a Policy against Harassment, including Sexual Harassment (the Policy).

This Policy aims to establish formal and informal rules and procedures, including policies and concrete procedural and administrative measures; to establish a specific mechanism and assign responsibilities to the respective authorities at central and local levels of management to prevent, investigate and take disciplinary measures against harassment and sexual harassment in State Police. The approved policy defines responsible police authorities that are responsible to treat cases of harassment and sexual harassment in the police organization; raise awareness and conduct training of all levels of management in order to prevent and/or punish cases of harassment and sexual harassment; and monitor the implementation of the policy in State Police.  Along with the Policy, a training module is drafted for the continuous training of the police staff with the support of UN Women. This document was developed and approved in the context of government’s efforts to increase women’s participation in Albanian Police force, as well as improve retention and career advancement within the police forces.

In parallel, UN Women has organized a number of trainings, where over 80police officers have been trained on their responsibilities and rights with regards to a work environment free of harassment in the work place.

Currently, five years after the adoption of the Policy it becomes paramount to monitor its relevance, efficiency and impact and the review it based on the results of the monitoring report.   This process is particularly relevant in the context of the adoption of the Albanian National Action Plan on the Implementation of the UN SCR 1325, which includes as one of its measures the strengthening of professional capacities of the State Police for a gender perspective in policing, with a focus on sexual harassment.

To this aim, UN Women is planning to recruit a National Consultant who will monitor the implementation of the Albanian State Police Policy against Harassment since its adoption in 2014 and review the document.

Objectives of the Consultancy:

The purpose of this consultancy is as follows:

  • Assess the relevance of the Policy (e.g. whether its provisions including its measures to prevent, investigate and end impunity against offender are relevant to current need in ASP to address sexual harrasment whether all Staff of the Albanian Police well informed about the Policy and measures to be taken in cases of allegations for sexual harassment)
  • Review and monitor the status of implementation of the Policy (e.g. identification of achievements and gaps related to its implementation; rate of successful disciplinary measures; percentage of police officers who have undergone training on harassment policy and procedures)
  • Assess the impact of the Policy (e.g. is the work environment in the Police perceived as safer since the adoption of the Policy; has the number of reports and increased/decreased);
  • Provide recommendations to the Albanian State Police on required revisions to increase the effectiveness of the Policy.
  • Support Albanian State Police and the Ministry of Interior with drafting a revised Policy Document
  • Adapt the existing training modules, materials, and presentations in Albanian as per the changes of the Policy;
  • Delivery 5 (five) one-day training to  Police Officers of different regions of Albania.

Duties and Responsibilities

Under the overall supervision of the UN Women Albania and in close collaboration with the Albanian State Police, the consultant will be responsible for the following activities: 

  • Prepare a consultancy work-plan, including a schedule of meetings with representatives of the Albanian State Police at the central level (e.g. Department of Professional Standards at the General Directory of State Police; Human Resources Department; Police Unions, including Women Forum, Ministry of Interior) to inform them about the purpose of the monitoring process of the Policy Develop a methodology to monitor the implementation of the Albanian State Police Policy on Sexual Harassment, which inter alia should include:
  • the overarching methodological framework (for example sample survey case study, desk review, mixed methods);
  • expected data collection and analysis methods;
  • the process for verifying findings with key stakeholders;
  • meetings or consultations or other interactions expected with particular stakeholder groups;
  • how various members of the police force/stakeholders in the monitoring process are likely to be involved;
  • Conduct the monitoring process and prepare a detailed report on the findings of the monitoring of the Policy, including specific recommendations for further measures to improve its implementation.
  • Assess whether the Policy is aligned with international standards for the provision of effective and efficient response to the sexual harassment cases and national legal framework.
  • Review the policy document based on the recommendation of the monitoring report and of the findings of the assessment
  • Share the draft policy with relevant authorities and revise as per their suggestions.
  • Coordinate the organization of a workshop/consultation meeting with representatives of the State Police and other stakeholders to share the findings of the monitoring report.

Deliverables:

  • Consultancy work-plan and report of meetings with representatives of Albanian State Police (3 working days);
  • The methodology for monitoring the Policy (5 working days)
  • Monitoring process and final monitoring report including recommendations (20 working days);
  • Revised Policy document based on the monitoring report and the inputs provided by relevant authorities (5 working days)
  • Presentation and report on the workshop/consultation meeting with key stakeholders to share the findings of the monitoring process and the revision of the Policy; (2 days)
  • Adapt the existing training modules, materials, and presentations in Albanian as per the changes of the Policy; (2 days)
  • Delivery 5 (five) one-day training to  Police Officers of different regions of Albania. (8 days)

Duration of the Work

The consultant will be contracted for a maximum of 45 days for a period of 3 months starting from the signature of the contract.

  • Previous experience with UN Women and/or other international organizations in conducting relevant work is an asset.

Language requirement

  • Proficiency in written and spoken English and Albanian, and excellent drafting and presentation skills.

Scope of Price Proposal and Schedule of Payments:

Financial proposal specifying the daily fee in Albanian Lek.

Please note that the financial proposal is all-inclusive and shall take into account various expenses incurred by the consultant/contractor during the contract period (e.g. fee and any other relevant expenses related to the performance of services). In case of travel in or outside of the country related to this assignment, the travel costs will be covered by UN Women separately.

Payment will be made as per the payment schedule in the contract upon (i) satisfactory completion of tasks; (ii) provision of deliverables specified in the ToRs; (iii) submission of and approval of final draft; and (iv) submission of the respective invoice.

Evaluation of applicants:

Candidates will be evaluated using a cumulative analysis method taking into consideration the combination of the applicants’ qualifications and financial proposal. Contract will be awarded to the individual consultant whose offer has been evaluated and determined as:

Responsive/compliant/acceptable; and

Having received the highest score out of below defined technical and financial criteria.

Only candidates obtaining a minimum of 70% (49 points) in the technical evaluation would be considered for financial evaluation.

The maximum number of points assigned to the financial proposal is allocated to the lowest price proposal. All other price proposals receive points in inverse proportion. The calculation formula applied is as follow:
