The project intends to prevent the release in Persistent Organic Pollutants (POPs) in the environment through the improvement of health care waste management, implementation of green chemistry initiatives in the industry and agriculture along with destruction of identified POPs waste stockpiles.

The following POPs will be targeted by the project: Dioxins (PCDD/F) released by unsafe incineration of medical waste and empty pesticide containers, POPs substances listed under Stockholm Convention (SC) on Persistent Organic Pollutants used in the manufacturing of plastic products, with special reference to plastic use in articles exposed to sources of heat; and polychlorinated biphenyls (PCBs) existing in the dielectric fluid of electrical equipment, and obsolete POPs stockpiles/materials.

All these substances pose a global threat to the environment and human health due to their long persistence in the environment, their long term and cumulative toxic properties, and their capacity to bioaccumulate in living organisms.

The overall objective of the project is to reduce risk for people’s health and the environment through the prevention of U-POP releases, shifting from POPs toward non-POPs chemicals in the plastic industry, and sound destruction of at least 50 tons of POPs waste.

Objective

The Objective of this consultancy assignment is a desk review and analysis of shortcomings (GAP analysis) of the existing environmental legal framework, institutional and technical capacities’ needs concerning Stockholm Convention and relevant sectors, and EU legislation with identified legal acts (at the state, entity and Brcko district government levels) subject to amendments/updates, as well as any missing legal documents to be developed.

Purpose

Consultants will develop a GAP analysis of the existing environmental legal framework and institutional needs concerning the Stockholm Convention and EU legislation with identified legal acts (at the state, entity and Brcko district government levels) that will be subject of amendments/updates.

Following the recommendations set in the Environmental Approximation Strategy of BiH, entities and Brcko district, the Consultant is expected to revise NIP and if needed update the current harmonization level of BiH wide legislation with the EU acquis and the Stockholm Convention provisions and define the main gaps of the existing legal framework within the sector.

The GAP analysis should include legal, technical and institutional shortcomings within each sector and respective recommendations for improvements. As the baseline for the relevant bylaws the Consultant shall use all EU legislative acts related to the hazardous waste and chemicals sectors.

The selected consultants are expected to closely coordinate with the Environmental Development Project Manager.

Duties and Responsibilities

Consultants shall conduct a desk review and aa GAP analysis of the existing environmental legal framework, institutional needs and technical capacities needs concerning the Stockholm Convention and relevant EU legislation with identified legal acts (at the state, entity and Brcko district government levels) that will be subject of amendments/updates.

A GAP analysis shall be based that is on three main points: review and update of NIP with regards to current legislation relevant for the Stockholm Convention (and respective sectors), standards and obligations resulting from ratification of a Stockholm Convention by BiH, and technical capacities’ needs of institutions relevant for the Stockholm Convention. Therefore, the document shall identify shortcomings of the above listed three main points (aspects) and propose measures and recommendations for improvement of the situation for every mentioned aspect.

The Desk review shall provide the main information related to obligations of Bosnia and Herzegovina under the Stockholm Convention (objectives, requests), reporting obligations of the country, obligations of respective institutions in terms of data collection and data flow). Moreover, the Desk review shall provide for an overview of the legal and institutional framework in BiH relevant for implementation of the Stockholm Convention (legal acts related to data collection, data flow, institutional obligations, reporting obligations etc.), overview of strategies, reports, documents relevant for the Stockholm Convention.

The Consultant is also expected to help by providing all necessary inputs on Environmental Development Project manager request for developing a list of all chemicals covered by the Stockholm Convention and map institutions in BiH that are potential data sources for each chemical. Consultant is expected to ensure that all is in line with existing documents (NIP, country reports to the Stockholm Convention, etc.).

The Consultant is expected to perform following tasks:

  1. Review the background documentation and detailed work plan developed;
  2. Conduct GAP analysis of the existing environmental legal framework and institutional needs concerning the Stockholm Convention and EU legislation with identified legal acts (at the state, entity and Brcko district government levels) that will be subject of amendments/updates.
  3. Collect comments from Focal Point of the Ministry of Foreign Trade and Economic Relations of BiH, UNDP and all other institutions identified as relevant; answer on all comments and incorporate in document if relevant
  4. Final GAP Analysis of the existing environmental legal framework and institutional needs concerning the Stockholm Convention and EU legislation with identified legal acts (at the state, entity and Brcko district government levels) that will be subject of amendments/updates) delivered to UNDP
  5. Revise and update the list of all chemicals from NIP covered by the Stockholm Convention and their (potential) data sources in BiH. The consultant will update the existing list of chemicals in NIP covered by the Stockholm Convention and map institutions that are potential data sources for each chemical.
  6. Conduct a desk review based on the findings and recommendations of the GAP analyses above. Desk review will, followed by the consultations with working groups, encompass recommendations for enhanced institutional cooperation, reporting procedures and software entry points.

In addition to cooperation with working groups` representatives, the selected consultant is expected to closely coordinate with the Environmental Development Project Manager and Focal Point of the Ministry of Foreign Trade and Economic Relations of BiH.

Note 1: The Consultant must ensure timely preparation and submission of all deliverables as mentioned before. The Deliverables provided will be quality reviewed and approved by the UNDP Environmental Development Project Manager. The deliverables have to be submitted in local language.

Note 2: Payments for deliverables will be lump sum based as per deliverable, including local travel costs.

  • Previous work for UN agencies or international organization will be considered as an asset.

Languages Requirements:

  • Fluency in both written and spoken English language (excellent writing, editing and communication skills) demonstrated in submitted one-page segment on English of any relevant study/publication/written document compiled in order to assess language skills.

  • Excellent computer skills and ability to use information technologies as a tool and resource.
