Background

To address gender-based discrimination in the workplace, UN Women Georgia developed an online sexual harassment course for public servants and since early 2017 the Public Defender’s Office (PDO) has been hosting the course on its website. UN Women office in Georgia has further advocated for inclusion of a clause on non-acceptability of sexual harassment at the workplace in the Code of Ethics for Public Servants and supported the Ministry of Defence and Ministry of IDPs from the Occupied Territories, Refugees and Accommodation in the development of internal complains’ mechanisms on the cases of sexual harassment and gender-based discrimination.

In 2018, UN Women in partnership with national statistical office – GEOSTAT and generous funding from the EU completed a nation-wide survey on Violence against Women that has found that 20 per cent women has experienced sexual harassment in Georgia and 10 per cent of women have admitted experiencing it at the work-place. The reported prevalence rates are high provided also that the field work for the research was carried out in the beginning of 2017, before the global #metoo campaign and few high profile sexual harassment allegation cases brought to public attention also locally in Georgia. These events further increased public’s awareness and sensitivity to sexual harassment prompting the Gender Equality Council of the Parliament to come forward with the legal amendments to better regulate sexual harassment in the Georgian legislation, adopted by the Parliament of Georgia in February 2019.

In addition, 2020 will mark the 20-year anniversary of the UN Security Council Resolution 1325 (2000) — the first resolution to link women’s experiences of conflict to the international peace and security agenda. In April 2019, at the High-Level Commitments event on Women, Peace and Security preparing for the 20th anniversary of UN Security Council Resolution 1325, Government of Georgia pledged to introduce sexual harassment complaints mechanism by the Ministry of Internal Affairs of Georgia before October 2020. The mentioned commitment of the Government of Georgia among other commitments creates an enabling environment for capacity development of security sector representatives to address the sexual harassment in the workplace within and beyond their institutions.

With this increased awareness and the improved regulation of the issue, several public institutions, civil society organizations and private companies expressed interest in developing internal procedures and policies to receive and accommodate sexual harassment complaints. To meet this growing demand, UN Women Georgia Country Office hired international and national consultants to assist organizations with the development of internal sexual harassment complaints’ mechanisms.  The work has been ongoing through 2018-2019. So far, up to 15 organizations have adopted internal sexual harassment complaints mechanisms.

As the investigation process of the sexual harassment cases is quite sensitive, UN Women decided to hire an international consultant who will support the targeted organizations as well as Public Defender’s Office to conduct gender-sensitive investigation processes and develop respective protocols.

The consultancy will be cost shared between projects “A joint Action for Women’s Economic Empowerment in Georgia”, funded by the Government of Norway and “Strengthening Women’s Meaningful Participation in Peacebuilding and Gender Mainstreaming in the Security Sector in Georgia”, funded by the UK Conflict, Stability and Security Fund.

The objectives of the assignment are:

  • To develop protocols for the gender-sensitive investigation of the sexual harassment cases for civil society organizations (CSOs), public sector, academic institutions and private companies based on international best practices;
  • To develop local expertise and capacities around the victim-survivor-centric and trauma informed perspective to the investigation of the sexual harassment cases

Duties and Responsibilities

The duties and responsibilities of the International Consultant are to:

  • To develop draft protocols for the investigation of sexual harassment cases for CSO, public institutions, academic institutions and private companies covering the interviewing techniques and communication throughout investigatory procedures and consulting with victim-survivors;
  • To conduct two two-day trainings on the key principles for devising a protocol on the investigation of the sexual harassment cases and their effective application and use it to finalize the draft protocols together with the training participants;
  • To provide on-line coaching and support to the participants on investigation processes and their practical application;
  • To prepare final report about the work carried out, key observations and recommendations for successful functioning of the protocols on the investigation of sexual harassment cases and its translation into practice.

Deliverables:

  • Work plan with timelines in line with duties and responsibilities spelled above (1 working day)home-based by December 15, 2019;
  • Draft protocols for the investigation of sexual harassment cases for CSO, public institutions, academic institutions and private companies covering the interviewing techniques and communication throughout investigatory procedures and consulting with victim-survivors developed (8 working days) - December 25, 2019;
  • Two 2 day-day trainings for up to 20 participants each conducted and draft protocols on the investigation of the sexual harassment cases finalized (5 working days) - in Georgia by January 24, 2020;
  • On-line coaching and support provided to training participants (5 working days) – home-based by February 10, 2020;
  • Final report prepared and submitted to UN Women (1 working day) – home-based by February 15, 2020.

Required Skills and Experience

Education:

  • Advanced University degree (at least Masters) in Law, Gender, Human Rights, Labor relations, Sociology or similar fields

Experience: 

  • At least three years of proven experience of designing protocols and investigating sexual harassment cases;
  • At least three years of working experience in the field of labour rights and relations and/or discrimination and violence against women in the workplace
  • Sound understanding of women’s rights, gender equality, sex and gender-based discrimination and sexual harassment

Language:

  • Fluency in English (speaking and writing).

Evaluation Procedure:

The candidates will be evaluated in three stages: according to minimum qualification criteria; technical and financial evaluation.

The candidates must possess following minimum qualification criteria to be eligible for further technical evaluation:

  • Advanced University degree (at least Masters) in Law, Gender, Human Rights, Labor relations, Sociology or similar fields;
  • At least three years of proven experience of designing protocols and investigating sexual harassment cases;
  • Fluency in English (speaking and writing);

Technical evaluation criteria (including minimum qualifications):

  • Advanced University degree (at least Masters) in Law, Gender, Human Rights, Labor relations, Sociology or similar fields (max 30 points)
  • At least three years of proven experience of designing protocols and investigating sexual harassment cases 
  •  (max 100 points)
  • At least three years of working experience in the field of labour rights and relations and/or discrimination and violence against women in the workplace (max 100 points)
  • Sound understanding of women’s rights, gender equality, sex and gender-based discrimination and sexual harassment (max 90 points)
  • Fluency in English (speaking and writing) (max 30 points)

Maximum total technical score amounts to 350 points. Only candidates who have passed over the minimum qualification criteria and have accumulated at least 245 points out of maximum 350 under technical evaluation will qualify for the next stage i.e. evaluation of their financial proposals.

Evaluation of submitted financial offers will be done based on the following formula: S = Fmin / F * 150

S – score received on financial evaluation;

Fmin – the lowest financial offer out of all the submitted offers qualified over the technical evaluation round;

F – financial offer under consideration.

The winning candidate will be the candidate, who has accumulated the highest aggregated score (technical scoring + financial scoring).

Management arrangements:

The contractor will report to and work under direct supervision of UN Women Programme Analyst on Women’s Economic Empowerment and UN Women Project Analyst on Women, Peace and Security.

Financial arrangements:

Payment will be disbursed upon submission and approval of deliverables and certification by UN Women Programme Analyst that the services have been satisfactorily performed as specified below:

  • Deliverables 1, 2 – 45%;
  • Deliverables 3,4 & 5 - 55%
